Les faits concernent une promesse de vente d&#8217;un immeuble \u00e0 usage de foyer \u00e9tudiant, assortie d&#8217;une clause de maintien de cette destination. La commune a pr\u00e9empt\u00e9 le bien pour cr\u00e9er une r\u00e9sidence sociale, ce que le tribunal a annul\u00e9. La question de droit portait sur l&#8217;opposabilit\u00e9 \u00e0 la collectivit\u00e9 pr\u00e9emptrice des conditions d&#8217;usage futur stipul\u00e9es dans la promesse de vente. La cour a confirm\u00e9 la solution des premiers juges en consid\u00e9rant que la clause litigieuse constituait une condition de l&#8217;ali\u00e9nation.<\/p>\n<p>L&#8217;\u00e9tendue des conditions opposables au titulaire du droit de pr\u00e9emption.<\/p>\n<p>La cour a jug\u00e9 que la stipulation imposant le maintien de la gestion d&#8217;un foyer \u00e9tudiant n&#8217;\u00e9tait pas une simple information mais un engagement contractuel. Elle affirme que <em>&#8220;une telle stipulation constitue, non pas une simple information, mais un engagement de la part de&#8221;<\/em> l&#8217;acqu\u00e9reur \u00e9vinc\u00e9 (point 9). Le sens de cette solution est d&#8217;inclure les restrictions d&#8217;usage dans les conditions de l&#8217;ali\u00e9nation au sens des articles L. 213-2 et R. 213-8 du code de l&#8217;urbanisme. La valeur de cette interpr\u00e9tation est d&#8217;\u00e9largir la notion de condition au-del\u00e0 du seul prix ou des modalit\u00e9s financi\u00e8res. Sa port\u00e9e est de soumettre le pr\u00e9empteur au respect de l&#8217;int\u00e9gralit\u00e9 des stipulations du contrat projet\u00e9, y compris celles relatives \u00e0 la destination du bien.<\/p>\n<p>Les cons\u00e9quences du non-respect de ces conditions par le pr\u00e9empteur.<\/p>\n<p>La cour a constat\u00e9 que la commune avait pr\u00e9empt\u00e9 en vue de cr\u00e9er une r\u00e9sidence sociale, m\u00e9connaissant ainsi la condition de maintien du foyer \u00e9tudiant. Elle rel\u00e8ve que <em>&#8220;la Ville de Paris a pr\u00e9empt\u00e9 le bien non pas avec l&#8217;intention d&#8217;y cr\u00e9er un foyer \u00e9tudiant mais pour cr\u00e9er des logements sociaux&#8221;<\/em> (point 11). Le sens de cet arr\u00eat est d&#8217;annuler la d\u00e9cision de pr\u00e9emption pour incoh\u00e9rence entre le projet municipal et les conditions de la vente projet\u00e9e. La valeur de cette solution est de garantir l&#8217;effectivit\u00e9 des droits de l&#8217;acqu\u00e9reur \u00e9vinc\u00e9 face \u00e0 une collectivit\u00e9 pr\u00e9emptrice. Cette d\u00e9claration comporte obligatoirement l&#8217;indication du prix et des conditions de l&#8217;ali\u00e9nation projet\u00e9e ou, en cas d&#8217;adjudication, l&#8217;estimation du bien ou sa mise \u00e0 prix, ainsi que les informations dues au titre de l&#8217;article L. 514-20 du code de l&#8217;environnement. Le titulaire du droit de pr\u00e9emption peut, dans le d\u00e9lai de deux mois pr\u00e9vu au troisi\u00e8me alin\u00e9a du pr\u00e9sent article, adresser au propri\u00e9taire une demande unique de communication des documents permettant d&#8217;appr\u00e9cier la consistance et l&#8217;\u00e9tat de l&#8217;immeuble, ainsi que, le cas \u00e9ch\u00e9ant, la situation sociale, financi\u00e8re et patrimoniale de la soci\u00e9t\u00e9 civile immobili\u00e8re. La liste des documents susceptibles d&#8217;\u00eatre demand\u00e9s est fix\u00e9e limitativement par d\u00e9cret en Conseil d&#8217;Etat. La d\u00e9claration d&#8217;intention d&#8217;ali\u00e9ner peut \u00eatre d\u00e9mat\u00e9rialis\u00e9e. Le cas \u00e9ch\u00e9ant, cette d\u00e9claration comporte \u00e9galement les informations dues au titre des articles L. 303-2 et L. 741-1 du code de la construction et de l&#8217;habitation. <\/p>\n<p>Lorsque la contrepartie de l&#8217;ali\u00e9nation fait l&#8217;objet d&#8217;un paiement en nature, la d\u00e9claration doit mentionner le prix d&#8217;estimation de cette contrepartie. <\/p>\n<p>Lorsque le droit de pr\u00e9emption est exerc\u00e9 par le repr\u00e9sentant de l&#8217;Etat dans le d\u00e9partement dans les conditions pr\u00e9vues au deuxi\u00e8me alin\u00e9a de l&#8217;article L. 210-1, la d\u00e9claration est transmise \u00e0 ce dernier par le maire, dans un d\u00e9lai de sept jours ouvr\u00e9s \u00e0 compter de la date de sa r\u00e9ception. A d\u00e9faut, le repr\u00e9sentant de l&#8217;Etat dans le d\u00e9partement peut informer le maire de son intention d&#8217;en faire dresser proc\u00e8s-verbal, par lettre recommand\u00e9e avec demande d&#8217;avis de r\u00e9ception. Le maire dispose d&#8217;un d\u00e9lai de sept jours \u00e0 compter de la r\u00e9ception de la lettre du repr\u00e9sentant de l&#8217;Etat dans le d\u00e9partement pour faire part de ses observations. A l&#8217;issue de ce d\u00e9lai et au vu des observations du maire, le repr\u00e9sentant de l&#8217;Etat dans le d\u00e9partement peut d\u00e9cider de constater l&#8217;absence de transmission de la d\u00e9claration par proc\u00e8s-verbal. Il est alors proc\u00e9d\u00e9 au recouvrement d&#8217;une amende forfaitaire de 1 000 \u20ac. Cette amende est redevable par la commune, par voie de titre de perception \u00e9mis par le repr\u00e9sentant de l&#8217;Etat dans le d\u00e9partement, au profit du Fonds national des aides \u00e0 la pierre mentionn\u00e9 \u00e0 l&#8217;article L. 435-1 du code de la construction et de l&#8217;habitation, lorsque la commune se situe en m\u00e9tropole, ou au profit du fonds r\u00e9gional d&#8217;am\u00e9nagement foncier et urbain mentionn\u00e9 \u00e0 l&#8217;article L. 340-2 du pr\u00e9sent code, lorsque la commune se situe dans un d\u00e9partement d&#8217;outre-mer. L&#8217;avis de mise en recouvrement du titre de perception de l&#8217;amende forfaitaire re\u00e7u par le maire peut faire l&#8217;objet d&#8217;un recours de pleine juridiction. <\/p>\n<p>Le silence du titulaire du droit de pr\u00e9emption pendant deux mois \u00e0 compter de la r\u00e9ception de la d\u00e9claration mentionn\u00e9e au premier alin\u00e9a vaut renonciation \u00e0 l&#8217;exercice du droit de pr\u00e9emption. <\/p>\n<p>Le d\u00e9lai est suspendu \u00e0 compter de la r\u00e9ception de la demande mentionn\u00e9e au premier alin\u00e9a ou de la demande de visite du bien. Il reprend \u00e0 compter de la r\u00e9ception des documents par le titulaire du droit de pr\u00e9emption, du refus par le propri\u00e9taire de la visite du bien ou de la visite du bien par le titulaire du droit de pr\u00e9emption. Si le d\u00e9lai restant est inf\u00e9rieur \u00e0 un mois, le titulaire dispose d&#8217;un mois pour prendre sa d\u00e9cision. Pass\u00e9s ces d\u00e9lais, son silence vaut renonciation \u00e0 l&#8217;exercice du droit de pr\u00e9emption. <\/p>\n<p>Lorsqu&#8217;il envisage d&#8217;acqu\u00e9rir le bien, le titulaire du droit de pr\u00e9emption transmet sans d\u00e9lai copie de la d\u00e9claration d&#8217;intention d&#8217;ali\u00e9ner au responsable d\u00e9partemental des services fiscaux. La d\u00e9cision du titulaire fait l&#8217;objet d&#8217;une publication. Elle est notifi\u00e9e au vendeur, au notaire et, le cas \u00e9ch\u00e9ant, \u00e0 la personne mentionn\u00e9e dans la d\u00e9claration d&#8217;intention d&#8217;ali\u00e9ner qui avait l&#8217;intention d&#8217;acqu\u00e9rir le bien. Le notaire la transmet aux titulaires de droits d&#8217;emphyt\u00e9ose, d&#8217;habitation ou d&#8217;usage, aux personnes b\u00e9n\u00e9ficiaires de servitudes, aux fermiers et aux locataires mentionn\u00e9s dans la d\u00e9claration d&#8217;intention d&#8217;ali\u00e9ner. <\/p>\n<p>Le titulaire du droit de pr\u00e9emption peut demander \u00e0 visiter le bien dans des conditions fix\u00e9es par d\u00e9cret. <\/p>\n<p>L&#8217;action en nullit\u00e9 pr\u00e9vue au premier alin\u00e9a se prescrit par cinq ans \u00e0 compter de la publication de l&#8217;acte portant transfert de propri\u00e9t\u00e9.<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006817738\" rel=\"nofollow\" target=\"_blank\">Article R. 213-8 du Code de l&#8217;urbanisme<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>   Lorsque l&#8217;ali\u00e9nation est envisag\u00e9e sous forme de vente de gr\u00e9 \u00e0 gr\u00e9 ne faisant pas l&#8217;objet d&#8217;une contrepartie en nature, le titulaire du droit de pr\u00e9emption notifie au propri\u00e9taire :<\/p>\n<\/p>\n<p>   a) Soit sa d\u00e9cision de renoncer \u00e0 l&#8217;exercice du droit de pr\u00e9emption ;<\/p>\n<\/p>\n<p>   b) Soit sa d\u00e9cision d&#8217;acqu\u00e9rir aux prix et conditions propos\u00e9s, y compris dans le cas de versement d&#8217;une rente viag\u00e8re ;<\/p>\n<\/p>\n<p>   c) Soit son offre d&#8217;acqu\u00e9rir \u00e0 un prix propos\u00e9 par lui et, \u00e0 d\u00e9faut d&#8217;acceptation de cette offre, son intention de faire fixer le prix du bien par la juridiction comp\u00e9tente en mati\u00e8re d&#8217;expropriation ; ce prix est exclusif de toute indemnit\u00e9 accessoire, et notamment de l&#8217;indemnit\u00e9 de r\u00e9emploi. Dans le cas d&#8217;une vente envisag\u00e9e moyennant le versement d&#8217;une rente viag\u00e8re, le titulaire du droit de pr\u00e9emption et, le cas \u00e9ch\u00e9ant, la juridiction doivent respecter les conditions de paiements propos\u00e9es par le vendeur.
