Un bail d\u2019habitation conclu en 2014 a g\u00e9n\u00e9r\u00e9 d\u2019importants impay\u00e9s. Un commandement de payer a \u00e9t\u00e9 d\u00e9livr\u00e9 en f\u00e9vrier 2022, puis une assignation en r\u00e9siliation et expulsion en octobre 2022. Le juge des contentieux de la protection a constat\u00e9 l\u2019acquisition de la clause r\u00e9solutoire au 23 avril 2022, ordonn\u00e9 l\u2019expulsion et fix\u00e9 une indemnit\u00e9 d\u2019occupation. Le locataire a interjet\u00e9 appel pour obtenir des d\u00e9lais de paiement, la suspension de la clause r\u00e9solutoire et des dommages-int\u00e9r\u00eats. Le bailleur a soutenu l\u2019irrecevabilit\u00e9 des demandes, pr\u00e9sent\u00e9es pour la premi\u00e8re fois en appel.<\/p>\n<p>La proc\u00e9dure a vu, d\u2019abord, l\u2019actualisation de la dette \u00e0 8.961,51 euros au 2 d\u00e9cembre 2022, puis un jugement r\u00e9put\u00e9 contradictoire le 8 f\u00e9vrier 2023. En appel, le locataire a sollicit\u00e9 douze mois d\u2019\u00e9chelonnement et la neutralisation des effets de la clause, outre une indemnisation au titre d\u2019un pr\u00e9judice d\u2019anxi\u00e9t\u00e9. Le bailleur a conclu \u00e0 l\u2019irrecevabilit\u00e9 de ces pr\u00e9tentions comme nouvelles, \u00e0 la confirmation du jugement, et \u00e0 l\u2019allocation de frais irr\u00e9p\u00e9tibles suppl\u00e9mentaires.<\/p>\n<p>La question centrale portait sur la recevabilit\u00e9 en appel de demandes non soulev\u00e9es en premi\u00e8re instance par le d\u00e9fendeur non comparant et, au fond, sur la possibilit\u00e9 de suspendre ou d\u2019assouplir les effets d\u2019une clause r\u00e9solutoire d\u00e9j\u00e0 acquise, notamment lorsque le locataire a quitt\u00e9 les lieux. La cour d\u00e9clare recevables les demandes de d\u00e9lais, de suspension et d\u2019indemnisation, mais juge la suspension sans objet, confirme l\u2019acquisition de la clause, refuse des d\u00e9lais suppl\u00e9mentaires au regard de l\u2019article 1343-5 du code civil, et rejette la demande de dommages-int\u00e9r\u00eats.<\/p>\n<p>I. Le cadre proc\u00e9dural des pr\u00e9tentions nouvelles en appel<\/p>\n<p>A. Les exceptions des articles 564 \u00e0 567 du code de proc\u00e9dure civile<\/p>\n<p>Le principe d\u2019irrecevabilit\u00e9 des pr\u00e9tentions nouvelles est rappel\u00e9 par une formule claire. La cour cite l\u2019article 564 du code de proc\u00e9dure civile : \u00ab Les parties ne peuvent soumettre \u00e0 la cour de nouvelles pr\u00e9tentions si ce n&#8217;est pour opposer compensation, faire \u00e9carter les pr\u00e9tentions adverses ou faire juger les questions n\u00e9es de l&#8217;intervention d&#8217;un tiers, ou de la survenance ou de la r\u00e9v\u00e9lation d&#8217;un fait. \u00bb L\u2019article 567 est ensuite vis\u00e9 : \u00ab Les demandes reconventionnelles sont \u00e9galement recevables en appel. \u00bb<\/p>\n<p>La juridiction d\u2019appel souligne son office, en des termes sans \u00e9quivoque, en se r\u00e9f\u00e9rant \u00e0 la jurisprudence. Elle affirme que \u00ab La cour d&#8217;appel est tenue d&#8217;examiner d&#8217;office, au regard de chacune des exceptions pr\u00e9vues aux articles 564 \u00e0 567 du code de proc\u00e9dure civile, si une demande est nouvelle \u00bb. Elle rappelle encore qu\u2019\u00ab Est ainsi recevable en cause d&#8217;appel la demande du locataire form\u00e9e pour la premi\u00e8re fois en appel tendant \u00e0 l&#8217;octroi de d\u00e9lais de paiement et \u00e0 la suspension des effets de la clause r\u00e9solutoire \u00bb. La ratio decidendi tient \u00e0 la nature d\u00e9fensive et reconventionnelle de ces pr\u00e9tentions, qui tendent \u00e0 faire \u00e9carter la demande principale adverse en paiement et en r\u00e9siliation.<\/p>\n<p>Cette lecture \u00e9claire la coh\u00e9rence du syst\u00e8me. La r\u00e8gle interdit les demandes v\u00e9ritablement nouvelles, mais admet celles qui neutralisent, adaptent ou r\u00e9pondent aux pr\u00e9tentions adverses. Le juge d\u2019appel se reconna\u00eet ainsi une vigilance d\u2019office, gage d\u2019\u00e9galit\u00e9 des armes et de pleine effectivit\u00e9 du contradictoire, m\u00eame en cas de non-comparution initiale.<\/p>\n<p>B. La qualification retenue et son application concr\u00e8te<\/p>\n<p>La d\u00e9cision applique imm\u00e9diatement ce cadre, en adoptant une qualification fonctionnelle des pr\u00e9tentions. Elle rel\u00e8ve que, \u00ab En l&#8217;esp\u00e8ce, au regard de ces \u00e9l\u00e9ments la demande de d\u00e9lais de paiement, qui peut \u00e9galement s&#8217;analyser en une demande reconventionnelle au sens de l&#8217;article 567, et la demande de suspension des effets de la clause r\u00e9solutoire sont recevables. Il en est de m\u00eame de la demande de dommages-int\u00e9r\u00eats \u00bb. La solution s\u2019arrime \u00e0 la finalit\u00e9 proc\u00e9durale des demandes et non \u00e0 leur libell\u00e9.<\/p>\n<p>L\u2019approche conforte une ligne jurisprudentielle constante, favorable \u00e0 l\u2019examen au fond des mesures de temporisation dans les baux d\u2019habitation. Elle valorise l\u2019office correcteur du juge d\u2019appel et responsabilise la partie d\u00e9faillante sans la priver de moyens utiles de d\u00e9fense en cause d\u2019appel. La port\u00e9e pratique est nette : les d\u00e9fenses au fond et les demandes reconventionnelles corr\u00e9latives restent ouvertes, sous le contr\u00f4le des exceptions l\u00e9gales.<\/p>\n<p>II. L\u2019office du juge face \u00e0 la r\u00e9siliation et aux mesures d\u2019assouplissement<\/p>\n<p>A. La suspension devenue sans objet et la confirmation de la clause r\u00e9solutoire<\/p>\n<p>La cour rappelle d\u2019abord le dispositif sp\u00e9cial de la loi de 1989. \u00ab Selon l&#8217;article 24 V de la loi du 6 juillet 1989, (\u2026) le juge peut, m\u00eame d&#8217;office, accorder des d\u00e9lais de paiement dans la limite de trois ann\u00e9es \u00bb. Elle en \u00e9nonce l\u2019effet attach\u00e9 : \u00ab L&#8217;octroi de ces d\u00e9lais suspend les effets de la clause r\u00e9solutoire, en application du VII du m\u00eame article. \u00bb La mesure suppose n\u00e9anmoins une utilit\u00e9 concr\u00e8te et un maintien du lien locatif.<\/p>\n<p>Constatant le d\u00e9part du locataire et l\u2019absence de demande de r\u00e9int\u00e9gration, la cour juge que \u00ab sa demande de d\u00e9lais de paiement suspensifs des effets de la clause r\u00e9solutoire, en application de l&#8217;article pr\u00e9cit\u00e9, se r\u00e9v\u00e8le sans objet. \u00bb Le contr\u00f4le de la r\u00e9siliation demeure, en revanche, inchang\u00e9. La motivation retient que \u00ab le commandement de payer d\u00e9livr\u00e9 le 22 f\u00e9vrier 2022 est rest\u00e9 infructueux de sorte que la clause r\u00e9solutoire stipul\u00e9e dans le bail est acquise \u00e0 l&#8217;issue d&#8217;un d\u00e9lai de deux mois. \u00bb Elle pr\u00e9cise, dans une formule de principe, que \u00ab La circonstance qu&#8217;un plan d&#8217;apurement de la dette ait \u00e9t\u00e9 convenu par la suite est \u00e0 cet \u00e9gard sans incidence. \u00bb<\/p>\n<p>Le sens de la d\u00e9cision est p\u00e9dagogique. La suspension l\u00e9gale n\u2019a vocation \u00e0 jouer que tant que la relation contractuelle peut \u00eatre sauvegard\u00e9e. La confirmation de l\u2019acquisition de la clause r\u00e9solutoire garantit la s\u00e9curit\u00e9 juridique, surtout lorsque le commandement est demeur\u00e9 vain. La port\u00e9e est d\u2019importance pratique : les plans d\u2019apurement n\u2019effacent ni les effets acquis de la clause, ni l\u2019\u00e9conomie du d\u00e9lai l\u00e9gal de deux mois.<\/p>\n<p>B. Le refus de d\u00e9lais au titre de l\u2019article 1343-5 et le rejet de la responsabilit\u00e9 d\u00e9lictuelle<\/p>\n<p>La cour op\u00e8re la bascule du r\u00e9gime sp\u00e9cial au droit commun pour l\u2019\u00e9chelonnement. Elle rappelle que \u00ab Aux termes de l&#8217;article 1343-5 du code civil le juge peut, compte tenu de la situation du d\u00e9biteur et en consid\u00e9ration des besoins du cr\u00e9ancier, reporter ou \u00e9chelonner, dans la limite de deux ann\u00e9es, le paiement des sommes dues. \u00bb Elle constate toutefois l\u2019absence d\u2019\u00e9l\u00e9ments probants et l\u2019insuffisance de la d\u00e9monstration actualis\u00e9e de la situation personnelle. Elle tranche en ces termes : \u00ab ainsi aucun \u00e9l\u00e9ment ne justifie en l&#8217;\u00e9tat des pi\u00e8ces produites et des circonstances invoqu\u00e9es d&#8217;octroyer des d\u00e9lais de paiement \u00e0 l&#8217;appelant. \u00bb Le juge rappelle implicitement l\u2019office de l\u2019article 12 du code de proc\u00e9dure civile et exerce son pouvoir souverain d\u2019appr\u00e9ciation.<\/p>\n<p>La demande indemnitaire est, elle aussi, examin\u00e9e sous l\u2019angle de la faute et de la preuve. La cour cite la r\u00e8gle de principe : \u00ab Selon l&#8217;article 1240 du code civil, tout fait quelconque de l&#8217;homme, qui cause \u00e0 autrui un dommage, oblige celui par la faute duquel il est arriv\u00e9 \u00e0 le r\u00e9parer. \u00bb S\u2019agissant de l\u2019abus, elle retient que \u00ab L&#8217;abus de proc\u00e9dure est caract\u00e9ris\u00e9 lorsqu&#8217;est commise une faute, m\u00eame simple, qui &#8220;a fait d\u00e9g\u00e9n\u00e9rer en abus le droit d&#8217;agir en justice&#8221;. \u00bb Elle rappelle enfin la charge probatoire : \u00ab Il incombe \u00e0 chaque partie de prouver conform\u00e9ment \u00e0 la loi les faits n\u00e9cessaires au succ\u00e8s de sa pr\u00e9tention \u00bb. Le locataire n\u2019\u00e9tablit ni faute du cr\u00e9ancier, ni pr\u00e9judice personnel, direct et certain imputable \u00e0 une d\u00e9marche abusive, de sorte que l\u2019action d\u00e9lictuelle \u00e9choue.<\/p>\n<p>L\u2019appr\u00e9ciation retenue s\u2019inscrit dans une ligne \u00e9quilibr\u00e9e. Le droit commun des d\u00e9lais suppose un dossier \u00e9tay\u00e9 et une situation actuelle justifi\u00e9e, sp\u00e9cialement en appel. L\u2019action en responsabilit\u00e9 ne sanctionne pas l\u2019exercice l\u00e9gitime d\u2019un droit d\u2019agir, en l\u2019absence de man\u0153uvres fautives av\u00e9r\u00e9es. La port\u00e9e est pratique et pr\u00e9ventive : les d\u00e9biteurs doivent documenter rigoureusement leur solvabilit\u00e9 pr\u00e9visible et la dynamique d\u2019apurement, tandis que les bailleurs conservent la facult\u00e9 d\u2019agir sans craindre, par principe, une qualification d\u2019abus.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Cour d\u2019appel de Paris, 11 septembre 2025.
