Le bailleur a engag\u00e9 une proc\u00e9dure en r\u00e9f\u00e9r\u00e9 pour impay\u00e9s de loyers, visant \u00e0 obtenir la r\u00e9siliation du bail, l&#8217;expulsion des locataires et le paiement de sommes. Les locataires ne se sont pas pr\u00e9sent\u00e9s \u00e0 l&#8217;audience. Le juge a d\u00e9clar\u00e9 la demande recevable et l&#8217;a enti\u00e8rement accueillie, ordonnant notamment l&#8217;expulsion et condamnant les locataires au paiement de provisions. La d\u00e9cision illustre l&#8217;efficacit\u00e9 du r\u00e9f\u00e9r\u00e9 en mati\u00e8re de contentieux locatif, tout en encadrant strictement les conditions de la r\u00e9siliation pour impay\u00e9s.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<br \/>\nLe juge v\u00e9rifie d&#8217;abord le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;action. La recevabilit\u00e9 de la demande est subordonn\u00e9e au strict respect des d\u00e9lais l\u00e9gaux de la loi du 6 juillet 1989. Le bailleur a produit la notification des impay\u00e9s \u00e0 la commission d\u00e9partementale deux mois avant l&#8217;assignation. Il a \u00e9galement justifi\u00e9 de la d\u00e9nonciation de cette assignation \u00e0 la pr\u00e9fecture six semaines avant l&#8217;audience. Ces conditions de forme, imp\u00e9ratives, sont ainsi satisfaites et permettent l&#8217;examen au fond.<\/p>\n<p>La mise en \u0153uvre effective de la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a><br \/>\nLe juge examine ensuite les conditions de fond de la r\u00e9siliation. Le bailleur a d\u00e9livr\u00e9 un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> visant express\u00e9ment la clause r\u00e9solutoire pour un arri\u00e9r\u00e9 locatif pr\u00e9cis. &#8220;Les sommes vis\u00e9es au commandement n\u2019ont pas \u00e9t\u00e9 int\u00e9gralement pay\u00e9es dans le d\u00e9lai imparti&#8221; (Motifs). Constatant ce d\u00e9faut de paiement, le juge estime que la condition r\u00e9solutoire est r\u00e9alis\u00e9e. Il en d\u00e9duit la r\u00e9siliation du bail \u00e0 une date fixe et en ordonne les cons\u00e9quences, \u00e0 savoir l&#8217;expulsion des lieux sous un d\u00e9lai de sept jours.<\/p>\n<p>La port\u00e9e de ce contr\u00f4le est de prot\u00e9ger le locataire contre une r\u00e9siliation brutale. Le juge rappelle le caract\u00e8re d&#8217;ordre public des d\u00e9lais de la loi de 1989, qui neutralisent temporairement les effets de la clause. La d\u00e9cision s&#8217;inscrit en coh\u00e9rence avec une jurisprudence constante sur le formalisme requis. &#8220;Aux termes des dispositions du premier alin\u00e9a de l&#8217;article L. 145-41 du code de commerce, toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu&#8217;un mois apr\u00e8s un commandement demeur\u00e9 infructueux&#8221; (Tribunal judiciaire de Paris, le 14 mai 2025, n\u00b022\/11698). Le principe, bien que tir\u00e9 du code de commerce, illustre l&#8217;exigence d&#8217;un commandement pr\u00e9alable et d&#8217;un d\u00e9lai de gr\u00e2ce.<\/p>\n<p>Les mesures prononc\u00e9es en r\u00e9f\u00e9r\u00e9 et leur ex\u00e9cution<br \/>\nLa d\u00e9cision accorde des mesures provisoires en attendant un jugement au fond. Consid\u00e9rant que l&#8217;obligation de payer le loyer n&#8217;est pas s\u00e9rieusement contestable, le juge accorde une provision sur la dette locative arr\u00eat\u00e9e \u00e0 une somme pr\u00e9cise. Il condamne \u00e9galement les locataires \u00e0 une indemnit\u00e9 d&#8217;occupation mensuelle jusqu&#8217;\u00e0 la lib\u00e9ration effective des lieux. Ces condamnations p\u00e9cuniaires sont prononc\u00e9es \u00e0 titre provisionnel, conform\u00e9ment aux pouvoirs du juge des r\u00e9f\u00e9r\u00e9s en pr\u00e9sence d&#8217;une obligation peu contestable.<\/p>\n<p>La valeur de ces mesures r\u00e9side dans leur effet imm\u00e9diat et leur caract\u00e8re ex\u00e9cutoire de plein droit. Le juge rappelle que les ordonnances de r\u00e9f\u00e9r\u00e9 sont de droit ex\u00e9cutoires \u00e0 titre provisoire. Il encadre cependant l&#8217;expulsion forc\u00e9e en imposant un commandement de quitter les lieux et un d\u00e9lai minimal de deux mois avant toute intervention de la force publique. Ce d\u00e9lai, pr\u00e9vu par le code des proc\u00e9dures civiles d&#8217;ex\u00e9cution, ne peut \u00eatre r\u00e9duit en l&#8217;absence de circonstances particuli\u00e8res.
