Un consommateur avait assign\u00e9 une soci\u00e9t\u00e9 professionnelle pour obtenir la r\u00e9solution de la vente d\u2019un v\u00e9hicule non livr\u00e9. Apr\u00e8s une r\u00e9ouverture des d\u00e9bats pour v\u00e9rifier le respect du contradictoire, le juge a prononc\u00e9 la r\u00e9solution du contrat. La question de droit portait sur les conditions de r\u00e9solution pour d\u00e9faut de d\u00e9livrance et l\u2019indemnisation du consommateur.<\/p>\n<p>I. La r\u00e9solution pour d\u00e9faut de livraison<\/p>\n<p>Le tribunal applique les articles L216-1 et L216-6 du code de la consommation pour sanctionner le retard de livraison. Il estime que le professionnel n\u2019a pas livr\u00e9 le v\u00e9hicule dans le d\u00e9lai imparti, justifiant la r\u00e9solution. La d\u00e9cision rappelle que le consommateur peut imm\u00e9diatement r\u00e9soudre le contrat en cas de manquement \u00e0 l\u2019obligation essentielle de d\u00e9livrance. La solution est conforme au droit protecteur du consommateur, consacrant la sanction automatique du d\u00e9faut de livraison.<\/p>\n<p>Le juge ordonne le remboursement des avances avec une majoration de 50% sur le fondement de l\u2019article L241-6. Il retient que le professionnel n\u2019a pas rembours\u00e9 dans les quatorze jours, entra\u00eenant cette p\u00e9nalit\u00e9 l\u00e9gale. Cette majoration a une valeur punitive et dissuasive, visant \u00e0 garantir l\u2019effectivit\u00e9 des droits du consommateur. La port\u00e9e est de renforcer la contrainte pesant sur les professionnels d\u00e9faillants.<\/p>\n<p>II. Le rejet des dommages et int\u00e9r\u00eats suppl\u00e9mentaires<\/p>\n<p>Le tribunal \u00e9carte la demande de dommages et int\u00e9r\u00eats distincts faute de preuve d\u2019un pr\u00e9judice sp\u00e9cifique. Il rappelle que le remboursement major\u00e9 r\u00e9pare d\u00e9j\u00e0 le pr\u00e9judice subi par l\u2019acheteur. Cette position souligne la n\u00e9cessit\u00e9 d\u2019un pr\u00e9judice autonome non couvert par les restitutions l\u00e9gales. La valeur de ce raisonnement est d\u2019\u00e9viter une double indemnisation.<\/p>\n<p>La port\u00e9e de cette solution est de limiter les demandes accessoires lorsque la loi a d\u00e9j\u00e0 pr\u00e9vu une r\u00e9paration forfaitaire.
