Le locataire a donn\u00e9 cong\u00e9 avec un pr\u00e9avis d\u2019un mois, a quitt\u00e9 les lieux le 15 octobre 2020 et a laiss\u00e9 les cl\u00e9s chez une voisine. Les bailleurs soutiennent n\u2019avoir r\u00e9cup\u00e9r\u00e9 les cl\u00e9s que le 16 novembre 2020, revendiquent une indemnit\u00e9 d\u2019occupation et des r\u00e9parations, tandis que le locataire r\u00e9clame la restitution du d\u00e9p\u00f4t, la p\u00e9nalit\u00e9 l\u00e9gale de retard et des frais.<\/p>\n<p>Le juge des contentieux de la protection de Paris, par jugement du 25 novembre 2022, a ordonn\u00e9 la restitution int\u00e9grale du d\u00e9p\u00f4t, allou\u00e9 des dommages et int\u00e9r\u00eats et rejet\u00e9 les demandes reconventionnelles, tout en d\u00e9clarant irrecevable l\u2019intervention volontaire du conjoint copropri\u00e9taire. Les bailleurs ont interjet\u00e9 appel, sollicitant la recevabilit\u00e9 de l\u2019intervention, une indemnit\u00e9 d\u2019occupation, la prise en charge de r\u00e9parations, et le rejet de la p\u00e9nalit\u00e9. Le locataire a demand\u00e9 confirmation, avec application de la majoration l\u00e9gale.<\/p>\n<p>La question principale porte sur la date et les modalit\u00e9s de la restitution des lieux, d\u00e9termin\u00e9es par la remise des cl\u00e9s, et sur les cons\u00e9quences financi\u00e8res qui en d\u00e9coulent, notamment l\u2019indemnit\u00e9 d\u2019occupation, le solde du d\u00e9p\u00f4t et la majoration de 10% pr\u00e9vue par l\u2019article 22 de la loi du 6 juillet 1989. S\u2019y ajoute la recevabilit\u00e9 de l\u2019intervention volontaire du conjoint copropri\u00e9taire lorsque le bail a \u00e9t\u00e9 consenti par l\u2019autre \u00e9poux. La cour admet l\u2019intervention, fixe la restitution des lieux au 16 novembre 2020, accorde une indemnit\u00e9 d\u2019occupation de 850 euros et retient 385 euros de r\u00e9parations, condamnant corr\u00e9lativement au solde de 465 euros sur le d\u00e9p\u00f4t, major\u00e9 de la p\u00e9nalit\u00e9 l\u00e9gale de f\u00e9vrier 2021 \u00e0 mars 2023.<\/p>\n<p>I. D\u00e9termination de la restitution des lieux et de ses effets<\/p>\n<p>A. Admission de l\u2019intervention volontaire du conjoint copropri\u00e9taire<\/p>\n<p>La cour rappelle le cadre proc\u00e9dural et patrimonial applicable. Elle vise d\u2019abord les crit\u00e8res de rattachement et de droit d\u2019agir, en citant que \u00ab l\u2019intervention n\u2019est recevable que si elle se rattache aux pr\u00e9tentions des parties par un lien suffisant \u00bb et qu\u2019\u00ab elle n\u2019est recevable que si son auteur a le droit d\u2019agir relativement \u00e0 cette pr\u00e9tention \u00bb. Elle mobilise ensuite le r\u00e9gime de communaut\u00e9, en relevant que les baux de biens communs, hors fonds ruraux et baux commerciaux, peuvent \u00eatre pass\u00e9s par un seul conjoint. L\u2019int\u00e9r\u00eat \u00e0 agir du copropri\u00e9taire indivis sur le bien lou\u00e9 r\u00e9sulte de sa qualit\u00e9 de co-titulaire du droit et du rattachement direct \u00e0 l\u2019objet du litige.<\/p>\n<p>Partant, la cour infirme l\u2019irrecevabilit\u00e9 prononc\u00e9e en premi\u00e8re instance. La solution est classique, car le lien suffisant avec les pr\u00e9tentions principales se d\u00e9duit de la propri\u00e9t\u00e9 commune et de l\u2019incidence p\u00e9cuniaire directe sur les droits du conjoint. L\u2019\u00e9conomie du r\u00e9gime matrimonial et la finalit\u00e9 de l\u2019article 325 du code de proc\u00e9dure civile commandent d\u2019ouvrir l\u2019instance \u00e0 celui dont la situation juridique est imm\u00e9diatement affect\u00e9e.<\/p>\n<p>B. Remise des cl\u00e9s, indemnit\u00e9 d\u2019occupation et d\u00e9p\u00f4t de garantie<\/p>\n<p>La cour fixe d\u2019abord le cadre normatif de la restitution des lieux. Elle \u00e9nonce que \u00ab il r\u00e9sulte d\u2019une jurisprudence constante, d\u2019une part que seule une restitution r\u00e9guli\u00e8re et l\u00e9gitime des locaux lou\u00e9s lib\u00e8re le locataire de toute obligation et, d\u2019autre part, que c\u2019est la remise des cl\u00e9s au domicile du bailleur ou de son repr\u00e9sentant qui mat\u00e9rialise la restitution des lieux lou\u00e9s \u00bb. Elle pr\u00e9cise que \u00ab s\u2019agissant des modalit\u00e9s de la remise des cl\u00e9s, celles-ci doivent \u00eatre remises en mains propres au bailleur ou au repr\u00e9sentant de celui-ci \u00bb, ajoutant que \u00ab seul le refus du bailleur de recevoir les cl\u00e9s permet de passer outre le d\u00e9faut de remise des cl\u00e9s \u00bb. Elle rappelle enfin que \u00ab la restitution du d\u00e9p\u00f4t de garantie ne peut avoir lieu qu\u2019\u00e0 la remise des cl\u00e9s \u00bb et qu\u2019\u00ab \u00e0 d\u00e9faut de restitution des cl\u00e9s apr\u00e8s la r\u00e9siliation du bail par l\u2019effet du cong\u00e9, une indemnit\u00e9 d\u2019occupation reste due \u00bb.<\/p>\n<p>Appliquant ces principes, la cour retient que la remise \u00e0 un tiers non mandat\u00e9 ne lib\u00e8re pas le locataire, faute d\u2019acceptation ou de refus imputable au bailleur, et fixe la restitution des lieux au 16 novembre 2020, date de r\u00e9cup\u00e9ration effective des cl\u00e9s. Elle alloue en cons\u00e9quence une indemnit\u00e9 d\u2019occupation de 850 euros pour la p\u00e9riode post\u00e9rieure au cong\u00e9. Sur les d\u00e9gradations, elle constate l\u2019absence d\u2019\u00e9tat des lieux de sortie, relevant que \u00ab il est constant qu\u2019aucun \u00e9tat des lieux de sortie n\u2019a \u00e9t\u00e9 \u00e9tabli \u00bb et que \u00ab les photographies [&#8230;] ne sauraient suppl\u00e9er l\u2019absence d\u2019\u00e9tat des lieux de sortie \u00bb. Elle ne retient que les canalisations bouch\u00e9es, notant que \u00ab seul est \u00e9tabli le fait que les canalisations \u00e9taient bouch\u00e9es \u00bb. Le solde du d\u00e9p\u00f4t se calcule alors en d\u00e9duisant l\u2019indemnit\u00e9 d\u2019occupation et les r\u00e9parations retenues, et la majoration de 10% court, dans le cadre d\u2019un retard persistant, jusqu\u2019au mois pr\u00e9c\u00e9dant le paiement effectif.<\/p>\n<p>II. Appr\u00e9ciation critique et port\u00e9e normative<\/p>\n<p>A. Conformit\u00e9 aux textes et \u00e0 la jurisprudence de la Cour de cassation<\/p>\n<p>La solution s\u2019inscrit dans la ligne exigeante de la troisi\u00e8me chambre civile. La cour d\u2019appel reprend litt\u00e9ralement que \u00ab les cl\u00e9s doivent \u00eatre remises en mains propres au bailleur ou au repr\u00e9sentant de celui-ci \u00bb, ce qui concorde avec la position excluant toute remise \u00e0 un tiers non mandat\u00e9. Le refus du bailleur constitue l\u2019unique exon\u00e9ration op\u00e9rante, ce que rappelle la formule selon laquelle \u00ab seul le refus du bailleur de recevoir les cl\u00e9s permet de passer outre le d\u00e9faut de remise des cl\u00e9s \u00bb. La cons\u00e9quence sur le d\u00e9p\u00f4t est logiquement articul\u00e9e, la cour retenant que \u00ab la restitution du d\u00e9p\u00f4t de garantie ne peut avoir lieu qu\u2019\u00e0 la remise des cl\u00e9s \u00bb. La coh\u00e9rence interne est assur\u00e9e, puisque la date de restitution gouverne \u00e0 la fois l\u2019indemnit\u00e9 d\u2019occupation, le point de d\u00e9part de la majoration l\u00e9gale et l\u2019assiette du solde.<\/p>\n<p>Sur les r\u00e9parations, l\u2019analyse respecte la charge probatoire. L\u2019absence d\u2019\u00e9tat des lieux de sortie neutralise les all\u00e9gations non \u00e9tay\u00e9es, la cour soulignant que \u00ab il est constant qu\u2019aucun \u00e9tat des lieux de sortie n\u2019a \u00e9t\u00e9 \u00e9tabli \u00bb. La s\u00e9lection d\u2019un poste unique, \u00e9tay\u00e9 par des \u00e9l\u00e9ments concordants, traduit une d\u00e9marche mesur\u00e9e, soucieuse de proportion et d\u2019objectivation du dommage locatif. L\u2019admission de l\u2019intervention du conjoint copropri\u00e9taire s\u2019accorde, enfin, avec le texte proc\u00e9dural et la logique du r\u00e9gime matrimonial, sans cr\u00e9er de distorsion proc\u00e9durale.<\/p>\n<p>B. Incidences pratiques et enseignements pour la pratique locative<\/p>\n<p>L\u2019arr\u00eat rappelle avec force l\u2019imp\u00e9ratif de tra\u00e7abilit\u00e9 des restitutions. La remise des cl\u00e9s doit \u00eatre mat\u00e9rialis\u00e9e, \u00e0 d\u00e9faut d\u2019accord expr\u00e8s, par une remise en mains propres contre r\u00e9c\u00e9piss\u00e9 ou par l\u2019envoi recommand\u00e9, la cour rappelant que \u00ab c\u2019est la remise des cl\u00e9s au domicile du bailleur ou de son repr\u00e9sentant qui mat\u00e9rialise la restitution des lieux lou\u00e9s \u00bb. Pour les praticiens, le recours \u00e0 un commissaire de justice pour organiser l\u2019\u00e9tat des lieux et la remise des cl\u00e9s s\u00e9curise le calendrier, borne l\u2019occupation et \u00e9vite les litiges sur l\u2019indemnit\u00e9 due.<\/p>\n<p>La port\u00e9e est \u00e9galement probatoire. La cour avertit que \u00ab les photographies [&#8230;] ne sauraient suppl\u00e9er l\u2019absence d\u2019\u00e9tat des lieux de sortie \u00bb, de sorte que la documentation \u00e0 chaud, contradictoire et dat\u00e9e, demeure essentielle. Sur le quantum des r\u00e9parations, l\u2019arr\u00eat illustre une approche restrictive et factuelle, en relevant que \u00ab seul est \u00e9tabli le fait que les canalisations \u00e9taient bouch\u00e9es \u00bb.
