L&#8217;acquisition automatique de la clause r\u00e9solutoire face \u00e0 l&#8217;impay\u00e9 locatif<\/p>\n<p>Le juge rappelle le m\u00e9canisme l\u00e9gal de la clause r\u00e9solutoire en mati\u00e8re de bail d&#8217;habitation. Il \u00e9nonce qu&#8217;aux termes de l&#8217;article 24 de la loi du 6 juillet 1989, <em>&#8220;la clause r\u00e9solutoire produit effet deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221;<\/em> (Motivation, page 3). La d\u00e9cision constate que le commandement d\u00e9livr\u00e9 le 20 f\u00e9vrier 2025 est rest\u00e9 sans effet, entra\u00eenant la r\u00e9siliation de plein droit au 20 avril 2025.<\/p>\n<p>La valeur de cette solution est de rappeler le caract\u00e8re automatique de la clause r\u00e9solutoire lorsque ses conditions sont r\u00e9unies. Le juge ne dispose d&#8217;aucun pouvoir pour emp\u00eacher l&#8217;effet de la clause une fois le commandement infructueux et le d\u00e9lai expir\u00e9. La port\u00e9e de ce principe est de s\u00e9curiser le droit des bailleurs \u00e0 recouvrer rapidement leur bien face \u00e0 un locataire d\u00e9faillant.<\/p>\n<p>II. Le refus des d\u00e9lais de paiement face \u00e0 une dette ancienne et importante<\/p>\n<p>Le juge \u00e9carte la demande de d\u00e9lais de paiement pr\u00e9sent\u00e9e par le locataire en raison de sa situation financi\u00e8re pr\u00e9caire. Il motive ce rejet par <em>&#8220;l&#8217;importance de la dette, \u00e0 l&#8217;anciennet\u00e9 des impay\u00e9s et \u00e0 l&#8217;absence de reprise effective du paiement&#8221;<\/em> (Motivation, page 3). La dette de 13 140 euros et l&#8217;absence de versement depuis le commandement justifient cette d\u00e9cision.<\/p>\n<p>La valeur de ce refus r\u00e9side dans l&#8217;appr\u00e9ciation souveraine du juge qui doit concilier l&#8217;\u00e9quit\u00e9 et l&#8217;efficacit\u00e9 de la proc\u00e9dure. Il s&#8217;agit d&#8217;une application stricte des conditions l\u00e9gales, privil\u00e9giant la protection du bailleur cr\u00e9ancier. La port\u00e9e de ce refus est de rappeler que la pr\u00e9carit\u00e9 du locataire ne suffit pas \u00e0 obtenir des d\u00e9lais si aucune perspective s\u00e9rieuse de paiement n&#8217;est d\u00e9montr\u00e9e.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>I.
