Un candidat \u00e9vinc\u00e9 conteste la r\u00e9gularit\u00e9 du scrutin en invoquant plusieurs griefs. La haute juridiction examine successivement l\u2019existence de manoeuvres dolosives, puis divers incidents de campagne. La question centrale est de savoir si les faits reproch\u00e9s ont alt\u00e9r\u00e9 la sinc\u00e9rit\u00e9 du scrutin. Le Conseil rejette la requ\u00eate et valide l\u2019\u00e9lection de l\u2019\u00e9lu proclam\u00e9.<\/p>\n<p>I. L\u2019appr\u00e9ciation lib\u00e9rale de la mauvaise foi et des manoeuvres<\/p>\n<p>Le Conseil constitutionnel \u00e9carte d\u2019abord le grief principal tir\u00e9 de pr\u00e9tendues manoeuvres frauduleuses. Il consid\u00e8re que les informations litigieuses, relatives \u00e0 un soutien politique, ne peuvent \u00eatre r\u00e9put\u00e9es publi\u00e9es de mauvaise foi. La solution se fonde sur une appr\u00e9ciation in concreto des circonstances locales et nationales. La haute juridiction affirme ainsi un principe de tol\u00e9rance pour les inexactitudes non intentionnelles en p\u00e9riode \u00e9lectorale.<\/p>\n<p>La valeur de cette solution est d\u2019instaurer une pr\u00e9somption de bonne foi au profit des candidats. En exigeant la preuve d\u2019une intention frauduleuse, le juge constitutionnel prot\u00e8ge la libert\u00e9 d\u2019expression en campagne. La port\u00e9e de cette d\u00e9cision est de limiter les annulations aux seules manoeuvres caract\u00e9ris\u00e9es par un \u00e9l\u00e9ment moral. Le Conseil refuse de sanctionner une simple maladresse ou une erreur d\u2019information non d\u00e9lib\u00e9r\u00e9e.<\/p>\n<p>II. Le rejet des griefs mineurs et l\u2019exigence d\u2019une influence d\u00e9terminante<\/p>\n<p>Le Conseil \u00e9carte ensuite tous les autres moyens, faute de preuves suffisantes ou d\u2019impact sur le scrutin. Il juge que les irr\u00e9gularit\u00e9s d\u2019affichage et la parution d\u2019une annonce le jour du scrutin sont sans influence. Il pr\u00e9cise que la reproduction d\u2019un appel eccl\u00e9siastique ne constitue pas un usage abusif de cr\u00e9dit personnel. Enfin, il estime que l\u2019utilisation d\u2019un titre professionnel n\u2019a pas fauss\u00e9 la sinc\u00e9rit\u00e9 du vote.<\/p>\n<p>Le sens de cette solution est de rappeler que toutes les irr\u00e9gularit\u00e9s ne justifient pas une annulation. La valeur de ce raisonnement est de consacrer un principe de proportionnalit\u00e9 et d\u2019effectivit\u00e9 du contentieux \u00e9lectoral. La port\u00e9e de l\u2019arr\u00eat est de fixer un seuil \u00e9lev\u00e9 pour l\u2019annulation d\u2019une \u00e9lection.
