{"id":685557,"date":"2026-04-25T20:49:06","date_gmt":"2026-04-25T18:49:06","guid":{"rendered":"https:\/\/kohenavocats.com\/tribunal-judiciaire-le-20-juin-2025-n25-00270\/"},"modified":"2026-04-25T20:49:06","modified_gmt":"2026-04-25T18:49:06","slug":"tribunal-judiciaire-le-20-juin-2025-n25-00270","status":"publish","type":"post","link":"https:\/\/kohenavocats.com\/zh-hans\/tribunal-judiciaire-le-20-juin-2025-n25-00270\/","title":{"rendered":"Tribunal judiciaire, le 20 juin 2025, n\u00b025\/00270"},"content":{"rendered":"<div class=\"article-content\">\n<p>Tribunal judiciaire de Toulouse, 20 juin 2025, ordonnance de r\u00e9f\u00e9r\u00e9 (RG n\u00b0 25\/00270) rendue sur le fondement de l\u2019article 145, \u00e0 propos d\u2019une vente immobili\u00e8re litigieuse.<\/p>\n<p>Apr\u00e8s l\u2019acquisition d\u2019une maison, les acqu\u00e9reurs ont signal\u00e9 une absence d\u2019isolation en toiture et murs, des jours sous tuiles, ainsi que des traces d\u2019humidit\u00e9 persistantes. Plusieurs constats techniques, dont un diagnostic hygrom\u00e9trique et un proc\u00e8s-verbal de commissaire de justice, attestaient d\u2019anomalies significatives affectant la performance et la salubrit\u00e9 du bien. Un diagnostic plus r\u00e9cent classait le bien en cat\u00e9gorie \u00e9nerg\u00e9tique sup\u00e9rieure, tandis qu\u2019un diagnostic ant\u00e9rieur expir\u00e9 le pla\u00e7ait sensiblement plus bas.<\/p>\n<p>Les acqu\u00e9reurs ont saisi le juge des r\u00e9f\u00e9r\u00e9s pour obtenir une consultation, subsidiairement une expertise, \u00e0 l\u2019appui d\u2019une future action en responsabilit\u00e9 li\u00e9e aux diagnostics et \u00e0 la r\u00e9novation all\u00e9gu\u00e9e. Les d\u00e9fendeurs ont demand\u00e9 de restreindre la mission, de l\u2019\u00e9tendre \u00e0 d\u2019autres intervenants, et ont sollicit\u00e9 des mises hors de cause et des frais irr\u00e9p\u00e9tibles.<\/p>\n<p>La question \u00e9tait de savoir si les conditions de l\u2019article 145 \u00e9taient r\u00e9unies, au regard d\u2019indices s\u00e9rieux et contradictoires, et quelles cons\u00e9quences proc\u00e9durales en d\u00e9coulaient. Le juge a r\u00e9pondu positivement, retenant que \u00ab La mesure sollicit\u00e9e est conforme au fondement de l\u2019article 145 du code de proc\u00e9dure civile \u00bb et qu\u2019\u00ab une mesure d\u2019instruction se justifie \u00bb. Il a refus\u00e9 d\u2019anticiper le fond, d\u00e9clar\u00e9 pr\u00e9matur\u00e9es les mises hors de cause, fix\u00e9 une consignation, et \u00e9cart\u00e9 les demandes fond\u00e9es sur l\u2019article 700.<\/p>\n<p>I. L\u2019encadrement de la mesure d\u2019instruction in futurum<\/p>\n<p>A. Le motif l\u00e9gitime au regard des indices vers\u00e9s<\/p>\n<p>La d\u00e9cision rappelle la norme de r\u00e9f\u00e9rence et le contr\u00f4le exerc\u00e9 par le juge des r\u00e9f\u00e9r\u00e9s. \u00ab Il appartient au juge de s&#8217;assurer souverainement que la mesure correspond \u00e0 un juste motif dont la pertinence se trouve dans l&#8217;\u00e9tablissement d&#8217;une preuve dont la production est susceptible d&#8217;influer sur la solution d&#8217;un litige futur, concernant des pr\u00e9tentions qui, dans leurs fondements, ne doivent pas appara\u00eetre comme manifestement irrecevables ou vou\u00e9es \u00e0 l&#8217;\u00e9chec. \u00bb<\/p>\n<p>Appliquant ce standard, le juge retient des indices techniques concordants, utiles \u00e0 \u00e9tablir la r\u00e9alit\u00e9 et l\u2019\u00e9tendue des d\u00e9sordres all\u00e9gu\u00e9s. \u00ab Au vu de ce qui pr\u00e9c\u00e8de, et en particulier si les difficult\u00e9s de classement seraient le cas \u00e9ch\u00e9ant li\u00e9es aux normes techniquement applicables selon les p\u00e9riodes de diagnostic, une mesure d\u2019instruction se justifie. \u00bb<\/p>\n<p>La proportionnalit\u00e9 de la mesure est soulign\u00e9e, le besoin d\u2019investigations approfondies emportant le choix d\u2019une expertise plut\u00f4t qu\u2019une simple consultation. \u00ab Au regard de la mission dont se pr\u00e9vaut les demandeurs, une simple consultation ne sera pas suffisante surtout s\u2019il faut identifier et chiffrer des travaux de remise en \u00e9tat. \u00bb<\/p>\n<p>B. L\u2019ad\u00e9quation d\u2019une expertise compl\u00e8te \u00e0 l\u2019objet probatoire<\/p>\n<p>Le dispositif circonscrit rigoureusement l\u2019objet des op\u00e9rations en \u00e9vitant toute d\u00e9rive inquisitoriale. L\u2019expert doit \u00ab dire si l\u2019immeuble pr\u00e9sente les d\u00e9sordres et malfa\u00e7ons pr\u00e9cis\u00e9ment invoqu\u00e9s dans l&#8217;assignation ou tout document de renvoi \u00e0 l&#8217;exclusion de tous autres non d\u00e9finis, \u00bb ce qui garantit la pertinence des investigations.<\/p>\n<p>La mission vise aussi l\u2019\u00e9clairage normatif et temporel indispensable \u00e0 la compr\u00e9hension des \u00e9carts constat\u00e9s entre diagnostics. Elle pr\u00e9voit d\u2019\u00ab indiquer si le diagnostic r\u00e9alis\u00e9 en 2013\/2018 et en 2023 ont respecivement tenu compte des normes en vigueur applicables en la mati\u00e8re \u00e0 leur \u00e9poque et prendre soin de rappeler ces normes en pr\u00e9cisant si elles ont \u00e9volu\u00e9 entre les deux ann\u00e9es de r\u00e9alisation des deux diagnostics, \u00bb afin d\u2019asseoir un chiffrage fiable et une qualification claire des causes. Enfin, l\u2019expert doit \u00ab rechercher tous les \u00e9l\u00e9ments techniques qui permettront \u00e0 telle juridiction de d\u00e9terminer les responsabilit\u00e9s respectives \u00e9ventuellement encourues, \u00bb ce qui balise utilement le futur d\u00e9bat.<\/p>\n<p>II. Les effets proc\u00e9duraux attach\u00e9s \u00e0 la prudence du juge des r\u00e9f\u00e9r\u00e9s<\/p>\n<p>A. L\u2019impossibilit\u00e9 d\u2019anticiper le fond et le rejet des mises hors de cause<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s r\u00e9affirme sa retenue institutionnelle, n\u00e9cessaire au stade probatoire. \u00ab Il n&#8217;appartient pas au juge des r\u00e9f\u00e9r\u00e9s, \u00e0 ce stade exploratoire, d&#8217;anticiper des d\u00e9bats de fond que l&#8217;expertise a pour finalit\u00e9 de nourrir d&#8217;un point de vue technique en recherchant les causes du sinistre, \u00e0 ce jour non identifi\u00e9es de fa\u00e7on certaine. \u00bb Cette position commande le rejet des demandes pr\u00e9matur\u00e9es.<\/p>\n<p>Dans la m\u00eame logique, les mises hors de cause sont \u00e9cart\u00e9es tant que le socle factuel demeure incomplet et discut\u00e9. \u00ab Le d\u00e9bat instaur\u00e9 est, eu \u00e9gard \u00e0 ce qui pr\u00e9c\u00e8de, largement pr\u00e9matur\u00e9, alors que la mise en jeu de l\u2019article 145 du code de proc\u00e9dure civile est requise d\u00e8s lors qu\u2019existe un int\u00e9r\u00eat l\u00e9gitime \u00e0 faire v\u00e9rifier une situation susceptible de devenir contentieuse, ce qui rend \u00e0 ce stade peu l\u00e9gitime toute mise hors de cause. \u00bb<\/p>\n<p>B.
