Un assureur demandait l\u2019autorisation de s\u00e9questrer des capitaux d\u00e9c\u00e8s en raison d\u2019un litige sur la validit\u00e9 du contrat. La b\u00e9n\u00e9ficiaire d\u00e9sign\u00e9e ne s\u2019opposait pas \u00e0 cette mesure conservatoire. La question portait sur la comp\u00e9tence du juge pour ordonner un s\u00e9questre avant tout jugement au fond. Le juge a fait droit \u00e0 la demande et ordonn\u00e9 la mesure.<\/p>\n<p>La comp\u00e9tence du juge de la mise en \u00e9tat pour ordonner le s\u00e9questre.<br \/>\nLe juge fonde sa comp\u00e9tence sur l\u2019article 789 4\u00b0 du code de proc\u00e9dure civile. Ce texte lui conf\u00e8re le pouvoir d\u2019ordonner toutes mesures provisoires ou conservatoires. La solution confirme l\u2019\u00e9tendue de ses pouvoirs en mati\u00e8re de gestion des fonds litigieux.<br \/>\nLa valeur de cette d\u00e9cision est de rappeler que le s\u00e9questre est une mesure conservatoire ordinaire. Elle ne n\u00e9cessite pas l\u2019urgence caract\u00e9ris\u00e9e mais une simple bonne administration de la justice.<br \/>\nLa port\u00e9e est ici de permettre au juge de la mise en \u00e9tat de bloquer des fonds en attente d\u2019une d\u00e9cision au fond. Cela \u00e9vite un paiement pr\u00e9matur\u00e9 et pr\u00e9serve les droits des parties en pr\u00e9sence.<\/p>\n<p>Le fondement de l\u2019obligation de s\u00e9questre dans le droit des assurances.<br \/>\nLe juge invoque l\u2019article L 132-25 du code des assurances pour justifier la mesure. Il pr\u00e9cise que &#8220;lorsque l\u2019assureur n\u2019a pas eu connaissance de la d\u00e9signation d\u2019un b\u00e9n\u00e9ficiaire [&#8230;] le paiement [&#8230;] est lib\u00e9ratoire pour l\u2019assureur de bonne foi&#8221;.<br \/>\nLa valeur de ce raisonnement est de prot\u00e9ger l\u2019assureur contre un double paiement en cas de litige sur les b\u00e9n\u00e9ficiaires.<br \/>\nLa port\u00e9e de l\u2019ordonnance est de suspendre le paiement jusqu\u2019\u00e0 ce que le tribunal tranche la validit\u00e9 du contrat ou des d\u00e9signations.
