Le tribunal judiciaire, statuant par jugement r\u00e9put\u00e9 contradictoire, a rendu une d\u00e9cision le 16 mars 2026. L\u2019affaire concernait un litige relatif \u00e0 la propri\u00e9t\u00e9 d\u2019une cave situ\u00e9e sous une parcelle de terrain. La demanderesse initiale sollicitait la reconnaissance de sa propri\u00e9t\u00e9 et l\u2019expulsion de l\u2019occupante. Les d\u00e9fenderesses opposaient des fins de non-recevoir tir\u00e9es de la prescription acquisitive et du d\u00e9faut de qualit\u00e9 \u00e0 agir. Le tribunal a rejet\u00e9 ces exceptions et fait droit aux principales demandes de la requ\u00e9rante.<\/p>\n

La clarification des conditions de la prescription abr\u00e9g\u00e9e<\/p>\n

Le rejet de la fin de non-recevoir fond\u00e9e sur la prescription acquisitive permet d\u2019en pr\u00e9ciser les conditions l\u00e9gales. Le tribunal rappelle le r\u00e9gime de droit commun de la prescription trentenaire et celui, d\u00e9rogatoire, de la prescription abr\u00e9g\u00e9e de dix ans. Il souligne que cette derni\u00e8re suppose une acquisition a non domino, un juste titre et la bonne foi. “Toutefois, celui qui acquiert de bonne foi et par juste titre un immeuble en prescrit la propri\u00e9t\u00e9 par dix ans” (Tribunal judiciaire de Boulogne-sur-Mer, le 24 mars 2026, n\u00b024\/05125). La d\u00e9cision pr\u00e9cise que le juste titre doit \u00eatre un acte qui, s\u2019il \u00e9manait du v\u00e9ritable propri\u00e9taire, serait translatif de propri\u00e9t\u00e9. En l\u2019esp\u00e8ce, le vendeur de 1994 agissait en qualit\u00e9 de propri\u00e9taire et non d\u2019acqu\u00e9reur a non domino. Le titre invoqu\u00e9 par les d\u00e9fenderesses, l\u2019acte de 1961, \u00e9tait un acte d\u2019acquisition aupr\u00e8s du v\u00e9ritable propri\u00e9taire. Par cons\u00e9quent, leurs auteurs ne pouvaient se pr\u00e9valoir de la prescription abr\u00e9g\u00e9e. La prescription trentenaire \u00e9tait quant \u00e0 elle inop\u00e9rante, le d\u00e9lai n\u2019\u00e9tant pas accompli et ayant \u00e9t\u00e9 interrompu par l\u2019assignation. Cette analyse renforce la d\u00e9finition exigeante du juste titre, qui doit n\u00e9cessairement traduire une ali\u00e9nation par un non-propri\u00e9taire pour ouvrir la voie \u00e0 l\u2019usucapion abr\u00e9g\u00e9e.<\/p>\n

Le renforcement de la pr\u00e9somption de propri\u00e9t\u00e9 de l\u2019article 552 du code civil<\/p>\n

Le tribunal \u00e9carte \u00e9galement le moyen tir\u00e9 du d\u00e9faut de qualit\u00e9 \u00e0 agir en affirmant la propri\u00e9t\u00e9 de la demanderesse sur la cave. Il applique strictement la pr\u00e9somption \u00e9tablie par l\u2019article 552 du code civil. “La propri\u00e9t\u00e9 du sol emporte la propri\u00e9t\u00e9 du dessus et du dessous” (Motifs, point 2). Cette pr\u00e9somption ne peut \u00eatre combattue que par un titre ou une prescription acquisitive. Le silence du titre de 1994 quant \u00e0 l\u2019existence de la cave joue en faveur de l\u2019acqu\u00e9reur du sol. Les d\u00e9fenderesses ne rapportent pas la preuve contraire requise. Un projet de cession sous seing priv\u00e9 et un ch\u00e8que non encaiss\u00e9 sont jug\u00e9s insuffisants pour constituer un titre de propri\u00e9t\u00e9. La possession de la cave par les d\u00e9fenderesses est ainsi qualifi\u00e9e d\u2019occupation sans droit ni titre. La d\u00e9cision consacre donc la force de la pr\u00e9somption de l\u2019article 552, qui place une charge probatoire lourde sur celui qui pr\u00e9tend \u00e0 une propri\u00e9t\u00e9 dissoci\u00e9e. Elle rappelle que seuls des \u00e9l\u00e9ments juridiques solides, titre ou usucapion, peuvent la renverser, prot\u00e9geant ainsi la stabilit\u00e9 des droits fonciers.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
