Le locataire oppose une exception d&#8217;inex\u00e9cution en invoquant des vices dans les locaux. Le juge admet partiellement la demande en retenant le caract\u00e8re non s\u00e9rieusement contestable de la cr\u00e9ance principale. Il rejette en revanche la demande accessoire relative \u00e0 une clause p\u00e9nale jug\u00e9e potentiellement excessive.<\/p>\n<p>L\u2019admission conditionnelle de la demande principale<br \/>\nLe cadre l\u00e9gal de l\u2019article 835 du code de proc\u00e9dure civile<br \/>\nLe juge des r\u00e9f\u00e9r\u00e9s statue sur le fondement de l\u2019article 835 alin\u00e9a 2 du code de proc\u00e9dure civile. Ce texte exige que l\u2019existence de l\u2019obligation ne soit pas s\u00e9rieusement contestable pour accorder une provision. Le juge rappelle que le paiement du loyer constitue une obligation principale du locataire en vertu de l\u2019article 1728 du code civil. L\u2019application de ce cadre l\u00e9gal est ainsi strictement subordonn\u00e9e \u00e0 l\u2019absence de contestation s\u00e9rieuse sur le principe m\u00eame de la dette.<\/p>\n<p>La neutralisation des moyens de d\u00e9fense du locataire<br \/>\nLe locataire invoquait une nullit\u00e9 du bail pour dol et une exception d\u2019inex\u00e9cution. Le juge \u00e9carte le dol car le locataire &#8220;ne justifie pas avoir saisi la juridiction comp\u00e9tente d&#8217;une action pour en obtenir l&#8217;annulation&#8221; et ne produit que des \u00e9l\u00e9ments insuffisants. Concernant l\u2019exception d\u2019inex\u00e9cution, il estime que les pi\u00e8ces vers\u00e9es, comme un courriel signalant une fuite, &#8220;ne permettent pas de d\u00e9montrer que le d\u00e9g\u00e2t des eaux invoqu\u00e9 ait \u00e9t\u00e9 d&#8217;une ampleur telle qu&#8217;il ait rendu les locaux impropre \u00e0 l&#8217;usage&#8221;. Cette analyse rejoint la jurisprudence selon laquelle &#8220;d\u00e8s lors que les locaux lou\u00e9s ne sont pas rendus impropres \u00e0 l&#8217;usage auquel ils sont destin\u00e9s, le bailleur ne manque pas \u00e0 son obligation de d\u00e9livrance et le preneur ne peut, en cons\u00e9quence, lui opposer l&#8217;exception d&#8217;inex\u00e9cution&#8221; (3\u00e8me Civ., 6 juillet 2023, pourvoi n\u00b0 22-15.923). La contestation est donc jug\u00e9e d\u00e9pourvue de s\u00e9rieux, ouvrant la voie \u00e0 la provision.<\/p>\n<p>Le rejet motiv\u00e9 des demandes accessoires<br \/>\nLe refus de statuer sur la clause p\u00e9nale<br \/>\nLe bailleur r\u00e9clamait \u00e9galement le paiement de p\u00e9nalit\u00e9s de retard et d\u2019une indemnit\u00e9 forfaitaire. Le juge qualifie cette demande de clause p\u00e9nale. Bien que reconnaissant sa comp\u00e9tence pour accorder une provision sur une telle clause, il refuse de le faire en l\u2019esp\u00e8ce. Il motive son refus en estimant que &#8220;la somme demand\u00e9e appara\u00eet en l\u2019esp\u00e8ce \u00e9lev\u00e9e et est susceptible d\u2019\u00eatre qualifi\u00e9es de manifestement excessive et donc d\u2019\u00eatre r\u00e9duite par le juge du fond&#8221;. Cette appr\u00e9ciation conduit \u00e0 retenir l\u2019existence d\u2019une &#8220;contestation s\u00e9rieuse&#8221; au sens de l\u2019article 835, ce qui interdit toute condamnation \u00e0 titre provisionnel sur ce chef.<\/p>\n<p>La condamnation aux frais irr\u00e9p\u00e9tibles et aux d\u00e9pens<br \/>\nLe juge use de son pouvoir discr\u00e9tionnaire pour allouer une somme au titre de l\u2019article 700 du code de proc\u00e9dure civile. Il condamne le locataire, partie perdante, \u00e0 payer 2000 euros pour les frais expos\u00e9s non compris dans les d\u00e9pens. Cette condamnation est justifi\u00e9e par &#8220;les d\u00e9marches judiciaires accomplies&#8221; en l\u2019absence de factures acquitt\u00e9es produites par le bailleur. Par ailleurs, le locataire est condamn\u00e9 aux d\u00e9pens de l\u2019instance, incluant les frais de signification. Ces d\u00e9cisions sanctionnent l\u2019\u00e9chec des d\u00e9fenses soulev\u00e9es et consacrent les cons\u00e9quences financi\u00e8res de la proc\u00e9dure.<\/p>\n<p>Cette ordonnance illustre la rigueur du contr\u00f4le op\u00e9r\u00e9 par le juge des r\u00e9f\u00e9r\u00e9s sur le s\u00e9rieux des contestations. Elle rappelle que l\u2019exception d\u2019inex\u00e9cution en mati\u00e8re de bail requiert une alt\u00e9ration substantielle de la jouissance. Elle d\u00e9montre aussi la prudence du juge face aux clauses r\u00e9put\u00e9es abusives, renvoyant leur examen au fond.
