Le bailleur, un office public de l\u2019habitat, assigne son locataire apr\u00e8s un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> rest\u00e9 infructueux. La d\u00e9cision traite de la recevabilit\u00e9 de la demande et du fond du litige, notamment l\u2019application dans le temps de la loi du 27 juillet 2023. Elle constate la r\u00e9siliation du bail mais accorde au locataire des d\u00e9lais de paiement suspendant ses effets.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le respect des formalit\u00e9s pr\u00e9alables \u00e0 l\u2019assignation. Le l\u00e9gislateur a instaur\u00e9 une saisine obligatoire de la commission de coordination des actions de pr\u00e9vention des expulsions. Cette formalit\u00e9 constitue une condition de recevabilit\u00e9 de l\u2019action en r\u00e9siliation pour les bailleurs personnes morales. &#8220;Cette saisine est r\u00e9put\u00e9e constitu\u00e9e d\u00e8s lors que persiste une situation d&#8217;impay\u00e9s pr\u00e9alablement signal\u00e9e dans les conditions r\u00e9glementaires aux organismes payeurs des aides au logement&#8221; (Motifs). La d\u00e9cision valide ainsi une proc\u00e9dure simplifi\u00e9e de saisine par signalement pr\u00e9alable. Elle assure la coordination entre la proc\u00e9dure judiciaire et le maintien des aides personnelles au logement.<\/p>\n<p>L\u2019accomplissement des notifications impos\u00e9es par la loi. Le bailleur doit \u00e9galement notifier sa demande \u00e0 l\u2019autorit\u00e9 pr\u00e9fectorale comp\u00e9tente. Cette notification intervient par voie \u00e9lectronique plus de six semaines avant l\u2019audience. Le juge v\u00e9rifie scrupuleusement le respect de ce d\u00e9lai l\u00e9gal imp\u00e9ratif. Cette exigence garantit une information transparente des pouvoirs publics. Elle permet \u00e0 l\u2019\u00c9tat de mobiliser, le cas \u00e9ch\u00e9ant, les dispositifs d\u2019accompagnement social des locataires en difficult\u00e9.<\/p>\n<p>L\u2019application dans le temps de la r\u00e9forme des d\u00e9lais de r\u00e9siliation<\/p>\n<p>Le maintien de l\u2019ancien d\u00e9lai pour les contrats en cours. La loi du 27 juillet 2023 a r\u00e9duit le d\u00e9lai apr\u00e8s commandement de deux mois \u00e0 six semaines. La question centrale est l\u2019applicabilit\u00e9 imm\u00e9diate de ce nouveau d\u00e9lai aux baux ant\u00e9rieurs. Le juge applique le principe de non-r\u00e9troactivit\u00e9 des lois pos\u00e9 \u00e0 l\u2019article 2 du Code civil. &#8220;La loi du 27 juillet 2023 ne comprend pas de disposition d\u00e9rogeant \u00e0 l&#8217;article 2 du code civil, selon lequel la loi ne dispose que pour l&#8217;avenir et n&#8217;a point d&#8217;effet r\u00e9troactif&#8221; (Motifs). Cette solution pr\u00e9serve la s\u00e9curit\u00e9 juridique et la stabilit\u00e9 des conventions. Elle rejoint une jurisprudence constante sur le droit transitoire des relations contractuelles.<\/p>\n<p>La validation de la clause contractuelle conforme \u00e0 l\u2019ancien droit. Le bail litigieux contenait une <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> pr\u00e9voyant un d\u00e9lai de deux mois. Ce d\u00e9lai \u00e9tait conforme \u00e0 la loi en vigueur lors de la conclusion du contrat. Le juge constate donc son acquisition \u00e0 la date pr\u00e9vue par les stipulations. &#8220;Il convient en cons\u00e9quence de constater que les conditions d&#8217;acquisition de la clause r\u00e9solutoire sont r\u00e9unies \u00e0 la date du 30 D\u00e9cembre 2024&#8221; (Motifs). Cette approche respecte la volont\u00e9 des parties et la loi qui r\u00e9gissait leur accord. Elle \u00e9vite une r\u00e9faction r\u00e9troactive du contrat qui serait contraire au droit commun.<\/p>\n<p>La conciliation entre r\u00e9siliation pour impay\u00e9s et maintien dans les lieux<\/p>\n<p>L\u2019octroi de d\u00e9lais de paiement comme mesure de gr\u00e2ce. Malgr\u00e9 la r\u00e9siliation constat\u00e9e, le juge use de son pouvoir d\u2019am\u00e9nagement. Il peut accorder des d\u00e9lais si le locataire a repris le paiement du loyer courant. &#8220;Sa proposition de r\u00e8glement qui appara\u00eet adapt\u00e9e \u00e0 sa situation permettrait de solder la dette dans les d\u00e9lais l\u00e9gaux&#8221; (Motifs). Cette facult\u00e9 t\u00e9moigne de la vocation sociale du juge des contentieux de la protection. Elle subordonne l\u2019expulsion \u00e0 une ultime tentative de redressement de la situation du d\u00e9biteur.<\/p>\n<p>La suspension conditionnelle des effets de la clause r\u00e9solutoire. L\u2019octroi de d\u00e9lais suspend l\u2019effet imm\u00e9diat de la r\u00e9siliation. &#8220;Les effets de la clause de r\u00e9siliation de plein droit sont suspendus pendant le cours des d\u00e9lais de paiement ainsi accord\u00e9s&#8221; (Motifs). Le maintien dans les lieux devient ainsi strictement conditionnel au respect d\u2019un \u00e9ch\u00e9ancier. Ce m\u00e9canisme \u00e9quilibre la protection du locataire et les droits du bailleur cr\u00e9ancier. Il transforme une d\u00e9cision de constatation en une mesure d\u2019apurement contr\u00f4l\u00e9 de la dette.<\/p>\n<p>Cette d\u00e9cision illustre la complexit\u00e9 du droit transitoire en mati\u00e8re de bail d\u2019habitation. Elle affirme avec force le principe de non-r\u00e9troactivit\u00e9 pour les contrats en cours. Le juge refuse d\u2019appliquer imm\u00e9diatement le d\u00e9lai raccourci de la loi nouvelle. Cette solution garantit la s\u00e9curit\u00e9 des conventions et la pr\u00e9visibilit\u00e9 du droit. Elle s\u2019inscrit en coh\u00e9rence avec la jurisprudence ant\u00e9rieure sur le sujet.<\/p>\n<p>Par ailleurs, l\u2019arr\u00eat d\u00e9montre la dimension \u00e9minemment sociale de la justice du logement. Le constat de r\u00e9siliation n\u2019aboutit pas \u00e0 une expulsion automatique et imm\u00e9diate. Le juge use de ses pouvoirs pour am\u00e9nager un d\u00e9lai de paiement r\u00e9aliste. Cette conciliation entre l\u2019ex\u00e9cution du contrat et la pr\u00e9vention des expulsions est essentielle.
