Des bailleurs avaient assign\u00e9 leur locataire pour troubles de voisinage, sollicitant la r\u00e9siliation du bail et l\u2019expulsion. En cours d\u2019instance, le locataire a quitt\u00e9 les lieux, rendant ces demandes sans objet. Le litige persistant portait sur le paiement de charges locatives et la restitution d\u2019une partie du d\u00e9p\u00f4t de garantie. La question de droit centrale \u00e9tait de d\u00e9terminer si le locataire restait redevable des loyers jusqu\u2019\u00e0 la date effective de l\u2019\u00e9tat des lieux. La solution retient que le locataire doit les charges justifi\u00e9es et les loyers jusqu\u2019au 11 avril 2024.<\/p>\n<p>I. La charge de la preuve du paiement et de la justification des charges locatives<\/p>\n<p>Le tribunal rappelle que le locataire doit prouver le paiement ou l\u2019extinction de son obligation. Il pr\u00e9cise que <em>&#8220;le paiement des loyers et charges aux termes convenus dans le contrat est une obligation essentielle du locataire&#8221;<\/em> (Motifs). Cette affirmation a le sens d\u2019une r\u00e9affirmation classique de l\u2019obligation contractuelle. La valeur de ce rappel est d\u2019ancrer l\u2019analyse dans le droit commun des obligations. La port\u00e9e est de faire peser la charge probatoire sur le locataire qui conteste sa dette. En l\u2019esp\u00e8ce, le bailleur justifie les charges par un d\u00e9compte d\u00e9taill\u00e9 de l\u2019agence. Le juge estime ainsi que <em>&#8220;les charges sont justifi\u00e9es&#8221;<\/em> (Motifs), validant la cr\u00e9ance de 326,82 euros.<\/p>\n<p>II. Les conditions de la fin du contrat et le rejet de la demande reconventionnelle<\/p>\n<p>Le locataire r\u00e9clame le remboursement des loyers per\u00e7us apr\u00e8s le 26 mars 2024. Il soutient un accord verbal avec l\u2019agence pour un d\u00e9part \u00e0 cette date. Le tribunal \u00e9carte cet argument en relevant que <em>&#8220;l&#8217;accord de l&#8217;agence \u00e9tait conditionn\u00e9 \u00e0 l&#8217;accord \u00e9crit des propri\u00e9taires&#8221;<\/em> (Motifs). Cette motivation a le sens d\u2019une exigence de formalisme pour lib\u00e9rer le locataire de son obligation. La valeur de cette solution est de prot\u00e9ger les droits du bailleur face \u00e0 des accords non confirm\u00e9s. La port\u00e9e est que, sans accord expr\u00e8s du propri\u00e9taire, le pr\u00e9avis l\u00e9gal s\u2019applique et le locataire doit les loyers jusqu\u2019\u00e0 l\u2019\u00e9tat des lieux.
