Le bailleur, un organisme HLM, invoque une <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> apr\u00e8s un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> demeur\u00e9 infructueux. Le locataire a repris le paiement du loyer courant avant l\u2019audience. Le juge constate la r\u00e9union des conditions de la clause mais en suspend les effets. Il accorde au locataire des d\u00e9lais de paiement pour l\u2019arri\u00e9r\u00e9, sous conditions strictes. La d\u00e9cision articule ainsi la sanction du manquement contractuel avec une mesure de pr\u00e9vention des expulsions.<\/p>\n<p>Le formalisme proc\u00e9dural de la r\u00e9siliation<\/p>\n<p>Le juge v\u00e9rifie d\u2019abord le strict respect des conditions de recevabilit\u00e9 de l\u2019action. La saisine pr\u00e9alable de la commission de coordination est un pr\u00e9requis imp\u00e9ratif. &#8220;PARTENORD HABITAT justifie avoir saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives (CCAPEX) par lettre recommand\u00e9e avec avis de r\u00e9ception sign\u00e9 le 15 avril 2024&#8221; (Motifs de la d\u00e9cision). La notification de l\u2019assignation \u00e0 la pr\u00e9fecture dans le d\u00e9lai l\u00e9gal est \u00e9galement contr\u00f4l\u00e9e. Ce formalisme protecteur, issu de la loi de 2023, conditionne l\u2019acc\u00e8s au juge pour le bailleur. Il vise \u00e0 garantir une tentative de r\u00e9solution amiable avant toute proc\u00e9dure contentieuse. La port\u00e9e est substantielle, car son inobservation entra\u00eenerait l\u2019irrecevabilit\u00e9 de la demande, prot\u00e9geant ainsi le locataire d\u2019une action pr\u00e9cipit\u00e9e.<\/p>\n<p>L\u2019acquisition conditionn\u00e9e de la clause r\u00e9solutoire<\/p>\n<p>Le juge examine ensuite les conditions de mise en \u0153uvre de la clause contractuelle. Il rappelle le cadre l\u00e9gal imp\u00e9ratif qui r\u00e9git son effet. &#8220;toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus ou pour non-versement du <a href=\"https:\/\/kohenavocats.fr\/avocat-depot-garantie-paris\/\" target=\"_blank\" title=\"d\u00e9p\u00f4t de garantie\">d\u00e9p\u00f4t de garantie<\/a> ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221; (Motifs de la d\u00e9cision). Le commandement signifi\u00e9 le 10 avril 2024 est rest\u00e9 sans effet complet. La jurisprudence confirme cette analyse en jugeant que la clause produit ses effets lorsque les sommes ne sont pas r\u00e9gl\u00e9es dans le d\u00e9lai de deux mois. &#8220;La bailleresse est donc bien fond\u00e9e \u00e0 se pr\u00e9valoir des effets de la clause r\u00e9solutoire, dont les conditions sont r\u00e9unies&#8221; (Tribunal judiciaire de Paris, le 14 janvier 2025, n\u00b024\/03182). La valeur de ce contr\u00f4le est de soumettre la volont\u00e9 contractuelle \u00e0 un garde-fou proc\u00e9dural, emp\u00eachant une r\u00e9siliation automatique et brutale.<\/p>\n<p>La suspension judiciaire des effets de la clause<\/p>\n<p>Le c\u0153ur de la d\u00e9cision r\u00e9side dans l\u2019am\u00e9nagement des cons\u00e9quences de la r\u00e9siliation. Constatant la reprise des paiements courants, le juge use de son pouvoir d\u2019ajuster les d\u00e9lais. &#8220;Lorsque le juge est saisi en ce sens par le bailleur ou par le locataire, et \u00e0 la condition que celui-ci ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience, les effets de la clause de r\u00e9siliation de plein droit peuvent \u00eatre suspendus&#8221; (Motifs de la d\u00e9cision). Il autorise un apurement de la dette par mensualit\u00e9s, suspend la clause pendant ce d\u00e9lai, et pr\u00e9voit son an\u00e9antissement r\u00e9troactif en cas de succ\u00e8s. Cette solution int\u00e8gre le diagnostic social et financier du locataire. La port\u00e9e est majeure : elle transforme une proc\u00e9dure essentiellement r\u00e9pressive en un outil de traitement social des impay\u00e9s, favorisant le maintien dans les lieux.<\/p>\n<p>Le r\u00e9gime dissuasif de la d\u00e9faillance ult\u00e9rieure<\/p>\n<p>La bienveillance du juge est toutefois encadr\u00e9e par un dispositif contraignant en cas de nouvelle d\u00e9faillance. Le jugement \u00e9nonce un m\u00e9canisme de retour \u00e0 la situation initiale en cas d\u2019impay\u00e9. &#8220;toute mensualit\u00e9, qu&#8217;elle soit due au titre du loyer et des charges courants ou de l&#8217;arri\u00e9r\u00e9, rest\u00e9e impay\u00e9e 15 jours apr\u00e8s une mise en demeure [&#8230;] justifiera : que la clause r\u00e9solutoire retrouve son plein effet&#8221; (Par ces motifs). Il pr\u00e9voit \u00e9galement l\u2019exigibilit\u00e9 imm\u00e9diate du solde, l\u2019expulsion et le paiement d\u2019une indemnit\u00e9 d\u2019occupation. Ce dispositif biface assure l\u2019effectivit\u00e9 de la mesure de gr\u00e2ce en mena\u00e7ant de cons\u00e9quences imm\u00e9diates et graves.
