L&#8217;arr\u00eat confirme un jugement ayant retenu une dette locative substantielle, tout en allouant une indemnit\u00e9 de jouissance mesur\u00e9e.<\/p>\n<p>La relation contractuelle portait sur une maison avec d\u00e9pendances, assortie d\u2019un loyer r\u00e9visable et de charges. Un cong\u00e9 pour reprise a \u00e9t\u00e9 notifi\u00e9 pour le 31 d\u00e9cembre 2015, puis une expertise a relev\u00e9 plusieurs manquements aux exigences de d\u00e9cence. La locataire a cess\u00e9 ses paiements d\u00e8s 2014, s\u2019est maintenue jusqu\u2019au 1er juin 2021, et a consign\u00e9 des loyers partiellement.<\/p>\n<p>Apr\u00e8s disjonction, validation du cong\u00e9 et fixation d\u2019une indemnit\u00e9 d\u2019occupation \u00e0 compter du 1er janvier 2016, un jugement du 3 avril 2023 a condamn\u00e9 la locataire \u00e0 44 659,47 euros, accordant parall\u00e8lement 7 200 euros pour trouble de jouissance. En appel, l\u2019appelante sollicitait l\u2019extinction de la dette, la restitution int\u00e9grale des sommes consign\u00e9es et une r\u00e9paration \u00e9gale aux loyers dus, tandis que l\u2019intim\u00e9e requ\u00e9rait confirmation.<\/p>\n<p>La question portait sur la possibilit\u00e9 de suspendre le paiement par exception d\u2019inex\u00e9cution, au regard de la non\u2011d\u00e9cence all\u00e9gu\u00e9e, et sur l\u2019\u00e9tendue temporelle et quantitative de l\u2019indemnisation du trouble de jouissance. La cour confirme une approche restrictive de l\u2019exception et retient une r\u00e9paration proportionn\u00e9e, fond\u00e9e sur l\u2019\u00e9valuation technique.<\/p>\n<p>I. Le cadre juridique et son application concr\u00e8te<\/p>\n<p>A. L\u2019exception d\u2019inex\u00e9cution strictement cantonn\u00e9e<\/p>\n<p>La cour rappelle d\u2019abord les obligations r\u00e9ciproques issues de la loi du 6 juillet 1989, puis pr\u00e9cise les limites de l\u2019exception d\u2019inex\u00e9cution. \u00ab Selon l&#8217;article 7 de la loi du 6 juillet 1989 dans sa version applicable Iors de la signature du bail, le locataire est oblig\u00e9 de payer le loyer et les charges r\u00e9cup\u00e9rables au terme convenu. \u00bb \u00ab Selon l&#8217;article 6 de la loi du 6 juillet 1989 dans sa version applicable Iors de la signature du bail, le bailleur est tenu de remettre au locataire un logement d\u00e9cent [&#8230;] \u00bb. Surtout, l\u2019arr\u00eat formule le crit\u00e8re dirimant en ces termes: \u00ab Il est de principe que le locataire ne peut se pr\u00e9valoir de l&#8217;exception d&#8217;inex\u00e9cution de l&#8217;article 1219 du code civil pour suspendre le paiement des loyers que si le logement est inhabitable ou totalement insalubre. \u00bb Cette formule borne la suspension aux seules hypoth\u00e8ses d\u2019an\u00e9antissement de l\u2019usage, excluant les d\u00e9sordres qui n\u2019atteignent pas ce seuil.<\/p>\n<p>B. La non\u2011d\u00e9cence constat\u00e9e, sans inhabitalit\u00e9 totale<\/p>\n<p>L\u2019expertise a retenu une non\u2011d\u00e9cence caract\u00e9ris\u00e9e, affectant \u00e9tanch\u00e9it\u00e9, chauffage, ventilation et divers \u00e9quipements, sans faire dispara\u00eetre toute habitabilit\u00e9. La cour s\u2019appuie sur une r\u00e9f\u00e9rence \u00e9conomique pr\u00e9cise: \u00ab L&#8217;expert chiffre le loyer \u00e0 500 \u20ac compte tenu de l&#8217;ensemble des d\u00e9sordres relev\u00e9s et du march\u00e9 locatif, \u00e9tant observ\u00e9 que cela correspond au montant du loyer arr\u00eat\u00e9 par la bailleresse \u00e0 partir de 2014 pour tenir compte du caract\u00e8re inutilisable de la grange. \u00bb La d\u00e9monstration s\u2019ach\u00e8ve sur l\u2019absence d\u2019inhabitabilit\u00e9 totale, condition indispensable pour suspendre int\u00e9gralement les loyers; l\u2019arri\u00e9r\u00e9 et l\u2019indemnit\u00e9 d\u2019occupation demeurent dus, la consigne jouant seulement imputation. La solution s\u2019inscrit dans une orthodoxie classique, \u00e9vitant de transformer la non\u2011d\u00e9cence en cause g\u00e9n\u00e9rale d\u2019extinction de la dette.<\/p>\n<p>II. La r\u00e9paration du trouble de jouissance et ses limites<\/p>\n<p>A. L\u2019encadrement temporel apr\u00e8s cessation du titre<\/p>\n<p>La cour refuse d\u2019indemniser la p\u00e9riode post\u00e9rieure \u00e0 la r\u00e9siliation intervenue au 1er janvier 2016, le maintien s\u2019\u00e9tant op\u00e9r\u00e9 sans droit ni titre. Elle proc\u00e8de toutefois \u00e0 une mise au point utile sur le fondement de la responsabilit\u00e9 contractuelle: \u00ab Le manquement de la bailleresse \u00e0 son obligation de d\u00e9livrance et le pr\u00e9judice de jouissance subi par la locataire n&#8217;est pas contest\u00e9 par la premi\u00e8re mais il ne saurait \u00eatre s\u00e9rieusement soutenu par l&#8217;appelante qu&#8217;elle a v\u00e9cu pendant des ann\u00e9es dans un taudis au point que sa sant\u00e9 en a \u00e9t\u00e9 alt\u00e9r\u00e9e alors que l&#8217;expert retient seulement plusieurs \u00e9l\u00e9ments de non-d\u00e9cence dont certains (ballon d&#8217;eau chaude hors d&#8217;usage) sont post\u00e9rieurs au 1er janvier 2016. \u00bb La r\u00e9paration est ainsi circonscrite par la causalit\u00e9 et la p\u00e9riode de validit\u00e9 du titre, afin d\u2019\u00e9viter une indemnisation durable d\u2019un maintien unilat\u00e9ral.<\/p>\n<p>B. Une indemnisation proportionn\u00e9e et articul\u00e9e au loyer<\/p>\n<p>La cour confirme une \u00e9valuation forfaitaire et proportionnelle du trouble, corr\u00e9l\u00e9e au loyer, qui \u00e9vite l\u2019assimilation \u00e0 une remise totale. Elle ent\u00e9rine la m\u00e9thode retenue en premi\u00e8re instance, d\u00e9sormais stabilis\u00e9e par l\u2019arr\u00eat. La coh\u00e9rence d\u2019ensemble s\u2019illustre encore dans les mesures accessoires, la cour pr\u00e9cisant: \u00ab La d\u00e9cision d\u00e9f\u00e9r\u00e9e est confirm\u00e9e en ses dispositions relatives aux d\u00e9pens et frais irr\u00e9p\u00e9tibles de premi\u00e8re instance. \u00bb L\u2019\u00e9conomie g\u00e9n\u00e9rale demeure lin\u00e9aire: dettes locatives et indemnit\u00e9 d\u2019occupation sont maintenues, la consigne s\u2019impute, une indemnit\u00e9 de proc\u00e9dure est accord\u00e9e en appel, et la r\u00e9paration du trouble demeure limit\u00e9e \u00e0 une fraction du loyer sur une p\u00e9riode d\u00e9termin\u00e9e.<\/p>\n<p>Ainsi se dessine une ligne jurisprudentielle claire, distinguant la non\u2011d\u00e9cence s\u00e9v\u00e8re de l\u2019inhabitabilit\u00e9 totale, bornant strictement l\u2019exception d\u2019inex\u00e9cution, et \u00e9quilibrant dette locative et r\u00e9paration du trouble par une proportionnalit\u00e9 ma\u00eetris\u00e9e.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>La Cour d&#8217;appel de Lyon, 2 juillet 2025 (8e chambre, RG 23\/03698), se prononce sur un bail d&#8217;habitation entach\u00e9 de non\u2011d\u00e9cence.
