La proc\u00e9dure est engag\u00e9e par le bailleur apr\u00e8s une mise en demeure infructueuse. Le locataire, bien que r\u00e9guli\u00e8rement cit\u00e9, ne compara\u00eet pas \u00e0 l\u2019audience. Le bailleur se d\u00e9siste de sa demande principale apr\u00e8s le paiement de la dette, mais maintient ses demandes accessoires. Le juge statue par d\u00e9faut et condamne le locataire aux d\u00e9pens et \u00e0 une indemnit\u00e9 sur le fondement de l\u2019article 700 du code de proc\u00e9dure civile.<\/p>\n<p>Le traitement du d\u00e9faut de comparution en mati\u00e8re locative<br \/>\nLe juge statue au fond malgr\u00e9 l\u2019absence de la partie d\u00e9fenderesse. L\u2019ordonnance rappelle le principe selon lequel le d\u00e9faut n\u2019\u00e9quivaut pas \u00e0 une acceptation des pr\u00e9tentions adverses. Le juge exerce son contr\u00f4le sur la r\u00e9gularit\u00e9 et le bien-fond\u00e9 de la demande. &#8220;Si le d\u00e9fendeur ne compara\u00eet pas, il est n\u00e9anmoins statu\u00e9 sur le fond et le juge ne fait droit \u00e0 la demande que dans la mesure o\u00f9 il l\u2019estime r\u00e9guli\u00e8re, recevable, et bien fond\u00e9e&#8221; (Motifs de la d\u00e9cision). Cette application stricte de l\u2019article 472 du code de proc\u00e9dure civile prot\u00e8ge la partie absente d\u2019une d\u00e9cision automatique. Elle confirme que le d\u00e9faut n\u2019est pas une voie de proc\u00e9dure facilitant l\u2019admission des demandes. La solution pr\u00e9serve les droits de la d\u00e9fense tout en permettant \u00e0 la justice de trancher le litige. Elle \u00e9vite ainsi une paralysie proc\u00e9durale li\u00e9e \u00e0 l\u2019absence d\u2019une partie.<\/p>\n<p>La sanction des frais de proc\u00e9dure malgr\u00e9 l\u2019extinction du litige principal<br \/>\nLa condamnation aux d\u00e9pens survient apr\u00e8s le d\u00e9sistement de l\u2019action principale. Le juge retient que le locataire a succomb\u00e9 en ne r\u00e9glant sa dette qu\u2019apr\u00e8s l\u2019introduction de l\u2019instance. &#8220;Monsieur [L] [K], qui succombe au sens de l\u2019article 696 du code de proc\u00e9dure civile en ce qu\u2019il ne s\u2019est acquitt\u00e9 de l\u2019arri\u00e9r\u00e9 locatif qu\u2019en cours de proc\u00e9dure, sera condamn\u00e9 aux entiers d\u00e9pens&#8221; (Motifs de la d\u00e9cision). Cette d\u00e9cision distingue clairement l\u2019objet principal du litige et ses cons\u00e9quences proc\u00e9durales. Le paiement tardif n\u2019efface pas les frais engag\u00e9s pour recouvrer la cr\u00e9ance. La solution rappelle que l\u2019article 700 du code de proc\u00e9dure civile vise \u00e0 compenser partiellement les frais non compris dans les d\u00e9pens. Elle sanctionne le comportement du d\u00e9biteur qui oblige son cr\u00e9ancier \u00e0 agir en justice. Cette approche incite au r\u00e8glement amiable des dettes avant toute proc\u00e9dure contentieuse.<\/p>\n<p>La port\u00e9e de la d\u00e9cision en droit du bail social<br \/>\nLa d\u00e9cision illustre l\u2019application des r\u00e8gles de proc\u00e9dure civile au contentieux du bail social. Le juge des contentieux de la protection statue en r\u00e9f\u00e9r\u00e9 selon une proc\u00e9dure particuli\u00e8re. Le d\u00e9sistement apr\u00e8s paiement emp\u00eache le prononc\u00e9 de la r\u00e9solution du bail. Cette issue diff\u00e8re d\u2019une suspension r\u00e9troactive de la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a>. &#8220;La cour retiendra plut\u00f4t que puisque la dette locative a \u00e9t\u00e9 sold\u00e9e, la demande de suspension de la clause r\u00e9solutoire doit en effet aboutir&#8221; (Cour d&#8217;appel de Paris, le 11 f\u00e9vrier 2025, n\u00b022\/13830). La jurisprudence offre au juge le pouvoir d\u2019accorder des d\u00e9lais de paiement r\u00e9troactifs. L\u2019ordonnance comment\u00e9e ne pr\u00e9sente pas cette analyse car le bailleur s\u2019est d\u00e9sist\u00e9. Elle montre cependant l\u2019importance du moment du paiement dans les cons\u00e9quences proc\u00e9durales. Le contentieux locatif reste ainsi marqu\u00e9 par une recherche de pr\u00e9servation du lien contractuel.<\/p>\n<p>Les cons\u00e9quences pratiques de la condamnation sur l\u2019article 700<br \/>\nL\u2019allocation d\u2019une indemnit\u00e9 de cent euros au bailleur compense partiellement ses frais. Cette somme est fix\u00e9e selon l\u2019\u00e9quit\u00e9 et la situation \u00e9conomique des parties. La d\u00e9cision ne d\u00e9taille pas les \u00e9l\u00e9ments pris en compte pour ce quantum. Elle applique le principe selon lequel la partie qui succombe supporte les frais de l\u2019instance. La condamnation aux d\u00e9pens int\u00e8gre les frais d\u2019huissier et d\u2019avocat selon le tarif l\u00e9gal. L\u2019indemnit\u00e9 de l\u2019article 700 couvre les frais non compris dans ces d\u00e9pens judiciaires. Cette distinction est essentielle pour une juste r\u00e9partition des co\u00fbts de la proc\u00e9dure. La solution incite les parties \u00e0 mod\u00e9rer leurs frais de justice pour \u00e9viter une condamnation excessive. Elle rappelle que l\u2019acc\u00e8s \u00e0 la justice comporte un risque financier pour la partie perdante.
