Le locataire est engag\u00e9 dans une proc\u00e9dure de surendettement dont l&#8217;instruction est suspendue. La question est de savoir si cette situation fait obstacle \u00e0 la r\u00e9siliation judiciaire du bail pour impay\u00e9s. Le tribunal prononce la r\u00e9siliation et condamne le locataire au paiement des sommes dues.<\/p>\n<p>La coexistence des proc\u00e9dures de surendettement et de r\u00e9siliation<\/p>\n<p>Le cadre l\u00e9gal pr\u00e9voit une suspension des mesures d&#8217;ex\u00e9cution. La recevabilit\u00e9 du dossier de surendettement entra\u00eene la suspension des proc\u00e9dures d&#8217;ex\u00e9cution. Cette suspension vise le recouvrement des dettes ant\u00e9rieures incluses dans le dossier. &#8220;La recevabilit\u00e9 de la proc\u00e9dure de surendettement, r\u00e9gie notamment par l\u2019article L.331-3 du Code de la consommation, entra\u00eene la suspension des proc\u00e9dures d\u2019ex\u00e9cution tendant au recouvrement des dettes ant\u00e9rieures&#8221; (Motifs). Cette r\u00e8gle prot\u00e8ge le d\u00e9biteur durant l&#8217;instruction de sa situation.<\/p>\n<p>La r\u00e9siliation judiciaire demeure cependant possible malgr\u00e9 cette suspension. La jurisprudence constante admet cette action du bailleur en cas de d\u00e9faut persistant. &#8220;Il est de jurisprudence constante rappelle que la d\u00e9cision de recevabilit\u00e9 ne prive pas le bailleur de la possibilit\u00e9 de demander la r\u00e9siliation judiciaire du bail&#8221; (Motifs). Le l\u00e9gislateur a distingu\u00e9 la suspension de la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> de plein droit. La loi \u00c9LAN suspend cette clause mais pas l&#8217;action en r\u00e9siliation judiciaire. Cette derni\u00e8re reste soumise \u00e0 l&#8217;appr\u00e9ciation souveraine des juges du fond.<\/p>\n<p>Les conditions de fond et de forme de la r\u00e9siliation<\/p>\n<p>Le manquement grave du locataire justifie la rupture du contrat. Le d\u00e9faut de paiement constitue une violation des obligations contractuelles essentielles. &#8220;Le non-paiement de l&#8217;int\u00e9gralit\u00e9 des loyers [&#8230;] constitue une violation grave et renouvel\u00e9e de ses obligations&#8221; (Motifs). En l&#8217;esp\u00e8ce, le locataire n&#8217;a r\u00e9gl\u00e9 que partiellement les loyers du premier semestre 2025. La dette s&#8217;est ainsi accrue de mani\u00e8re significative malgr\u00e9 les rappels.<\/p>\n<p>Le respect des formalit\u00e9s pr\u00e9alables est imp\u00e9ratif pour la recevabilit\u00e9. Le bailleur doit observer les d\u00e9lais apr\u00e8s saisine de la commission de pr\u00e9vention. &#8220;L&#8217;assignation aux fins de constat ou de prononc\u00e9 de la r\u00e9siliation est notifi\u00e9e [&#8230;] au moins six semaines avant l&#8217;audience&#8221; (Motifs). En l&#8217;esp\u00e8ce, la d\u00e9nonciation \u00e0 la pr\u00e9fecture est intervenue six semaines avant l&#8217;audience. La proc\u00e9dure est donc jug\u00e9e r\u00e9guli\u00e8re et recevable dans son ensemble.<\/p>\n<p>La port\u00e9e de la d\u00e9cision affirme la primaut\u00e9 de l&#8217;obligation de paiement. L&#8217;effacement amiable de la dette ne vaut pas paiement effectif aux yeux du juge. La Cour de cassation a clairement \u00e9tabli ce principe dans une d\u00e9cision ant\u00e9rieure. La proc\u00e9dure de surendettement prot\u00e8ge le d\u00e9biteur mais ne lib\u00e8re pas ses obligations courantes. Le locataire doit reprendre le versement int\u00e9gral des loyers pour \u00e9viter la r\u00e9siliation.<\/p>\n<p>La valeur de l&#8217;arr\u00eat r\u00e9side dans le rappel des formalit\u00e9s protectrices. Le juge v\u00e9rifie scrupuleusement le respect du d\u00e9lai de deux mois apr\u00e8s saisine de la commission. Cette r\u00e8gle vise \u00e0 favoriser les solutions amiables avant toute action judiciaire. &#8220;Les bailleurs personnes morales ne peuvent faire d\u00e9livrer, sous peine d&#8217;irrecevabilit\u00e9 [&#8230;] une assignation avant l&#8217;expiration d&#8217;un d\u00e9lai de deux mois&#8221; (Motifs).
