Un copropri\u00e9taire avait pos\u00e9 une lanterne et une climatisation avec goulotte visible, apr\u00e8s percement de fa\u00e7ade, sans autorisation pr\u00e9alable de l\u2019assembl\u00e9e g\u00e9n\u00e9rale. Mis en demeure de d\u00e9poser et de r\u00e9parer, l\u2019int\u00e9ress\u00e9 a tard\u00e9, puis a d\u00e9mont\u00e9 le mat\u00e9riel pendant l\u2019instance, la r\u00e9fection restant partielle lors des d\u00e9bats. Le syndicat demandait suppression, remise en \u00e9tat sous astreinte, dommages-int\u00e9r\u00eats et frais, tandis que la d\u00e9fense sollicitait le rejet en raison du d\u00e9montage et des reprises en cours.<\/p>\n<p>La question portait sur la qualification d\u2019un trouble manifestement illicite en copropri\u00e9t\u00e9 et sur l\u2019office du juge des r\u00e9f\u00e9r\u00e9s, malgr\u00e9 un d\u00e9montage intervenu post\u00e9rieurement. Se fondant sur le constat d\u2019huissier, la juridiction retient \u00ab ce qui constitue un trouble manifestement illicite en ce que l\u2019aspect ext\u00e9rieur de l\u2019immeuble en est affect\u00e9 \u00bb. Tout en relevant le retrait du mat\u00e9riel, elle ordonne la remise en \u00e9tat, indique \u00ab CONSTATONS que les \u00e9quipements litigieux ont \u00e9t\u00e9 d\u00e9mont\u00e9s \u00bb et assortit l\u2019ex\u00e9cution d\u2019astreinte. Elle alloue en outre \u00ab la somme provisionnelle de 300 euros \u00e0 titre de dommages-int\u00e9r\u00eats pour le pr\u00e9judice esth\u00e9tique occasionn\u00e9 \u00bb et condamne aux frais irr\u00e9p\u00e9tibles. L\u2019analyse portera sur la qualification du trouble et sur la valeur et la port\u00e9e de la solution adopt\u00e9e.<\/p>\n<p>I. La caract\u00e9risation du trouble manifestement illicite et l\u2019office des r\u00e9f\u00e9r\u00e9s<\/p>\n<p>A. L\u2019atteinte aux parties communes et \u00e0 l\u2019aspect ext\u00e9rieur<br \/>\nLa fa\u00e7ade d\u2019un immeuble en copropri\u00e9t\u00e9 constitue une partie commune dont la modification requiert une autorisation r\u00e9guli\u00e8re de l\u2019assembl\u00e9e g\u00e9n\u00e9rale. Le percement de la fa\u00e7ade et l\u2019installation d\u2019\u00e9quipements visibles portent atteinte \u00e0 l\u2019harmonie de l\u2019immeuble, entra\u00eenant l\u2019application des r\u00e8gles d\u2019ordre public de la loi de 1965. La d\u00e9cision retient l\u2019atteinte \u00e0 l\u2019aspect ext\u00e9rieur, justifiant la qualification de \u00ab trouble manifestement illicite \u00bb au sens de l\u2019article 835 du Code de proc\u00e9dure civile. Le constat de commissaire de justice, pr\u00e9cis et circonstanci\u00e9, assoit l\u2019\u00e9vidence du trouble et \u00e9carte toute contestation s\u00e9rieuse quant \u00e0 l\u2019existence de travaux non autoris\u00e9s.<\/p>\n<p>B. L\u2019injonction de remise en \u00e9tat et l\u2019astreinte<br \/>\nApr\u00e8s avoir reconnu le d\u00e9montage, la juridiction exige la remise en \u00e9tat des parties communes et sa justification, conform\u00e9ment \u00e0 l\u2019office conservatoire et r\u00e9parateur du r\u00e9f\u00e9r\u00e9. La motivation reprend l\u2019injonction \u00ab \u00e0 remettre en \u00e9tat les parties communes affect\u00e9es \u00bb et la compl\u00e8te par l\u2019exigence \u00ab d\u2019en justifier, sous astreinte \u00bb, afin d\u2019assurer l\u2019effectivit\u00e9. L\u2019astreinte de 100 euros par jour, diff\u00e9r\u00e9e d\u2019un mois et limit\u00e9e \u00e0 six mois, demeure mesur\u00e9e et proportionn\u00e9e au but de remise en conformit\u00e9. Cette combinaison d\u2019injonction et d\u2019astreinte s\u2019inscrit dans les pouvoirs conf\u00e9r\u00e9s par l\u2019article 835, sans pr\u00e9judice d\u2019une liquidation ult\u00e9rieure si l\u2019ex\u00e9cution tardait. Reste \u00e0 appr\u00e9cier la pertinence et la port\u00e9e d\u2019une telle r\u00e9ponse, au regard de l\u2019\u00e9quilibre entre droits privatifs et int\u00e9r\u00eat collectif de la copropri\u00e9t\u00e9.<\/p>\n<p>II. Valeur et port\u00e9e de la solution pour la pratique de la copropri\u00e9t\u00e9<\/p>\n<p>A. Une r\u00e9ponse juridiquement fond\u00e9e et proportionn\u00e9e<br \/>\nLa solution respecte le droit positif de la copropri\u00e9t\u00e9, qui prohibe les travaux privatifs portant sur des parties communes ou l\u2019aspect ext\u00e9rieur sans d\u00e9cision pr\u00e9alable. L\u2019intervention en r\u00e9f\u00e9r\u00e9, malgr\u00e9 le d\u00e9montage, demeure l\u00e9gitime car le trouble a exist\u00e9 et la remise en \u00e9tat compl\u00e8te conditionne la cessation effective de l\u2019atteinte. L\u2019allocation de \u00ab la somme provisionnelle de 300 euros \u00e0 titre de dommages-int\u00e9r\u00eats \u00bb traduit une appr\u00e9ciation mesur\u00e9e du pr\u00e9judice esth\u00e9tique, consacrant l\u2019exigence de proportionnalit\u00e9. L\u2019indemnit\u00e9 de proc\u00e9dure, \u00e9galement accord\u00e9e, compl\u00e8te utilement l\u2019arsenal incitatif sans d\u00e9river en sanction p\u00e9cuniaire excessive pour un manquement d\u00e9j\u00e0 partiellement corrig\u00e9.<\/p>\n<p>B. Enseignements et port\u00e9e pratique pour les copropri\u00e9t\u00e9s<br \/>\nLa d\u00e9cision rappelle avec clart\u00e9 que l\u2019autorisation d\u2019assembl\u00e9e demeure pr\u00e9alable pour tout \u00e9quipement affectant la fa\u00e7ade ou visible de l\u2019ext\u00e9rieur, m\u00eame au b\u00e9n\u00e9fice d\u2019un lot privatif. Elle confirme l\u2019utilit\u00e9 du r\u00e9f\u00e9r\u00e9 pour mettre fin promptement \u00e0 des atteintes manifestes et obtenir la r\u00e9paration mat\u00e9rielle, ind\u00e9pendamment d\u2019un \u00e9ventuel contentieux au fond. Pour les syndics, l\u2019astreinte calibr\u00e9e, diff\u00e9r\u00e9e, et born\u00e9e dans le temps, offre un levier de suivi des reprises, tout en pr\u00e9servant un dialogue technique avec l\u2019occupant.
