Un couple de locataires, b\u00e9n\u00e9ficiant d\u2019une proc\u00e9dure de r\u00e9tablissement personnel sans liquidation judiciaire, s\u2019opposait \u00e0 cette demande. La question centrale portait sur l\u2019articulation entre la clause r\u00e9solutoire et l\u2019effacement des dettes issu du surendettement. Le juge a constat\u00e9 l\u2019acquisition de la clause r\u00e9solutoire mais en a suspendu les effets pendant deux ans, tout en d\u00e9boutant le bailleur de sa demande en paiement des loyers ant\u00e9rieurs.<\/p>\n<p>L\u2019office du juge face \u00e0 l\u2019effacement des dettes locatives.<\/p>\n<p>Le juge rappelle que le r\u00e9tablissement personnel sans liquidation judiciaire entra\u00eene l\u2019effacement des dettes ant\u00e9rieures \u00e0 la d\u00e9cision de la commission. En l\u2019esp\u00e8ce, la cr\u00e9ance locative de 10 443,02 euros est mentionn\u00e9e dans le tableau des cr\u00e9ances actualis\u00e9es. Il en d\u00e9duit que <em>&#8220;la cr\u00e9ance de l\u2019association APREMIS est \u00e9teinte&#8221;<\/em> (Motifs, page 7), justifiant le d\u00e9bout\u00e9 de la demande en paiement. Cette solution consacre la primaut\u00e9 des mesures d\u2019effacement sur la cr\u00e9ance du bailleur, m\u00eame lorsque la clause r\u00e9solutoire a d\u00e9j\u00e0 jou\u00e9. La valeur de cette d\u00e9cision est d\u2019appliquer strictement les articles L 741-1 et L 741-2 du code de la consommation, sans condition de bonne foi particuli\u00e8re.<\/p>\n<p>La suspension des effets de la clause r\u00e9solutoire comme mesure protectrice.<\/p>\n<p>Le tribunal suspend la clause r\u00e9solutoire pour deux ans \u00e0 compter du 26 ao\u00fbt 2025, conform\u00e9ment \u00e0 l\u2019article 24 VIII de la loi du 6 juillet 1989. Il \u00e9nonce que <em>&#8220;le juge suspend les effets de la clause de r\u00e9siliation de plein droit pendant un d\u00e9lai de deux ans&#8221;<\/em> (Motifs, page 6). Cette suspension permet au locataire de se maintenir dans les lieux malgr\u00e9 l\u2019acquisition de la clause, sous r\u00e9serve du paiement des indemnit\u00e9s d\u2019occupation. La port\u00e9e de cette mesure est de concilier le droit au logement du d\u00e9biteur surendett\u00e9 avec les int\u00e9r\u00eats du bailleur.
