La condition de l&#8217;influence d\u00e9terminante sur le r\u00e9sultat<\/p>\n<p>Le juge de l&#8217;\u00e9lection exerce un contr\u00f4le concret sur l&#8217;impact des irr\u00e9gularit\u00e9s all\u00e9gu\u00e9es.<br \/>\nIl estime que &#8220;les irr\u00e9gularit\u00e9s invoqu\u00e9es auraient port\u00e9 sur un nombre de suffrages trop limit\u00e9 pour modifier le r\u00e9sultat du scrutin&#8221; (consid\u00e9rant 1).<br \/>\nCette appr\u00e9ciation quantitative constitue le c\u0153ur du raisonnement pour \u00e9carter le premier moyen.<br \/>\nLa valeur de ce contr\u00f4le est d&#8217;\u00e9viter l&#8217;annulation pour des vices purement formels sans cons\u00e9quence r\u00e9elle.<br \/>\nLa port\u00e9e de cette solution est d&#8217;affirmer que seules les irr\u00e9gularit\u00e9s substantielles peuvent vicier une \u00e9lection.<br \/>\nLe juge refuse ainsi de sanctionner des anomalies qui n&#8217;auraient pas chang\u00e9 l&#8217;issue du vote.<\/p>\n<p>II.
