Un commandement de payer visant la clause r\u00e9solutoire a \u00e9t\u00e9 signifi\u00e9 en juillet 2023, puis une assignation a suivi pour constater la r\u00e9siliation, obtenir l\u2019expulsion et le paiement des arri\u00e9r\u00e9s. Par jugement du 13 mai 2024, le juge des contentieux de la protection de Reims a retenu l\u2019acquisition de la clause, ordonn\u00e9 l\u2019expulsion et condamn\u00e9 au paiement des sommes dues.<\/p>\n<p>En appel, le locataire demandait la suspension des effets de la clause r\u00e9solutoire sur le fondement de l\u2019article 24 de la loi n\u00b0 89-462 du 6 juillet 1989, avec des d\u00e9lais d\u2019apurement, ainsi que l\u2019actualisation de la dette par recalcul du suppl\u00e9ment de loyer de solidarit\u00e9 pour 2024. \u00c0 titre subsidiaire, il sollicitait des d\u00e9lais au titre de l\u2019article 1343-5 du code civil. Le bailleur social s\u2019y opposait en faisant valoir l\u2019absence de reprise int\u00e9grale du loyer courant et l\u2019impossibilit\u00e9 d\u2019\u00e9tablir le SLS faute d\u2019avis d\u2019imposition. Malgr\u00e9 un d\u00e9lai pour produire des pi\u00e8ces en d\u00e9lib\u00e9r\u00e9, les justificatifs fiscaux n\u2019ont pas \u00e9t\u00e9 communiqu\u00e9s.<\/p>\n<p>La question pos\u00e9e portait sur les conditions strictes de la suspension de la clause r\u00e9solutoire au sens de l\u2019article 24, l\u2019incidence d\u2019un SLS non actualis\u00e9 faute de pi\u00e8ces, et l\u2019articulation avec les d\u00e9lais de paiement de l\u2019article 1343-5. La cour confirme la r\u00e9siliation, refuse la suspension et l\u2019injonction d\u2019actualiser, mais accorde des d\u00e9lais d\u2019apurement. Elle \u00e9nonce que \u00ab La r\u00e9siliation du bail est donc acquise \u00e0 la date du 13 septembre 2023 et la d\u00e9cision d\u00e9f\u00e9r\u00e9e sera confirm\u00e9e sur ce point. \u00bb<\/p>\n<p>I. Le sens de la d\u00e9cision: rigueur des conditions de suspension et neutralisation du d\u00e9bat SLS<\/p>\n<p>A. Commandement infructueux et prise d\u2019effet de la clause r\u00e9solutoire<br \/>\nLe cadre l\u00e9gal, issu de la loi du 6 juillet 1989, subordonne l\u2019effet de la clause r\u00e9solutoire au maintien de l\u2019impay\u00e9 pendant deux mois apr\u00e8s commandement. Les pi\u00e8ces \u00e9tablissent que les sommes vis\u00e9es n\u2019ont pas \u00e9t\u00e9 int\u00e9gralement r\u00e9gl\u00e9es dans ce d\u00e9lai. La cour en tire la cons\u00e9quence normative attendue, rappel\u00e9e par la formule d\u00e9cisive: \u00ab La r\u00e9siliation du bail est donc acquise \u00e0 la date du 13 septembre 2023 et la d\u00e9cision d\u00e9f\u00e9r\u00e9e sera confirm\u00e9e sur ce point. \u00bb La solution reprend la logique classique de l\u2019automaticit\u00e9 conditionn\u00e9e, qui suppose un commandement r\u00e9gulier, un quantum exigible et l\u2019absence d\u2019apurement dans le d\u00e9lai.<\/p>\n<p>B. Reprise int\u00e9grale du loyer courant et SLS non actualisable sans justificatifs<br \/>\nLa suspension des effets de la clause sur le fondement de l\u2019article 24 exige que le locataire ait repris le versement int\u00e9gral du loyer courant avant l\u2019audience. La cour rappelle, au texte, que \u00ab Pendant le cours des d\u00e9lais accord\u00e9s par le juge dans les conditions pr\u00e9vues aux V et VI du pr\u00e9sent article, les effets de la clause de r\u00e9siliation de plein droit sont suspendus. \u00bb L\u2019exigence de reprise int\u00e9grale, loyer et charges, est donc un pr\u00e9alable probatoire et substantiel. Faute d\u2019avis d\u2019imposition, le SLS ne peut \u00eatre recalcul\u00e9 et le quantum du loyer courant demeure celui appel\u00e9 par le bailleur. La motivation est nette: \u00ab La note en d\u00e9lib\u00e9r\u00e9 re\u00e7ue le 20 mai 2025 reste inop\u00e9rante pour d\u00e9terminer le suppl\u00e9ment loyer solidarit\u00e9 (\u2026) puisque l\u2019appelant ne fournit pas les d\u00e9clarations d\u2019imp\u00f4t r\u00e9clam\u00e9es par le bailleur. \u00bb La non-reprise int\u00e9grale du loyer courant et l\u2019absence de pi\u00e8ces fiscales cumul\u00e9es excluent la suspension.<\/p>\n<p>II. La valeur et la port\u00e9e: principe dispositif sur le d\u00e9compte et recours autonome \u00e0 l\u2019article 1343-5<\/p>\n<p>A. Principe dispositif et d\u00e9compte arr\u00eat\u00e9 \u00ab sauf \u00e0 parfaire \u00bb<br \/>\nLa cour refuse d\u2019actualiser d\u2019office les arri\u00e9r\u00e9s en l\u2019absence de pr\u00e9tentions chiffr\u00e9es concordantes et de pi\u00e8ces probantes, marquant la primaut\u00e9 du principe dispositif. Elle le formule sans ambigu\u00eft\u00e9: \u00ab En cons\u00e9quence, la cour, ne pouvant statuer en dehors des pr\u00e9tentions des parties, confirmera la d\u00e9cision du premier juge arr\u00eatant le d\u00e9compte locatif au 07\/03\/2024 sauf \u00e0 parfaire. \u00bb La mention \u00ab sauf \u00e0 parfaire \u00bb pr\u00e9serve l\u2019actualisation ult\u00e9rieure dans le cadre d\u2019ex\u00e9cutions et r\u00e9gularisations appropri\u00e9es, sans \u00e9largir la saisine d\u2019appel. La solution s\u00e9curise le contentieux des loyers par une stricte discipline proc\u00e9durale.<\/p>\n<p>B. Moratoire autonome de l\u2019article 1343-5, sans suspension des effets de la clause<br \/>\nLa cour distingue clairement les d\u00e9lais de l\u2019article 24, conditionn\u00e9s par la reprise du loyer, et le moratoire civil de l\u2019article 1343-5, d\u00e9tachable de la logique r\u00e9solutoire. Elle rappelle le texte: \u00ab Le juge peut, compte tenu de la situation du d\u00e9biteur et en consid\u00e9ration des besoins du cr\u00e9ancier, reporter ou \u00e9chelonner, dans la limite de deux ann\u00e9es, le paiement des sommes dues. \u00bb Apr\u00e8s appr\u00e9ciation des ressources et pr\u00e9l\u00e8vements, des d\u00e9lais sur vingt-quatre mensualit\u00e9s sont accord\u00e9s, sans remettre en cause l\u2019expulsion ni l\u2019indemnit\u00e9 d\u2019occupation. La dissociation des r\u00e9gimes clarifie la port\u00e9e des mesures: l\u2019article 24 rel\u00e8ve d\u2019une suspension conditionnelle de la clause, tandis que l\u2019article 1343-5 organise un \u00e9chelonnement de la dette, sans affecter l\u2019ex\u00e9cution du bail.
