Une soci\u00e9t\u00e9 civile immobili\u00e8re, propri\u00e9taire d&#8217;un immeuble, avait confi\u00e9 la gestion locative \u00e0 un cabinet. Ce dernier a per\u00e7u des loyers sans les reverser avant d&#8217;\u00eatre plac\u00e9 en liquidation judiciaire. La caution, sollicit\u00e9e, a refus\u00e9 sa garantie, ce qui a conduit la soci\u00e9t\u00e9 propri\u00e9taire \u00e0 l&#8217;assigner en paiement. La question de droit portait sur la r\u00e9union des conditions l\u00e9gales de mise en \u0153uvre de cette garantie autonome. Le tribunal a partiellement fait droit \u00e0 la demande, condamnant la caution \u00e0 verser une somme de 4453,03 euros.<\/p>\n<p>La d\u00e9monstration de la remise effective des fonds et du caract\u00e8re certain de la cr\u00e9ance est \u00e9tablie par les documents comptables du mandataire. Le tribunal retient que <em>&#8220;ces comptes rendus de gestion reprennent bien des \u00e9l\u00e9ments comptables et ils ont \u00e9t\u00e9 \u00e9tablis par la soci\u00e9t\u00e9 Cabinet l&#8217;Immeuble&#8221;<\/em> (Motifs, point 1). Il en d\u00e9duit que la cr\u00e9ance de la soci\u00e9t\u00e9 propri\u00e9taire appara\u00eet certaine, liquide et exigible, conditions n\u00e9cessaires \u00e0 la mobilisation de la garantie. Cette solution confirme le caract\u00e8re probant des comptes rendus unilat\u00e9raux du professionnel d\u00e9faillant pour le cr\u00e9ancier, all\u00e9geant ainsi sa charge probatoire.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est de rappeler que la garantie financi\u00e8re est autonome et ne n\u00e9cessite pas de d\u00e9claration pr\u00e9alable au passif du d\u00e9biteur. Le juge pr\u00e9cise en effet que <em>&#8220;la garantie financi\u00e8re est une garantie autonome&#8221;<\/em> (Motifs, point 1), permettant au cr\u00e9ancier d&#8217;agir directement contre le garant. Sur la valeur de ce point, le tribunal \u00e9carte l&#8217;exigence d&#8217;\u00e9l\u00e9ments comptables externes, se contentant des documents internes du syndic pour prouver la remise des fonds. Cette approche pragmatique prot\u00e8ge efficacement les bailleurs victimes de malversations de leur mandataire.<\/p>\n<p>Le montant garanti est limit\u00e9 aux seuls loyers et charges effectivement per\u00e7us et non revers\u00e9s, \u00e0 l&#8217;exclusion des r\u00e9serves non justifi\u00e9es. Le tribunal juge que <em>&#8220;ce dernier point n&#8217;est pas prouv\u00e9 et ce montant ne sera pas r\u00e9int\u00e9gr\u00e9 dans les loyers per\u00e7us et garantis&#8221;<\/em> (Motifs, point 2). Il refuse ainsi d&#8217;inclure une somme de 324 euros retenue pour factures, faute de preuve de son utilisation ou de sa restitution. Cette solution souligne l&#8217;exigence d&#8217;une preuve rigoureuse pour chaque \u00e9l\u00e9ment de la cr\u00e9ance garantie.<\/p>\n<p>En revanche, la demande de dommages et int\u00e9r\u00eats pour r\u00e9sistance abusive est rejet\u00e9e, faute de pr\u00e9judice d\u00e9montr\u00e9. Le tribunal constate que <em>&#8220;la SCI ne produit aucun \u00e9l\u00e9ment justifiant ce pr\u00e9judice invoqu\u00e9&#8221;<\/em> (Motifs, point 3). Cette position rappelle que le simple refus de payer, m\u00eame infond\u00e9, ne constitue pas un abus sans preuve d&#8217;un dommage sp\u00e9cifique.
