L&#8217;acqu\u00e9reur initial et la soci\u00e9t\u00e9 \u00e0 laquelle il a c\u00e9d\u00e9 ses droits contestent la d\u00e9livrance d&#8217;une bande de terrain et demandent une r\u00e9faction du prix. La venderesse r\u00e9clame quant \u00e0 elle le paiement int\u00e9gral du prix, des int\u00e9r\u00eats et des dommages-int\u00e9r\u00eats. La cour pr\u00e9cise les modalit\u00e9s d&#8217;ex\u00e9cution de la vente et statue sur les demandes accessoires.<\/p>\n<p>La consistance de la chose vendue et l&#8217;obligation de d\u00e9livrance<\/p>\n<p>La d\u00e9termination pr\u00e9cise de l&#8217;objet du contrat<\/p>\n<p>La cour rappelle l&#8217;autorit\u00e9 de la chose jug\u00e9e attach\u00e9e au jugement de 2008 constatant la perfection de la vente. Elle interpr\u00e8te la clause visant le &#8220;premier plan de division \u00e9tabli au mois de juillet 2004&#8221; pour trancher un diff\u00e9rend entre les parties. Elle retient que cette expression &#8220;doit s&#8217;entendre comme celui du 27 juillet 2004&#8221; (Motifs). Ce plan d\u00e9finit une bande de terrain de 1,50 m\u00e8tre de large, faisant ainsi partie int\u00e9grante de la chose vendue. La cour \u00e9carte l&#8217;argument tir\u00e9 de la modification des r\u00e9f\u00e9rences cadastrales, ces derni\u00e8res \u00e9tant de simples indices administratifs. La port\u00e9e de l&#8217;arr\u00eat est de r\u00e9affirmer la force du jugement ayant constat\u00e9 la vente et de fixer son objet avec certitude, mettant fin aux contestations r\u00e9p\u00e9t\u00e9es sur la consistance du bien.<\/p>\n<p>L&#8217;existence d&#8217;un trouble de fait et non de droit<\/p>\n<p>La cour examine l&#8217;argument des acqu\u00e9reurs selon lequel la bande de terrain serait occup\u00e9e par des tiers, emp\u00eachant sa d\u00e9livrance. Elle constate que la venderesse a cr\u00e9\u00e9 une parcelle distincte pour r\u00e9server cette bande. Elle en d\u00e9duit que &#8220;la bande de terrain litigieuse leur est bien vendue&#8221; (Motifs). L&#8217;occupation par des copropri\u00e9taires voisins constitue selon elle &#8220;un trouble de fait, et non pas de droit&#8221; (Motifs). La solution impose aux acqu\u00e9reurs d&#8217;actionner les voies de droit appropri\u00e9es contre les occupants pour jouir du bien. La valeur de cette analyse est de distinguer clairement l&#8217;obligation de d\u00e9livrance, remplie par la venderesse, de la jouissance effective, qui peut n\u00e9cessiter une action en justice contre des tiers.<\/p>\n<p>Les cons\u00e9quences p\u00e9cuniaires de la vente et les demandes accessoires<\/p>\n<p>Le r\u00e9gime des int\u00e9r\u00eats moratoires et leur prescription<\/p>\n<p>La cour applique les articles 1605 et 1652 du code civil concernant les int\u00e9r\u00eats sur le prix. Elle juge que &#8220;l&#8217;int\u00e9r\u00eat l\u00e9gal sur le prix de vente est donc une contrepartie de la jouissance du bien&#8221; (Motifs). Ces int\u00e9r\u00eats sont dus depuis la prise de possession, fix\u00e9e au jugement de 2008. Elle examine ensuite la prescription quinquennale de l&#8217;article 2224 du code civil. Elle estime que la prescription a \u00e9t\u00e9 interrompue par une conclusion en r\u00e9f\u00e9r\u00e9 en 2017, rejetant l&#8217;acqu\u00e9reur sur les int\u00e9r\u00eats ant\u00e9rieurs \u00e0 2012. La port\u00e9e est de rappeler le caract\u00e8re accessoire et autonome de la cr\u00e9ance d&#8217;int\u00e9r\u00eats et les r\u00e8gles strictes de sa prescription.<\/p>\n<p>La compensation entre indemnit\u00e9s d&#8217;occupation et int\u00e9r\u00eats dus<\/p>\n<p>La cour est saisie de demandes crois\u00e9es concernant des indemnit\u00e9s d&#8217;occupation vers\u00e9es par les acqu\u00e9reurs. Elle unifie le r\u00e9gime juridique de ces sommes et des int\u00e9r\u00eats. Elle estime qu&#8217;une &#8220;indemnit\u00e9 d&#8217;occupation constitue la r\u00e9paration du pr\u00e9judice caus\u00e9 au propri\u00e9taire d&#8217;un bien par l&#8217;occupation irr\u00e9guli\u00e8re&#8221; (Motifs). Elle en d\u00e9duit que cette indemnit\u00e9 &#8220;fait donc double emploi avec les int\u00e9r\u00eats au taux l\u00e9gal sur le prix qui repr\u00e9sente la contrepartie de la jouissance du bien&#8221; (Motifs). La solution ordonne la compensation des indemnit\u00e9s d\u00e9j\u00e0 vers\u00e9es avec les int\u00e9r\u00eats dus par l&#8217;acqu\u00e9reur actuel.
