L\u2019instance concernait une intervention volontaire et une action en trouble anormal de voisinage. La juridiction a accueilli l\u2019intervention, retenu l\u2019existence d\u2019un trouble pour perte de vue et accord\u00e9 une indemnisation pour pr\u00e9judice moral, tout en rejetant les autres demandes.<\/p>\n<p>La recevabilit\u00e9 de l\u2019intervention volontaire<\/p>\n<p>L\u2019intervention a \u00e9t\u00e9 jug\u00e9e recevable au regard de l\u2019int\u00e9r\u00eat \u00e0 agir du requ\u00e9rant. L\u2019article 329 du code de proc\u00e9dure civile dispose que \u00ab l\u2019intervention est principale lorsqu\u2019elle \u00e9l\u00e8ve une pr\u00e9tention au profit de celui qui la forme \u00bb (article 329 du code de proc\u00e9dure civile). La d\u00e9cision constate que l\u2019intervenant est \u00e9galement propri\u00e9taire de l\u2019immeuble concern\u00e9 par les travaux litigieux. Cette qualit\u00e9 lui conf\u00e8re un int\u00e9r\u00eat direct \u00e0 la solution du litige, justifiant sa participation \u00e0 l\u2019instance. Cette solution rappelle que l\u2019intervention volontaire n\u00e9cessite un lien juridique suffisant avec l\u2019affaire. Elle s\u2019inscrit en coh\u00e9rence avec la jurisprudence qui exige un int\u00e9r\u00eat pour la conservation de ses droits.<\/p>\n<p>La caract\u00e9risation du trouble anormal de voisinage<\/p>\n<p>La cour a op\u00e9r\u00e9 une distinction nette entre la perte d\u2019ensoleillement et la perte de vue. Concernant l\u2019ensoleillement, les juges ont estim\u00e9 que la preuve n\u2019\u00e9tait pas rapport\u00e9e d\u2019un d\u00e9passement du seuil de tol\u00e9rance. Ils ont relev\u00e9 la contradiction entre les expertises et le caract\u00e8re urbain des lieux. En revanche, la perte de vue a \u00e9t\u00e9 retenue comme constitutive d\u2019un trouble anormal. &#8220;Ce sentiment d\u2019enfermement qui d\u00e9coule de la perte de vue constitue un trouble anormal du voisinage, y compris dans une zone urbaine&#8221; (Motifs, point 2). La d\u00e9cision affirme ainsi l\u2019autonomie du pr\u00e9judice d\u2019agr\u00e9ment li\u00e9 \u00e0 la vue. Elle consacre une appr\u00e9ciation in concreto des nuisances, ind\u00e9pendante des r\u00e8gles d\u2019urbanisme.<\/p>\n<p>La r\u00e9paration s\u00e9lective des pr\u00e9judices invoqu\u00e9s<\/p>\n<p>Le tribunal a adopt\u00e9 une analyse exigeante de la preuve pour chaque chef de pr\u00e9judice. Le pr\u00e9judice mat\u00e9riel, fond\u00e9 sur une d\u00e9pr\u00e9ciation immobili\u00e8re, a \u00e9t\u00e9 \u00e9cart\u00e9 par manque de corroboration des \u00e9l\u00e9ments produits. &#8220;Ce rapport n\u2019est corrobor\u00e9 par aucun autre \u00e9l\u00e9ment vers\u00e9 aux d\u00e9bats&#8221; (Motifs, point 3). \u00c0 l\u2019inverse, le pr\u00e9judice moral d\u00e9coulant du sentiment d\u2019enfermement a \u00e9t\u00e9 retenu et indemnis\u00e9. La d\u00e9cision d\u00e9montre ainsi une dissociation stricte entre les pr\u00e9judices, exigeant pour chacun une d\u00e9monstration probante. Elle rappelle que l\u2019existence d\u2019un trouble ne vaut pas preuve automatique de tous les pr\u00e9judices all\u00e9gu\u00e9s.<\/p>\n<p>La port\u00e9e de l\u2019appr\u00e9ciation souveraine des juges du fond<\/p>\n<p>Cette d\u00e9cision illustre le pouvoir souverain d\u2019appr\u00e9ciation des juges du fond en mati\u00e8re de trouble de voisinage. Ils ont pu d\u00e9partager des expertises contradictoires sur l\u2019ensoleillement et qualifier juridiquement un sentiment d\u2019enfermement. La solution souligne que le respect des r\u00e8gles l\u00e9gales ne met pas \u00e0 l\u2019abri d\u2019une condamnation. &#8220;Inversement, il est admis que le respect des dispositions l\u00e9gales et des r\u00e8gles d\u2019urbanisme n\u2019exclut pas l\u2019existence \u00e9ventuelle de troubles exc\u00e9dant les inconv\u00e9nients normaux du voisinage&#8221; (Motifs, point 2).
