Un copropri\u00e9taire, mis en demeure \u00e0 deux reprises, n\u2019a pas r\u00e9gl\u00e9 les provisions \u00e9chues. Le syndicat a fait citer, puis a r\u00e9clam\u00e9 des charges, des quotes-parts sur budgets vot\u00e9s et fonds de travaux, des dommages et int\u00e9r\u00eats, ainsi qu\u2019une indemnit\u00e9 proc\u00e9durale.<\/p>\n<p>Les faits utiles sont simples. Deux mises en demeure sont rest\u00e9es sans effet. L\u2019assignation a suivi, avec production des proc\u00e8s-verbaux d\u2019assembl\u00e9e et d\u2019un extrait de compte arr\u00eat\u00e9 au 1er avril 2025. Certaines sommes ont \u00e9t\u00e9 d\u00e9duites car relevant des d\u00e9pens ou de l\u2019article 700, selon un pr\u00e9c\u00e9dent jugement mentionn\u00e9.<\/p>\n<p>La question tenait \u00e0 l\u2019articulation de l\u2019article 19-2 de la loi de 1965 avec l\u2019exigence probatoire en proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond. Elle portait aussi sur la qualification et la r\u00e9partition des frais entre l\u2019article 10-1 de la loi de 1965 et l\u2019article 700 du code de proc\u00e9dure civile, ainsi que sur l\u2019\u00e9ventuelle indemnisation compl\u00e9mentaire.<\/p>\n<p>La solution distingue nettement charges \u00e9chues, provisions non justifi\u00e9es, et frais accessoires. Le pr\u00e9sident condamne au paiement de 500,61 euros de charges arr\u00eat\u00e9es au 1er avril 2025, avec int\u00e9r\u00eats au taux l\u00e9gal \u00e0 compter de la mise en demeure du 28 janvier 2025. Il d\u00e9boute les demandes relatives aux budgets vot\u00e9s et au fonds de travaux faute de justification individualis\u00e9e, refuse des dommages et int\u00e9r\u00eats, alloue 60 euros au titre de l\u2019article 10-1, et 800 euros sur le fondement de l\u2019article 700, avec d\u00e9pens.<\/p>\n<p>I. L\u2019exigibilit\u00e9 imm\u00e9diate des provisions et l\u2019exigence de preuve<\/p>\n<p>A. Le cadre de l\u2019article 19-2 et le contr\u00f4le du pr\u00e9sident<\/p>\n<p>Le juge rappelle l\u2019\u00e9conomie du dispositif l\u00e9gal, dont la mise en mouvement exige une mise en demeure vaine, l\u2019approbation des comptes ou du budget, et la d\u00e9faillance du copropri\u00e9taire. L\u2019arr\u00eat reproduit le texte pertinent: \u00ab \u00e0 d\u00e9faut du versement \u00e0 sa date d\u2019exigibilit\u00e9 d\u2019une provision due au titre de l\u2019article 14-1 ou du I de l\u2019article 14-2, et apr\u00e8s mise en demeure rest\u00e9e infructueuse pass\u00e9 un d\u00e9lai de trente jours, les autres provisions non encore \u00e9chues en application des m\u00eames articles 14-1 ou 14-2 ainsi que les sommes restant dues appel\u00e9es au titre des exercices pr\u00e9c\u00e9dents apr\u00e8s approbation des comptes deviennent imm\u00e9diatement exigibles.<br \/>\nLe pr\u00e9sident du tribunal judiciaire statuant selon la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond, apr\u00e8s avoir constat\u00e9, selon le cas, l\u2019approbation par l\u2019assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires du budget pr\u00e9visionnel, des travaux ou des comptes annuels, ainsi que la d\u00e9faillance du copropri\u00e9taire, condamne ce dernier au paiement des provisions ou sommes exigibles \u00bb.<\/p>\n<p>La d\u00e9cision v\u00e9rifie ces conditions au moyen des proc\u00e8s-verbaux d\u2019assembl\u00e9e et de l\u2019extrait de compte. Elle isole ensuite la fraction exigible des charges, d\u00e9duction faite des postes inassimilables aux provisions ou relevant d\u2019un autre r\u00e9gime de recouvrement. La condamnation se limite ainsi au solde objectiv\u00e9, arr\u00eat\u00e9 \u00e0 une date pr\u00e9cise, et assorti d\u2019int\u00e9r\u00eats moratoires \u00e0 compter de la seconde mise en demeure.<\/p>\n<p>Cette d\u00e9marche est conforme \u00e0 la ratio legis de l\u2019article 19-2. L\u2019exigibilit\u00e9 imm\u00e9diate vise la tr\u00e9sorerie du syndicat, mais suppose une preuve rigoureuse du principe et du quantum. Le pr\u00e9sident exerce un contr\u00f4le probatoire complet, sans \u00eatre li\u00e9 par l\u2019ampleur de la demande chiffr\u00e9e, ni par la non-comparution de l\u2019adversaire.<\/p>\n<p>B. Le rejet des postes non individualis\u00e9s et la rigueur probatoire<\/p>\n<p>La d\u00e9cision refuse les quotes-parts de budget pr\u00e9visionnel et de fonds de travaux, faute d\u2019identification certaine du d\u00e9biteur et du lot dans le document produit. Elle \u00e9nonce: \u00ab Il ressort en outre des pi\u00e8ces produites, en particulier le document intitul\u00e9 \u201cquote-part sur budgets vot\u00e9s\u201d lequel ne mentionne ni l\u2019identit\u00e9 du copropri\u00e9taire ni le lot concern\u00e9, que les sommes de 55,66 euros au titre du budget pr\u00e9visionnel et de 5,56 euros au titre des cotisations fonds de travaux non encore exigibles, vot\u00e9es pour l\u2019exercice du 1er avril 2024 au 31 mars 2026, ne sont pas justifi\u00e9es. Le syndicat des copropri\u00e9taires sera en cons\u00e9quence d\u00e9bout\u00e9 de sa demande. \u00bb<\/p>\n<p>Le contr\u00f4le retient une exigence d\u2019individualisation des appels, qui conditionne l\u2019exigibilit\u00e9 et la condamnation. Un \u00e9tat global, d\u00e9pourvu de r\u00e9f\u00e9rence au lot, ne suffit pas, m\u00eame si l\u2019assembl\u00e9e a approuv\u00e9 le budget. Le juge rappelle ainsi que la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e ne diminue pas la charge de la preuve, laquelle doit \u00e9tablir la dette dans son objet, son fondement et sa destination au lot d\u00e9termin\u00e9.<\/p>\n<p>Cette rigueur s\u2019inscrit dans le droit commun probatoire. L\u2019article 19-2 ne dispense pas de justifier chaque poste par une pi\u00e8ce probante, rattach\u00e9e au lot et \u00e0 l\u2019exercice concern\u00e9. La d\u00e9cision \u00e9vite une confusion entre le principe d\u2019exigibilit\u00e9 et la v\u00e9rification concr\u00e8te des sommes, garantie de la s\u00e9curit\u00e9 juridique en milieu de copropri\u00e9t\u00e9.<\/p>\n<p>II. La qualification des frais et la port\u00e9e pratique de la solution<\/p>\n<p>A. La ligne de partage entre article 10-1 et article 700<\/p>\n<p>Le juge distingue les frais imputables au seul copropri\u00e9taire d\u00e9faillant, et ceux relevant de l\u2019indemnit\u00e9 proc\u00e9durale. Il d\u00e9cide: \u00ab Au vu des \u00e9l\u00e9ments figurant sur l\u2019extrait de compte, il sera allou\u00e9 au syndicat des copropri\u00e9taires une somme de 60 euros au titre des frais de mise en demeure, relevant comme tel de l\u2019article 10-1. \u00bb Il ajoute: \u00ab Les frais de mise au contentieux et de suivi contentieux rel\u00e8vent en revanche de l\u2019application de l\u2019article 700 du code de proc\u00e9dure civile et le syndicat des copropri\u00e9taires sera d\u00e9bout\u00e9 de cette demande. \u00bb<\/p>\n<p>La r\u00e9partition est claire. Les frais n\u00e9cessaires de relance apr\u00e8s mise en demeure entrent dans l\u2019exception de l\u2019article 10-1, \u00e0 charge exclusive du d\u00e9biteur. Les frais de contentieux et de suivi, qui ne sont pas strictement n\u00e9cessaires \u00e0 la constitution de la cr\u00e9ance ni des frais d\u2019actes, rel\u00e8vent du pouvoir d\u2019appr\u00e9ciation au titre de l\u2019article 700. Cette lecture coh\u00e9rente pr\u00e9vient les cumuls et encadre la facturation des cabinets de gestion et auxiliaires.<\/p>\n<p>La d\u00e9cision accorde par ailleurs une indemnit\u00e9 au titre de l\u2019article 700, appr\u00e9ci\u00e9e de mani\u00e8re concr\u00e8te. Elle restitue ainsi le double objectif du recouvrement: restaurer la tr\u00e9sorerie par les provisions exigibles, et compenser raisonnablement le co\u00fbt proc\u00e9dural, sans transformer l\u2019article 10-1 en vecteur d\u2019honoraires g\u00e9n\u00e9ralis\u00e9s.<\/p>\n<p>B. L\u2019exclusion des dommages-int\u00e9r\u00eats et l\u2019\u00e9conomie de la proc\u00e9dure<\/p>\n<p>Le juge refuse l\u2019allocation de dommages et int\u00e9r\u00eats, faute de preuve d\u2019un pr\u00e9judice distinct de l\u2019atteinte patrimoniale compens\u00e9e par les int\u00e9r\u00eats moratoires. Il l\u2019exprime nettement: \u00ab Il sera donc d\u00e9bout\u00e9 de sa demande de dommages et int\u00e9r\u00eats. \u00bb La solution s\u2019aligne sur le principe selon lequel l\u2019int\u00e9r\u00eat au taux l\u00e9gal r\u00e9pare le retard de paiement, sauf d\u00e9monstration d\u2019un dommage suppl\u00e9mentaire sp\u00e9cifique.<\/p>\n<p>Le point de d\u00e9part des int\u00e9r\u00eats, fix\u00e9 \u00e0 la mise en demeure, traduit l\u2019exigence d\u2019un retard imputable, objectiv\u00e9 et certain. La proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond, mobilis\u00e9e par le pr\u00e9sident, r\u00e9pond \u00e0 l\u2019urgence du financement des charges communes, mais n\u2019autorise aucun rel\u00e2chement probatoire. La d\u00e9cision conjugue c\u00e9l\u00e9rit\u00e9 et exigence, ce qui favorise une discipline documentaire accrue des syndicats.<\/p>\n<p>La port\u00e9e pratique est notable. Les gestionnaires doivent conserver et produire des pi\u00e8ces individualis\u00e9es pour chaque lot, en particulier sur les quotes-parts de budgets et le fonds de travaux. Les postes de frais doivent \u00eatre qualifi\u00e9s d\u00e8s l\u2019amont, pour \u00e9viter des irrecevabilit\u00e9s ou des d\u00e9bout\u00e9s partiels.
