La vraie difficult\u00e9 n&#8217;est pas seulement de conna\u00eetre le taux de majoration. Elle consiste \u00e0 construire un dossier suffisamment pr\u00e9cis pour que le conseil de prud&#8217;hommes puisse comparer les horaires all\u00e9gu\u00e9s par le salari\u00e9 avec les \u00e9l\u00e9ments de contr\u00f4le que l&#8217;employeur devait conserver.<\/p>\n<p>Cet angle est distinct du simple rappel de la charge de la preuve. Ici, l&#8217;objectif est pratique : que faire lorsque les heures ont \u00e9t\u00e9 r\u00e9alis\u00e9es, non pay\u00e9es, parfois r\u00e9cup\u00e9r\u00e9es partiellement, et que l&#8217;employeur r\u00e9pond qu&#8217;il n&#8217;a jamais demand\u00e9 ces heures ou qu&#8217;elles ont d\u00e9j\u00e0 \u00e9t\u00e9 compens\u00e9es.<\/p>\n<h2>Ce qui d\u00e9clenche le droit au paiement<\/h2>\n<p>Le point de d\u00e9part est l&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033020373\">L. 3121-28 du code du travail<\/a>. Toute heure accomplie au-del\u00e0 de la dur\u00e9e l\u00e9gale hebdomadaire, ou de la dur\u00e9e \u00e9quivalente applicable, constitue une heure suppl\u00e9mentaire. Elle ouvre droit soit \u00e0 une majoration salariale, soit \u00e0 un repos compensateur \u00e9quivalent lorsque les r\u00e8gles applicables le pr\u00e9voient.<\/p>\n<p>Il faut donc v\u00e9rifier quatre points avant de chiffrer :<\/p>\n<ul>\n<li>la dur\u00e9e contractuelle et l&#8217;\u00e9ventuel am\u00e9nagement du temps de travail ;<\/li>\n<li>les semaines r\u00e9ellement travaill\u00e9es au-del\u00e0 du seuil applicable ;<\/li>\n<li>les heures d\u00e9j\u00e0 pay\u00e9es ou d\u00e9j\u00e0 r\u00e9cup\u00e9r\u00e9es ;<\/li>\n<li>les r\u00e8gles de majoration pr\u00e9vues par l&#8217;accord collectif ou, \u00e0 d\u00e9faut, par le code du travail.<\/li>\n<\/ul>\n<p>Le salari\u00e9 \u00e0 temps partiel n&#8217;est pas dans le m\u00eame r\u00e9gime : il r\u00e9clame en principe des heures compl\u00e9mentaires, non des heures suppl\u00e9mentaires. Le salari\u00e9 en forfait jours doit, lui, commencer par v\u00e9rifier la validit\u00e9 et le suivi r\u00e9el de son forfait. Cette r\u00e9ponse ne suffit pas toujours. Des heures peuvent \u00eatre dues si elles ont \u00e9t\u00e9 demand\u00e9es directement, si l&#8217;employeur les a accept\u00e9es implicitement, ou si elles \u00e9taient rendues n\u00e9cessaires par la charge de travail confi\u00e9e.<\/p>\n<p>La documentation officielle de l&#8217;administration sur les heures suppl\u00e9mentaires rappelle cette logique : le paiement ne d\u00e9pend pas seulement d&#8217;un formulaire d&#8217;autorisation pr\u00e9alable lorsque l&#8217;employeur connaissait ou devait conna\u00eetre la surcharge et ne l&#8217;a pas emp\u00each\u00e9e.<\/p>\n<p>Concr\u00e8tement, un dossier solide ne se limite pas \u00e0 dire que l&#8217;on travaillait beaucoup. Il relie les horaires \u00e0 des faits v\u00e9rifiables : fermeture tardive, astreinte d\u00e9guis\u00e9e, dossiers \u00e0 rendre le soir, messages du manager, objectifs incompatibles avec l&#8217;horaire normal, validation de temps dans un outil interne, badgeage, mails envoy\u00e9s apr\u00e8s l&#8217;horaire collectif ou consignes re\u00e7ues pendant les repos.<\/p>\n<h2>Le r\u00e9gime de preuve : le salari\u00e9 n&#8217;a pas \u00e0 tout prouver seul<\/h2>\n<p>L&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006902808\">L. 3171-4 du code du travail<\/a> organise un m\u00e9canisme probatoire partag\u00e9. Le salari\u00e9 apporte des \u00e9l\u00e9ments suffisamment pr\u00e9cis sur les heures qu&#8217;il pr\u00e9tend avoir accomplies. L&#8217;employeur doit ensuite fournir ses propres \u00e9l\u00e9ments permettant de justifier les horaires effectivement r\u00e9alis\u00e9s.<\/p>\n<p>La Cour de cassation l&#8217;a rappel\u00e9 de mani\u00e8re structurante dans l&#8217;arr\u00eat du <a href=\"https:\/\/www.courdecassation.fr\/decision\/5fca5991f623992e47e153be\">18 mars 2020, n\u00b0 18-10.919<\/a>, publi\u00e9 au Bulletin et au Rapport : le juge forme sa conviction \u00e0 partir des \u00e9l\u00e9ments produits par les deux parties et peut fixer la cr\u00e9ance sans d\u00e9tailler math\u00e9matiquement chaque minute retenue.<\/p>\n<p>Cette m\u00e9thode a \u00e9t\u00e9 r\u00e9affirm\u00e9e dans l&#8217;arr\u00eat du <a href=\"https:\/\/www.courdecassation.fr\/decision\/64117335f6c989fb024356a7\">15 mars 2023, n\u00b0 21-16.057<\/a>. La Cour censure une d\u00e9cision qui avait fait peser la preuve sur le seul salari\u00e9 alors que celui-ci produisait des \u00e9l\u00e9ments permettant \u00e0 l&#8217;employeur de r\u00e9pondre.<\/p>\n<h2>Quelles pi\u00e8ces r\u00e9unir quand les heures n&#8217;ont pas \u00e9t\u00e9 pay\u00e9es<\/h2>\n<p>Le meilleur dossier combine un d\u00e9compte hebdomadaire et des pi\u00e8ces de contexte.<\/p>\n<p>Le d\u00e9compte doit id\u00e9alement mentionner, semaine par semaine, les horaires de d\u00e9but et de fin, les pauses, le total hebdomadaire, les heures d\u00e9j\u00e0 pay\u00e9es, les heures r\u00e9cup\u00e9r\u00e9es et le solde demand\u00e9. Il peut \u00eatre \u00e9tabli apr\u00e8s coup, si les donn\u00e9es sont reconstruites s\u00e9rieusement. Le probl\u00e8me n&#8217;est pas qu&#8217;un tableau soit fait a posteriori ; le probl\u00e8me est qu&#8217;il soit trop global, incoh\u00e9rent ou impossible \u00e0 discuter.<\/p>\n<p>Les pi\u00e8ces utiles sont notamment :<\/p>\n<ul>\n<li>mails envoy\u00e9s ou re\u00e7us en dehors de l&#8217;horaire normal ;<\/li>\n<li>SMS ou messages internes demandant une t\u00e2che tardive ;<\/li>\n<li>captures d&#8217;outil de planning, ticketing, CRM ou badgeage ;<\/li>\n<li>agenda professionnel, rendez-vous clients, feuilles de route ;<\/li>\n<li>attestations de coll\u00e8gues ou clients, r\u00e9dig\u00e9es pr\u00e9cis\u00e9ment ;<\/li>\n<li>bulletins de paie montrant l&#8217;absence de paiement ou un paiement partiel ;<\/li>\n<li>demandes \u00e9crites de r\u00e9gularisation et r\u00e9ponses de l&#8217;employeur ;<\/li>\n<li>preuve d&#8217;une r\u00e9cup\u00e9ration impos\u00e9e sans solde clair.<\/li>\n<\/ul>\n<p>Il faut \u00e9viter deux erreurs. La premi\u00e8re consiste \u00e0 produire uniquement un total mensuel. Les heures suppl\u00e9mentaires se raisonnent en principe par semaine. La seconde consiste \u00e0 r\u00e9clamer deux fois la m\u00eame chose : une heure d\u00e9j\u00e0 pay\u00e9e, une heure valablement r\u00e9cup\u00e9r\u00e9e, ou une absence transform\u00e9e artificiellement en temps de travail.<\/p>\n<h2>Heures non pay\u00e9es mais &#8220;r\u00e9cup\u00e9r\u00e9es&#8221; : le point \u00e0 contr\u00f4ler<\/h2>\n<p>Le mot &#8220;r\u00e9cup\u00e9ration&#8221; est souvent utilis\u00e9 de mani\u00e8re floue. Une entreprise peut organiser du repos compensateur dans certaines conditions. En revanche, elle ne peut pas effacer des heures suppl\u00e9mentaires non pay\u00e9es par un simple arrangement verbal si le repos n&#8217;est pas tra\u00e7able, \u00e9quivalent et conforme aux r\u00e8gles applicables.<\/p>\n<p>Le salari\u00e9 doit donc demander :<\/p>\n<ul>\n<li>quelles semaines ont g\u00e9n\u00e9r\u00e9 les heures ;<\/li>\n<li>quel volume a \u00e9t\u00e9 plac\u00e9 en repos ;<\/li>\n<li>\u00e0 quelles dates le repos a \u00e9t\u00e9 pris ;<\/li>\n<li>quel taux de majoration a \u00e9t\u00e9 appliqu\u00e9 ;<\/li>\n<li>si le contingent annuel a \u00e9t\u00e9 d\u00e9pass\u00e9 ;<\/li>\n<li>si les bulletins de paie font appara\u00eetre le paiement ou la compensation.<\/li>\n<\/ul>\n<p>Si l&#8217;employeur r\u00e9pond seulement que &#8220;tout a \u00e9t\u00e9 r\u00e9cup\u00e9r\u00e9&#8221;, sans tableau, sans compte de repos, sans bulletin clair et sans tra\u00e7abilit\u00e9, la contestation reste ouverte.<\/p>\n<h2>Quel montant demander<\/h2>\n<p>Le calcul part du taux horaire brut. \u00c0 d\u00e9faut d&#8217;accord collectif plus favorable ou diff\u00e9rent dans les limites l\u00e9gales, les heures suppl\u00e9mentaires accomplies au-del\u00e0 de 35 heures donnent g\u00e9n\u00e9ralement lieu \u00e0 majoration. Le rappel de salaire entra\u00eene aussi les cong\u00e9s pay\u00e9s aff\u00e9rents.<\/p>\n<p>L&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000027566295\">L. 3245-1 du code du travail<\/a> fixe le d\u00e9lai de prescription de l&#8217;action en paiement du salaire. En pratique, il faut raisonner sur les trois derni\u00e8res ann\u00e9es, avec une attention particuli\u00e8re au point de rupture du contrat lorsque le salari\u00e9 agit apr\u00e8s son d\u00e9part.<\/p>\n<p>La demande peut aussi avoir des cons\u00e9quences indirectes. Si un rappel important est reconnu, il peut modifier la base de calcul de certaines indemnit\u00e9s de rupture, notamment lorsque les douze derniers mois auraient d\u00fb inclure ces heures. C&#8217;est un point \u00e0 int\u00e9grer d\u00e8s la saisine, car il peut changer l&#8217;int\u00e9r\u00eat \u00e9conomique du dossier.<\/p>\n<h2>Quelle strat\u00e9gie avant les prud&#8217;hommes<\/h2>\n<p>La premi\u00e8re \u00e9tape consiste souvent \u00e0 envoyer une demande \u00e9crite courte et chiffr\u00e9e. Elle doit \u00e9viter les accusations inutiles et viser les pi\u00e8ces : d\u00e9compte, bulletins, heures r\u00e9cup\u00e9r\u00e9es, documents de contr\u00f4le, planning. Cette \u00e9tape sert aussi \u00e0 dater la contestation.<\/p>\n<p>La deuxi\u00e8me \u00e9tape consiste \u00e0 stabiliser le tableau. Il faut isoler les semaines prescrites, retirer les heures d\u00e9j\u00e0 pay\u00e9es, distinguer les p\u00e9riodes d&#8217;absence, les jours f\u00e9ri\u00e9s, les cong\u00e9s, les temps de trajet et les astreintes. Un tableau trop ambitieux mais mal tenu affaiblit l&#8217;ensemble du dossier.<\/p>\n<p>La troisi\u00e8me \u00e9tape est prud&#8217;homale : r\u00e9f\u00e9r\u00e9 si le dossier est simple et l&#8217;obligation peu contestable, proc\u00e9dure au fond si l&#8217;employeur conteste la r\u00e9alit\u00e9 des heures, le mode de calcul ou la qualification. Le choix d\u00e9pend du niveau de contradiction attendu.<\/p>\n<h2>Le delta utile par rapport aux contenus existants<\/h2>\n<p>Les contenus g\u00e9n\u00e9ralistes expliquent la d\u00e9finition des heures suppl\u00e9mentaires et la charge de la preuve. Les benchmarks Service-Public, \u00c9ditions Tissot et Odrius montrent que l&#8217;information disponible reste souvent centr\u00e9e sur le principe.
