Le bailleur sollicitait la r\u00e9siliation du bail pour d\u00e9faut de paiement et le paiement de sommes. Le locataire opposait l&#8217;irrecevabilit\u00e9 de la premi\u00e8re demande et contestait le montant de la cr\u00e9ance. Le juge a d\u00e9clar\u00e9 irrecevable l&#8217;action en r\u00e9siliation et a dit n&#8217;avoir lieu \u00e0 r\u00e9f\u00e9r\u00e9 sur la demande en paiement, condamnant le bailleur aux d\u00e9pens et \u00e0 une indemnit\u00e9 sur le fondement de l&#8217;article 700 du code de proc\u00e9dure civile.<\/p>\n<p>La sanction d&#8217;une irrecevabilit\u00e9 proc\u00e9durale substantielle<\/p>\n<p>L&#8217;exigence d&#8217;une d\u00e9nonciation pr\u00e9alable \u00e0 l&#8217;action en r\u00e9siliation. Le juge applique strictement les articles 24 de la loi du 6 juillet 1989. Il constate que le demandeur &#8220;ne produit pas les d\u00e9nonciations des assignations au repr\u00e9sentant de l\u2019Etat dans le d\u00e9partement&#8221; (Motifs, Sur la recevabilit\u00e9). Cette formalit\u00e9 substantielle conditionne la recevabilit\u00e9 de la demande en constat de r\u00e9siliation pour d\u00e9faut de paiement. Son omission entra\u00eene l&#8217;irrecevabilit\u00e9 de l&#8217;action principale et des demandes qui en d\u00e9coulent directement. Cette rigueur proc\u00e9durale prot\u00e8ge le locataire en garantissant une information des autorit\u00e9s. Elle rappelle le caract\u00e8re d&#8217;ordre public de cette r\u00e8gle de recevabilit\u00e9, que le juge rel\u00e8ve d&#8217;office.<\/p>\n<p>La port\u00e9e d&#8217;une irrecevabilit\u00e9 automatique et absolue. Cette solution est conforme \u00e0 une jurisprudence constante sur le formalisme protecteur. Un tribunal a d\u00e9j\u00e0 jug\u00e9 que &#8220;la demande de constat de la r\u00e9siliation de plein droit du bail ou de prononc\u00e9 de la r\u00e9siliation du bail pour d\u00e9faut de paiement du loyer et des charges suppose pour sa recevabilit\u00e9 une d\u00e9nonciation de l&#8217;assignation \u00e0 la pr\u00e9fecture&#8221; (Tribunal judiciaire de Paris, le 1 mars 2024, n\u00b023\/06454). L&#8217;irrecevabilit\u00e9 est ici totale car le fondement de l&#8217;action est bien une dette locative impay\u00e9e. Le juge \u00e9carte ainsi toute appr\u00e9ciation au fond sans examiner les preuves du d\u00e9faut de paiement. Cette s\u00e9v\u00e9rit\u00e9 souligne le caract\u00e8re substantiel de l&#8217;obligation de d\u00e9nonciation, qui est une condition essentielle de l&#8217;action.<\/p>\n<p>Le rejet des demandes en r\u00e9f\u00e9r\u00e9 face \u00e0 une contestation s\u00e9rieuse<\/p>\n<p>L&#8217;absence de caract\u00e8re incontestable de la cr\u00e9ance r\u00e9clam\u00e9e. Pour statuer en r\u00e9f\u00e9r\u00e9, le juge applique les articles 834 et 835 du code de proc\u00e9dure civile. Il rel\u00e8ve que la partie d\u00e9fenderesse &#8220;justifie de preuves de paiement et de d\u00e9compte actualis\u00e9 contredisant le d\u00e9compte arr\u00eat\u00e9 \u00e0 la date jointe \u00e0 l\u2019assignation&#8221; (Motifs, Sur la demande en paiement). Ces \u00e9l\u00e9ments \u00e9tablissent une contestation s\u00e9rieuse sur le principe et le montant de la dette all\u00e9gu\u00e9e. Le juge refuse donc d&#8217;allouer une provision ou d&#8217;ordonner un paiement, m\u00eame partiel. Il renvoie les parties \u00e0 statuer au fond sur cette question litigieuse. Cette analyse prot\u00e8ge le d\u00e9biteur contre une ex\u00e9cution forc\u00e9e pr\u00e9cipit\u00e9e.<\/p>\n<p>La confirmation d&#8217;une jurisprudence protectrice du d\u00e9biteur. La d\u00e9cision s&#8217;inscrit dans une ligne jurisprudentielle exigeante sur la preuve de la cr\u00e9ance en r\u00e9f\u00e9r\u00e9. Un autre tribunal a d\u00e9j\u00e0 estim\u00e9 que des justificatifs bancaires et des constats &#8220;\u00e9tayer ses affirmations&#8221; et que &#8220;le principe m\u00eame de la dette, ainsi que son montant se heurtent \u00e0 des contestations s\u00e9rieuses&#8221; (Tribunal judiciaire de Paris, le 28 mai 2024, n\u00b024\/00875). En l&#8217;esp\u00e8ce, la production d&#8217;un d\u00e9compte contradictoire suffit \u00e0 cr\u00e9er un doute s\u00e9rieux. Le juge en d\u00e9duit \u00e9galement l&#8217;absence d&#8217;urgence justifiant le recours \u00e0 la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e du r\u00e9f\u00e9r\u00e9.
