{"id":670394,"date":"2026-04-24T07:46:40","date_gmt":"2026-04-24T05:46:40","guid":{"rendered":"https:\/\/kohenavocats.com\/tribunal-judiciaire-de-tours-le-16-octobre-2024-n23-03894\/"},"modified":"2026-04-26T16:35:24","modified_gmt":"2026-04-26T14:35:24","slug":"tribunal-judiciaire-de-tours-le-16-octobre-2024-n23-03894","status":"publish","type":"post","link":"https:\/\/kohenavocats.com\/zh-hans\/tribunal-judiciaire-de-tours-le-16-octobre-2024-n23-03894\/","title":{"rendered":"Tribunal judiciaire de Tours, le 16 octobre 2024, n\u00b023\/03894"},"content":{"rendered":"<div class=\"article-content\">\n<p>Le tribunal judiciaire, par un jugement du 16 octobre 2024, a rejet\u00e9 une demande en annulation de deux r\u00e9solutions d\u2019une <a href=\"https:\/\/kohenavocats.fr\/elementor-60\/avocats-droit-affaires-paris\/avocat-assemblees-generales-societe-paris-2\/\" target=\"_blank\" title=\"assembl\u00e9e g\u00e9n\u00e9rale\">assembl\u00e9e g\u00e9n\u00e9rale<\/a> de <a href=\"https:\/\/kohenavocats.fr\/droit-de-la-copropriete\/\" target=\"_blank\" title=\"copropri\u00e9t\u00e9\">copropri\u00e9t\u00e9<\/a>. Un copropri\u00e9taire contestait la r\u00e9gularit\u00e9 des d\u00e9lib\u00e9rations adopt\u00e9es le 30 juin 2023. La juridiction a examin\u00e9 le respect des formalit\u00e9s pr\u00e9alables et la nature des d\u00e9cisions prises. Elle a d\u00e9bout\u00e9 le demandeur de l\u2019ensemble de ses pr\u00e9tentions et l\u2019a condamn\u00e9 aux d\u00e9pens ainsi qu\u2019\u00e0 une indemnit\u00e9 sur le fondement de l\u2019article 700 du code de proc\u00e9dure civile.<\/p>\n<p>La qualification restrictive des obligations d\u2019information<\/p>\n<p>Le tribunal \u00e9carte d\u2019abord le grief tir\u00e9 de l\u2019absence de documents joints \u00e0 la convocation pour la r\u00e9solution n\u00b016. Il op\u00e8re une interpr\u00e9tation stricte de l\u2019article 11 du d\u00e9cret du 17 mars 1967. La d\u00e9cision litigieuse portait uniquement sur le choix d\u2019un cabinet de g\u00e9om\u00e8tre-expert. Elle ne constitue pas une modification de l\u2019\u00e9tat descriptif de division au sens de la r\u00e9glementation. &#8220;Il convient surtout de relever que la r\u00e9solution porte uniquement sur le choix d\u2019un cabinet de g\u00e9om\u00e8tre pour actualiser l\u2019\u00e9tat descriptif de division. Il ne s\u2019agit donc pas d\u2019une d\u00e9cision vis\u00e9e par l\u2019article 11 &#8211; I-6\u00b0) du d\u00e9cret du 17 mars 1967&#8221; (Motifs, \u00a71). L\u2019obligation de communication pr\u00e9alable est ainsi circonscrite aux seuls actes modificatifs formels. Cette analyse limite la port\u00e9e des exigences documentaires pour les d\u00e9cisions pr\u00e9paratoires. Elle distingue la d\u00e9signation d\u2019un prestataire de l\u2019<a href=\"https:\/\/kohenavocats.com\/avocats-droit-famille-paris\/avocats-adoption-paris\/\" target=\"_blank\" title=\"adoption\">adoption<\/a> d\u00e9finitive d\u2019un acte modificatif. La solution pr\u00e9serve la fluidit\u00e9 des proc\u00e9dures pour les actes pr\u00e9paratoires. Elle pourrait toutefois r\u00e9duire l\u2019information des copropri\u00e9taires sur des engagements financiers futurs.<\/p>\n<p>L\u2019appr\u00e9ciation in concreto des cons\u00e9quences financi\u00e8res<\/p>\n<p>Le juge rejette ensuite le grief concernant l\u2019absence de devis et de cl\u00e9 de r\u00e9partition des frais. Il fonde sa d\u00e9cision sur une analyse concr\u00e8te du contenu de la r\u00e9solution. Celle-ci pr\u00e9voyait une prise en charge int\u00e9grale des frais par la copropri\u00e9taire directement concern\u00e9e. &#8220;Il y a lieu cependant de constater que la r\u00e9solution n\u2019engage pas en l\u2019\u00e9tat de d\u00e9penses suppl\u00e9mentaires pour les copropri\u00e9taires puisqu\u2019il est d\u00e9cid\u00e9 que \u201cMadame [F] se propose de prendre \u00e0 sa charge l&#8217;ensemble des d\u00e9penses du g\u00e9om\u00e8tre\u201d&#8221; (Motifs, \u00a71). Seule une \u00e9ventualit\u00e9 future, soumise \u00e0 un nouveau vote, pourrait entra\u00eener une d\u00e9pense commune. Cette lecture att\u00e9nue l\u2019exigence de transparence financi\u00e8re pour les d\u00e9cisions conditionnelles. Elle rejoint une jurisprudence exigeant une information pr\u00e9cise sur les co\u00fbts lorsque la d\u00e9cision engage imm\u00e9diatement la copropri\u00e9t\u00e9. &#8220;La seule mention du co\u00fbt pr\u00e9visible des travaux \u00e9tant insuffisante pour satisfaire l\u2019obligation d\u2019information qui incombe au syndic&#8221; (Tribunal judiciaire de Paris, le 23 f\u00e9vrier 2024, n\u00b022\/05980). La port\u00e9e de la d\u00e9cision est de privil\u00e9gier le libell\u00e9 exact de la r\u00e9solution pour appr\u00e9cier son impact financier.<\/p>\n<p>La distinction entre modification et adaptation de l\u2019usage<\/p>\n<p>Concernant la r\u00e9solution n\u00b020 sur les places de stationnement, le tribunal pr\u00e9cise les r\u00e8gles de majorit\u00e9 applicables. Il estime que la nouvelle r\u00e9partition des emplacements ne modifie pas leur usage juridique. Les parties communes conservent leur destination de parking, seul l\u2019attribution entre copropri\u00e9taires change. &#8220;En premier lieu il doit \u00eatre constat\u00e9 que la demande de substituer les places de parking de deux copropri\u00e9taires ne constitue pas une modification de l\u2019usage des parties communes qui restent bien \u00e0 usage de parking&#8221; (Motifs, \u00a72). D\u00e8s lors, l\u2019exigence d\u2019unanimit\u00e9 pr\u00e9vue par le r\u00e8glement pour changer la destination n\u2019est pas applicable. Cette distinction entre modification de l\u2019usage et adaptation de son exercice est essentielle. Elle permet des am\u00e9nagements pratiques sans recourir \u00e0 une majorit\u00e9 renforc\u00e9e. La valeur de cette analyse est de faciliter la gestion courante des parties communes. Elle \u00e9vite de paralyser la copropri\u00e9t\u00e9 par une interpr\u00e9tation trop rigide des r\u00e8gles d\u2019unanimit\u00e9.<\/p>\n<p>L\u2019interpr\u00e9tation t\u00e9l\u00e9ologique des accords anciens<\/p>\n<p>Enfin, le tribunal \u00e9carte l\u2019argument tir\u00e9 d\u2019un accord de 1987 qui pr\u00e9voyait un retour au statu ante en cas de d\u00e9saccord. Il interpr\u00e8te cette clause de mani\u00e8re restrictive et finaliste. &#8220;L\u2019absence d\u2019accord sur une modification de l\u2019attribution des emplacements ne peut avoir pour effet que de maintenir l\u2019attribution actuelle, telle que pr\u00e9vue par l\u2019accord du 14 juin 1987&#8221; (Motifs, \u00a72). La clause ne vise pas \u00e0 an\u00e9antir l\u2019accord initial mais \u00e0 pr\u00e9server l\u2019attribution existante en cas d\u2019\u00e9chec des n\u00e9gociations. Cette interpr\u00e9tation \u00e9vite un effet disproportionn\u00e9 et contraire \u00e0 la s\u00e9curit\u00e9 juridique. Elle garantit la p\u00e9rennit\u00e9 des accords de copropri\u00e9t\u00e9 face \u00e0 des revendications minoritaires. La port\u00e9e de cette solution est de privil\u00e9gier une lecture stabilisatrice des conventions anciennes.
