Apr\u00e8s l\u2019acquisition, des d\u00e9sordres auraient \u00e9t\u00e9 d\u00e9couverts derri\u00e8re les doublages, affectant des isolants et des c\u00e2bles, sans caract\u00e8re apparent lors de la vente.<\/p>\n<p>Les acqu\u00e9reurs r\u00e9clamaient le co\u00fbt des travaux de remise en \u00e9tat, une indemnisation morale et des frais, sur le fondement des articles 1641 et suivants du code civil. Les d\u00e9fendeurs, assign\u00e9s selon l\u2019article 659, n\u2019ont pas comparu, ce qui imposait l\u2019examen du bien\u2011fond\u00e9, conform\u00e9ment \u00e0 l\u2019article 472 du code de proc\u00e9dure civile.<\/p>\n<p>La question pos\u00e9e tient aux conditions probatoires du vice cach\u00e9, \u00e0 la gravit\u00e9 n\u00e9cessaire des atteintes et \u00e0 la port\u00e9e d\u2019\u00e9l\u00e9ments unilat\u00e9raux au regard du contradictoire. La juridiction rappelle que \u00ab le vendeur est tenu de la garantie \u00e0 raison des d\u00e9fauts de la chose vendue qui la rendent impropre \u00e0 l&#8217;usage auquel on la destine, ou qui diminuent tellement cet usage, que l&#8217;acheteur ne l&#8217;aurait pas acquise, ou n&#8217;en aurait donn\u00e9 qu&#8217;un moindre prix, s&#8217;il les avait connus \u00bb. Elle pr\u00e9cise encore que \u00ab Le vendeur n&#8217;est pas tenu des vices apparents et dont l&#8217;acheteur a pu se convaincre lui-m\u00eame \u00bb. Elle \u00e9nonce enfin que \u00ab Pour engager la garantie, le vice doit \u00eatre non apparent, ant\u00e9rieur \u00e0 la vente, atteindre la chose dans une de ses qualit\u00e9s principales et \u00eatre d&#8217;une gravit\u00e9 suffisante \u00bb, et rappelle, \u00e0 propos des \u00e9l\u00e9ments vers\u00e9s, que \u00ab le juge ne peut se fonder exclusivement sur une expertise non judiciaire r\u00e9alis\u00e9e \u00e0 la demande de l&#8217;une des parties, peu important qu&#8217;elle l&#8217;ait \u00e9t\u00e9 en pr\u00e9sence de celle-ci \u00bb. Appr\u00e9ciant les pi\u00e8ces produites, le tribunal constate que \u00ab ils ne permettent pas de d\u00e9montrer l\u2019ampleur de la pr\u00e9sence des rongeurs, ni la mat\u00e9rialit\u00e9 et la gravit\u00e9 des d\u00e9gradations provoqu\u00e9es par ces derniers \u00bb, et rel\u00e8ve l\u2019absence de titre authentique de vente, de sorte que la preuve d\u2019une ignorance l\u00e9gitime du vice fait d\u00e9faut. Les demandes sont rejet\u00e9es, les d\u00e9pens mis \u00e0 la charge des demandeurs, l\u2019ex\u00e9cution provisoire \u00e9tant \u00e9cart\u00e9e.<\/p>\n<p>I. Les conditions du vice cach\u00e9 strictement rappel\u00e9es<\/p>\n<p>A. Crit\u00e8res cumulatifs et affectation de l\u2019usage<br \/>\nLe jugement replace la garantie dans son cadre classique, en citant le texte et ses exigences cumulatives. Le rappel selon lequel \u00ab le vendeur est tenu de la garantie \u00e0 raison des d\u00e9fauts de la chose vendue \u00bb maintient l\u2019office dans les bornes de l\u2019article 1641, imm\u00e9diatement temp\u00e9r\u00e9 par la r\u00e9serve relative aux vices apparents. La formule retenue, \u00ab Pour engager la garantie, le vice doit \u00eatre non apparent, ant\u00e9rieur \u00e0 la vente, atteindre la chose dans une de ses qualit\u00e9s principales et \u00eatre d&#8217;une gravit\u00e9 suffisante \u00bb, explicite la structure du contr\u00f4le judiciaire, orient\u00e9e par la destination contractuelle du bien.<\/p>\n<p>La m\u00e9thode suivie \u00e9pouse un examen finaliste de l\u2019atteinte \u00e0 l\u2019usage, sans \u00e9luder la dimension temporelle et la gravit\u00e9 intrins\u00e8que du d\u00e9faut. Elle commande une d\u00e9monstration circonstanci\u00e9e, portant sur la mat\u00e9rialit\u00e9 des d\u00e9sordres et leur impact fonctionnel, afin d\u2019\u00e9tablir l\u2019impropri\u00e9t\u00e9 \u00e0 l\u2019usage ou la diminution substantielle de celui\u2011ci.<\/p>\n<p>B. Insuffisance probatoire des constats unilat\u00e9raux<br \/>\nLe juge confronte ensuite les pi\u00e8ces aux exigences probatoires. La valeur de l\u2019attestation technique et du proc\u00e8s\u2011verbal de commissaire de justice est pond\u00e9r\u00e9e par l\u2019objet limit\u00e9 de leurs constatations. Le constat selon lequel \u00ab ils ne permettent pas de d\u00e9montrer l\u2019ampleur de la pr\u00e9sence des rongeurs, ni la mat\u00e9rialit\u00e9 et la gravit\u00e9 des d\u00e9gradations provoqu\u00e9es par ces derniers \u00bb souligne l\u2019\u00e9cart entre l\u2019existence d\u2019indices et la preuve d\u2019un vice suffisamment grave.<\/p>\n<p>La carence documentaire majeure tient \u00e0 l\u2019absence de production de l\u2019acte authentique de vente, document d\u00e9cisif pour v\u00e9rifier l\u2019information transmise et d\u2019\u00e9ventuelles clauses relatives \u00e0 l\u2019\u00e9tat du bien. \u00c0 d\u00e9faut, la preuve que le vice n\u2019\u00e9tait \u00ab mentionn\u00e9 \u00bb et \u00ab totalement inconnu au moment de la vente \u00bb n\u2019est pas rapport\u00e9e, ce qui fragilise la pr\u00e9tention d\u2019ignorance l\u00e9gitime. La solution se d\u00e9duit alors du d\u00e9faut d\u2019\u00e9tablissement cumul\u00e9 de la gravit\u00e9 et du caract\u00e8re cach\u00e9.<\/p>\n<p>II. La gouvernance de la preuve par la contradiction<\/p>\n<p>A. Port\u00e9e de l\u2019interdiction de fonder le jugement sur une expertise unilat\u00e9rale<br \/>\nLe jugement rappelle utilement, en des termes constants, que \u00ab le juge ne peut se fonder exclusivement sur une expertise non judiciaire r\u00e9alis\u00e9e \u00e0 la demande de l&#8217;une des parties \u00bb. Cette exigence, justifi\u00e9e par l\u2019article 16 du code de proc\u00e9dure civile, s\u2019inscrit dans une jurisprudence de principe, notamment ch. mixte, 28 septembre 2012, puis 3e civ., 14 mai 2020 et 1er octobre 2020. Les \u00e9l\u00e9ments unilat\u00e9raux ne sont pas indiff\u00e9rents, mais ils appellent un adossement \u00e0 d\u2019autres preuves, id\u00e9alement issues d\u2019une mesure contradictoire.<\/p>\n<p>La d\u00e9cision illustre cet \u00e9quilibre: prise en compte d\u2019indices, sans que ceux\u2011ci puissent suffire \u00e0 caract\u00e9riser la gravit\u00e9 exig\u00e9e ni suppl\u00e9er une carence sur des pi\u00e8ces essentielles. Le contr\u00f4le op\u00e9r\u00e9 prot\u00e8ge l\u2019\u00e9galit\u00e9 des armes et l\u2019int\u00e9grit\u00e9 du d\u00e9bat, tout en incitant \u00e0 une construction probatoire robuste.<\/p>\n<p>B. Cons\u00e9quences probatoires pour l\u2019acheteur immobilier et \u00e9conomie du litige<br \/>\nLa charge de la preuve demeure int\u00e9gralement port\u00e9e par l\u2019acheteur, selon une logique de d\u00e9monstration compl\u00e8te, articulant mat\u00e9rialit\u00e9, gravit\u00e9, ant\u00e9riorit\u00e9 et caract\u00e8re cach\u00e9. L\u2019usage d\u2019une mesure d\u2019instruction contradictoire appara\u00eet, dans ces hypoth\u00e8ses, comme un vecteur probatoire privil\u00e9gi\u00e9 pour objectiver l\u2019\u00e9tendue des d\u00e9sordres derri\u00e8re les parois et leur incidence sur l\u2019usage. La conservation et la production du titre authentique participent \u00e9galement de la s\u00e9curisation du d\u00e9bat sur l\u2019information pr\u00e9contractuelle.<\/p>\n<p>Enfin, le traitement de l\u2019ex\u00e9cution provisoire compl\u00e8te l\u2019\u00e9conomie du litige. S\u2019il est rappel\u00e9 que \u00ab les d\u00e9cisions de premi\u00e8re instance sont, de droit, ex\u00e9cutoires \u00e0 titre provisoire \u00e0 moins que la loi ou la d\u00e9cision rendue n&#8217;en dispose autrement \u00bb, il est \u00e9galement observ\u00e9 que \u00ab le juge peut \u00e9carter l&#8217;ex\u00e9cution provisoire de droit, en tout ou partie, s&#8217;il estime qu&#8217;elle est incompatible avec la nature de l&#8217;affaire \u00bb.
