Un appelant contestait la validit\u00e9 de la signification du jugement de premi\u00e8re instance. Le conseiller de la mise en \u00e9tat avait radi\u00e9 l\u2019affaire pour inex\u00e9cution de la d\u00e9cision assortie de l\u2019ex\u00e9cution provisoire. La question de droit portait sur la recevabilit\u00e9 du moyen de nullit\u00e9 et l\u2019existence d\u2019un exc\u00e8s de pouvoir. La cour d\u00e9clare la demande recevable mais confirme l\u2019ordonnance de radiation.<\/p>\n<p>I. La recevabilit\u00e9 du d\u00e9f\u00e9r\u00e9-nullit\u00e9 et l\u2019irrecevabilit\u00e9 du moyen de nullit\u00e9<\/p>\n<p>La cour admet que la d\u00e9cision de radiation, mesure d\u2019administration judiciaire, peut faire l\u2019objet d\u2019un recours pour exc\u00e8s de pouvoir. Elle pr\u00e9cise que cette voie est ouverte car la radiation affecte l\u2019exercice du droit d\u2019appel. Le demandeur est donc recevable \u00e0 former son d\u00e9f\u00e9r\u00e9-nullit\u00e9.<\/p>\n<p>Cependant, la cour d\u00e9clare irrecevable l\u2019exception de nullit\u00e9 de l\u2019acte de signification soulev\u00e9e par l\u2019appelant. Elle applique l\u2019article 112 du code de proc\u00e9dure civile, qui impose de soulever la nullit\u00e9 in limine litis. L\u2019appelant avait conclu au fond avant d\u2019invoquer ce moyen, ce qui le couvre.<\/p>\n<p>II. L\u2019absence d\u2019exc\u00e8s de pouvoir et le rejet des demandes accessoires<\/p>\n<p>La cour estime que le conseiller de la mise en \u00e9tat n\u2019a pas exc\u00e9d\u00e9 ses pouvoirs. La signification \u00e9tant valable, la condition de notification pr\u00e9alable \u00e0 la radiation \u00e9tait remplie. La radiation pour inex\u00e9cution est donc l\u00e9gitime.<\/p>\n<p>La cour rejette la demande de dommages-int\u00e9r\u00eats pour proc\u00e9dure abusive de l\u2019intim\u00e9e. L\u2019exercice du recours, bien qu\u2019infond\u00e9, ne constitue pas un abus.
