Le tribunal judiciaire d’Angers, statuant en r\u00e9f\u00e9r\u00e9 le 29 mai 2025, se prononce sur une demande d’expulsion et de provisions. Une commune avait consenti une convention d’occupation temporaire \u00e0 une soci\u00e9t\u00e9 et son g\u00e9rant. Apr\u00e8s notification d’un cong\u00e9 r\u00e9gulier, les occupants se sont maintenus dans les lieux au-del\u00e0 du terme. Le juge des r\u00e9f\u00e9r\u00e9s ordonne leur expulsion et les condamne au paiement de provisions. Il retient que le maintien sans droit constitue un trouble manifestement illicite justifiant une mesure d’urgence.<\/p>\n

La caract\u00e9risation d’un trouble manifestement illicite<\/p>\n

Le juge des r\u00e9f\u00e9r\u00e9s fonde sa comp\u00e9tence sur l’existence d’un trouble \u00e0 faire cesser. Il applique l’article 835 du code de proc\u00e9dure civile qui permet de prescrire des mesures urgentes. Le trouble illicite r\u00e9sulte ici du maintien dans les lieux apr\u00e8s l’\u00e9ch\u00e9ance du titre. La d\u00e9cision \u00e9nonce que “le maintien dans un immeuble, sans droit ni titre du fait de la non reconduction d\u2019une convention d\u2019occupation temporaire, constitue un trouble manifestement illicite.” (Motifs, I). Cette qualification est imm\u00e9diate d\u00e8s la preuve du cong\u00e9 r\u00e9gulier. La port\u00e9e de cette analyse est de simplifier le contr\u00f4le du juge des r\u00e9f\u00e9r\u00e9s. Il lui suffit de constater l’absence de titre valable apr\u00e8s le terme pour caract\u00e9riser l’illic\u00e9it\u00e9. Cette approche rejoint une jurisprudence constante sur la nature du trouble. Ainsi, un tribunal a d\u00e9j\u00e0 jug\u00e9 que “Le maintien dans un immeuble, sans droit ni titre, constitue un trouble manifestement illicite.” (Tribunal judiciaire de Cr\u00e9teil, le 2 d\u00e9cembre 2025, n\u00b024\/00286). La valeur de ce point est de conforter une interpr\u00e9tation large et protectrice du propri\u00e9taire.<\/p>\n

La r\u00e9gularit\u00e9 de la proc\u00e9dure de cong\u00e9<\/p>\n

La recevabilit\u00e9 de la demande d’expulsion est subordonn\u00e9e \u00e0 un cong\u00e9 r\u00e9gulier. Le juge v\u00e9rifie scrupuleusement le respect des clauses contractuelles et des formalit\u00e9s. La convention pr\u00e9voyait un cong\u00e9 possible \u00e0 tout moment avec un pr\u00e9avis d’un mois. Il constate que “la commune a notifi\u00e9 la non reconduction de la convention par courrier recommand\u00e9 avec accus\u00e9 de r\u00e9ception du 18 septembre 2024.” (Motifs, I). Ce courrier fixait le terme au 1er novembre, respectant ainsi le d\u00e9lai de pr\u00e9avis contractuel. La solution assure une s\u00e9curit\u00e9 juridique aux deux parties en exigeant le strict respect des formes. La port\u00e9e est de faire pr\u00e9valoir la force obligatoire du contrat, rappel\u00e9e par l’article 1103 du code civil. Le sens de cette rigueur est d’\u00e9viter tout arbitraire dans la rupture de l’occupation pr\u00e9caire. Le juge en d\u00e9duit logiquement que les occupants sont sans droit ni titre \u00e0 compter du 2 novembre. Cette analyse justifie pleinement la mesure d’expulsion prononc\u00e9e en r\u00e9f\u00e9r\u00e9.<\/p>\n

Le r\u00e9gime de l’indemnit\u00e9 d’occupation apr\u00e8s le terme<\/p>\n

Le juge statue \u00e9galement sur la demande de provisions au titre de l’occupation irr\u00e9guli\u00e8re. Il op\u00e8re une distinction fondamentale entre la redevance contractuelle et l’indemnit\u00e9 due apr\u00e8s le terme. Il rappelle qu'”\u00e0 compter du terme de la convention, le locataire n\u2019est plus d\u00e9biteur de redevances, mais d\u2019une indemnit\u00e9 d\u2019occupation.” (Motifs, II). Cette indemnit\u00e9 r\u00e9pare le pr\u00e9judice de la privation de jouissance. En l’absence de stipulation contractuelle, le juge fixe son montant \u00e0 celui de l’ancienne redevance mensuelle. La port\u00e9e de cette solution est de garantir une r\u00e9paration int\u00e9grale et continue du pr\u00e9judice. Elle rejoint la position d’une cour d’appel pr\u00e9cisant que l’indemnit\u00e9 “doit n\u00e9cessairement comprendre, d\u00e8s lors qu’il n’est pas d\u00e9montr\u00e9 que la valeur locative est inf\u00e9rieure au montant du loyer, et afin de r\u00e9parer int\u00e9gralement le pr\u00e9judice […] ne saurait, de ce fait, \u00eatre inf\u00e9rieure \u00e0 la somme qui aurait \u00e9t\u00e9 pay\u00e9e en cas de poursuite du bail.” (Cour d’appel de Versailles, le 5 septembre 2023, n\u00b022\/01395). La valeur est d’\u00e9viter tout enrichissement sans cause de l’occupant.<\/p>\n

L’octroi de provisions sur une obligation non s\u00e9rieusement contestable<\/p>\n

Le juge accorde des provisions en application de l’article 835 alin\u00e9a 2 du code de proc\u00e9dure civile. Il rappelle la r\u00e9partition de la charge de la preuve dans ce cadre. “Il appartient au demandeur de prouver l\u2019existence de l\u2019obligation, puis au d\u00e9fendeur de d\u00e9montrer qu\u2019il existe une contestation s\u00e9rieuse.” (Motifs, II). En l’esp\u00e8ce, la d\u00e9faut de comparution des occupants \u00e9quivaut \u00e0 une absence de contestation. Le juge estime donc l’obligation de payer l’indemnit\u00e9 d’occupation non s\u00e9rieusement contestable. Il condamne ainsi les d\u00e9fendeurs au paiement de provisions mensuelles jusqu’\u00e0 lib\u00e9ration des lieux. La port\u00e9e de cette d\u00e9cision est d’assurer une ex\u00e9cution provisoire rapide des cr\u00e9ances certaines. Le sens est de ne pas laisser le propri\u00e9taire supporter seul les cons\u00e9quences financi\u00e8res de l’occupation illicite.
