{"id":684954,"date":"2026-04-25T20:08:20","date_gmt":"2026-04-25T18:08:20","guid":{"rendered":"https:\/\/kohenavocats.com\/tribunal-judiciaire-le-17-juin-2025-n25-00306\/"},"modified":"2026-04-25T20:08:20","modified_gmt":"2026-04-25T18:08:20","slug":"tribunal-judiciaire-le-17-juin-2025-n25-00306","status":"publish","type":"post","link":"https:\/\/kohenavocats.com\/zh-hans\/tribunal-judiciaire-le-17-juin-2025-n25-00306\/","title":{"rendered":"Tribunal judiciaire, le 17 juin 2025, n\u00b025\/00306"},"content":{"rendered":"<div class=\"article-content\">\n<p>Tribunal judiciaire de Clermont-Ferrand, ordonnance de r\u00e9f\u00e9r\u00e9 du 17 juin 2025. \u00c0 la suite d\u2019une succession de ventes d\u2019un v\u00e9hicule d\u2019occasion am\u00e9nag\u00e9 en camping\u2011car, l\u2019acheteuse finale a signal\u00e9 une corrosion grave r\u00e9v\u00e9l\u00e9e apr\u00e8s l\u2019acquisition. Un contr\u00f4le technique ant\u00e9rieur mentionnait d\u00e9j\u00e0 une corrosion, puis une r\u00e9vision a constat\u00e9 une rouille perforante et chiffr\u00e9 des r\u00e9parations significatives. Faute d\u2019accord, une expertise amiable a \u00e9t\u00e9 conduite, suivie d\u2019une expertise judiciaire ordonn\u00e9e le 25 juin 2024, dont un pr\u00e9\u2011rapport a \u00e9t\u00e9 communiqu\u00e9 le 12 f\u00e9vrier 2025.<\/p>\n<p>Le centre de contr\u00f4le technique, impliqu\u00e9 dans l\u2019expertise, a ensuite attrait l\u2019assureur de sa responsabilit\u00e9 civile pour obtenir que les op\u00e9rations d\u2019expertise soient d\u00e9clar\u00e9es communes et opposables. L\u2019assureur a pr\u00e9sent\u00e9 protestations et r\u00e9serves. La question pos\u00e9e \u00e9tait celle de la r\u00e9union des conditions de l\u2019article 145 du Code de proc\u00e9dure civile pour \u00e9tendre l\u2019expertise en cours \u00e0 un tiers assureur, afin de pr\u00e9server utilement la preuve. Le juge des r\u00e9f\u00e9r\u00e9s a accueilli la demande, d\u00e9clar\u00e9 l\u2019opposabilit\u00e9, organis\u00e9 la participation du tiers, prorog\u00e9 la mission d\u2019expertise et laiss\u00e9 les d\u00e9pens \u00e0 la charge du demandeur.<\/p>\n<p>La d\u00e9cision rappelle d\u2019abord le texte de r\u00e9f\u00e9rence: \u00ab S&#8217;il existe un motif l\u00e9gitime de conserver ou d&#8217;\u00e9tablir avant tout proc\u00e8s la preuve de faits dont pourrait d\u00e9pendre la solution d&#8217;un litige, les mesures d&#8217;instruction l\u00e9galement admissibles peuvent \u00eatre ordonn\u00e9es \u00e0 la demande de tout int\u00e9ress\u00e9, sur requ\u00eate ou en r\u00e9f\u00e9r\u00e9. \u00bb Elle en d\u00e9duit l\u2019utilit\u00e9 probatoire d\u2019une extension \u00e0 l\u2019assureur, puis fixe pr\u00e9cis\u00e9ment les obligations proc\u00e9durales du tiers: \u00ab DIT, en cons\u00e9quence, que la partie appel\u00e9e en cause sera tenue de r\u00e9pondre aux convocations de l\u2019expert et de lui remettre tous les documents que celui-ci estimera n\u00e9cessaires \u00e0 l\u2019accomplissement de sa mission, d\u2019assister aux op\u00e9rations d\u2019expertises ou de s\u2019y faire repr\u00e9senter et d\u2019y faire toutes les observations qu\u2019elle jugera utiles \u00bb. Enfin, l\u2019\u00e9conomie de la mesure est assur\u00e9e par deux pr\u00e9cisions suppl\u00e9mentaires: \u00ab ACCORDE \u00e0 l\u2019expert un d\u00e9lai suppl\u00e9mentaire de quatre mois \u00e0 compter de la derni\u00e8re \u00e9ch\u00e9ance ou prorogation pour d\u00e9poser son rapport \u00bb et \u00ab RAPPELLE que la pr\u00e9sente d\u00e9cision est ex\u00e9cutoire \u00e0 titre provisoire \u00bb.<\/p>\n<p>I. Le sens et la justification de l\u2019extension d\u2019expertise<\/p>\n<p>A. Le motif l\u00e9gitime caract\u00e9ris\u00e9 par la perspective d\u2019un litige technique et assurantiel<br \/>\nLe juge rattache l\u2019extension au c\u0153ur de l\u2019article 145, qui vise la conservation ou l\u2019\u00e9tablissement de preuves en amont de tout proc\u00e8s. La mat\u00e9rialit\u00e9 des d\u00e9sordres, l\u2019ant\u00e9riorit\u00e9 d\u2019un contr\u00f4le technique pertinent et la perspective d\u2019une mise en cause professionnelle \u00e9tablissent un besoin probatoire concret. Le lien d\u2019assurance du professionnel justifie l\u2019inclusion du tiers, afin que la preuve utile lui soit opposable sans alt\u00e9rer le fond du droit. La mesure demeure strictement conservatoire et s\u2019inscrit dans un cadre contradictoire d\u00e9j\u00e0 ouvert par l\u2019expertise judiciaire.<\/p>\n<p>B. L\u2019opposabilit\u00e9 \u00e0 un tiers assureur et la garantie du contradictoire<br \/>\nL\u2019ordonnance articule l\u2019opposabilit\u00e9 avec des obligations proc\u00e9durales pr\u00e9cises, assurant la pleine participation du tiers aux op\u00e9rations. L\u2019injonction de r\u00e9pondre aux convocations, de communiquer les documents utiles et d\u2019observer les op\u00e9rations pr\u00e9vient toute contestation ult\u00e9rieure sur le respect du contradictoire. Le juge ne pr\u00e9juge ni de la garantie ni de la responsabilit\u00e9; il approfondit seulement le cercle des destinataires de la preuve, pour \u00e9viter une r\u00e9it\u00e9ration co\u00fbteuse des constatations techniques.<\/p>\n<p>II. Valeur et port\u00e9e de l\u2019ordonnance<\/p>\n<p>A. Conformit\u00e9 \u00e0 l\u2019\u00e9conomie de l\u2019article 145 et gestion du temps probatoire<br \/>\nLa solution s\u2019aligne sur la finalit\u00e9 conservatoire du texte, en autorisant la mise en cause proc\u00e9durale d\u2019un tiers directement concern\u00e9 par les suites contentieuses pr\u00e9visibles. La prorogation de quatre mois traduit une gestion r\u00e9aliste de la temporalit\u00e9 de l\u2019expertise, afin d\u2019int\u00e9grer utilement la participation du tiers sans fragiliser l\u2019exactitude technique. L\u2019ex\u00e9cution provisoire garantit la continuit\u00e9 des op\u00e9rations et \u00e9vite la paralysie probatoire, ce qui sert l\u2019efficacit\u00e9 du futur d\u00e9bat judiciaire.<\/p>\n<p>B. Incidences pratiques et limites pour le tiers appel\u00e9<br \/>\nL\u2019assureur appel\u00e9 ne voit pas son obligation de garantie tranch\u00e9e; il est seulement saisi comme participant n\u00e9cessaire \u00e0 l\u2019\u00e9tablissement contradictoire des faits. L\u2019opposabilit\u00e9 des op\u00e9rations facilitera toutefois la suite du litige, en limitant les contestations relatives au d\u00e9roulement de l\u2019expertise et \u00e0 l\u2019acc\u00e8s au dossier technique. Le choix de laisser les d\u00e9pens \u00e0 la charge du demandeur confirme la nature instrumentale de la mesure, tout en rappelant que l\u2019article 145 n\u2019est pas un levier de pression financi\u00e8re.
