La locataire s\u2019opposait en invoquant une transaction ant\u00e9rieure et sollicitait des d\u00e9lais de paiement. La question centrale portait sur la validit\u00e9 du commandement de payer face \u00e0 l\u2019existence d\u2019un protocole transactionnel. Le juge a dit n\u2019y avoir lieu \u00e0 r\u00e9f\u00e9r\u00e9 sur l\u2019acquisition de la clause tout en accordant une provision partielle.<\/p>\n<p>La bonne foi du bailleur dans la d\u00e9livrance du commandement de payer est contestable.<\/p>\n<p>Le juge rel\u00e8ve que les parties ont sign\u00e9 une transaction le 2 ao\u00fbt 2024 ramenant la dette \u00e0 un montant pr\u00e9cis avec des d\u00e9lais. Il constate que la bailleresse a pourtant fait d\u00e9livrer un commandement visant des dettes ant\u00e9rieures \u00e0 ce protocole. Il en d\u00e9duit que \u00ab la bonne foi du bailleur dans sa d\u00e9livrance n\u2019est pas \u00e9tablie au-del\u00e0 de toute contestation s\u00e9rieuse \u00bb (point 14). La valeur de ce raisonnement est de prot\u00e9ger l\u2019effet des accords transactionnels contre des actes unilat\u00e9raux contradictoires. La port\u00e9e est de subordonner l\u2019efficacit\u00e9 d\u2019un commandement \u00e0 la coh\u00e9rence du comportement du cr\u00e9ancier.<\/p>\n<p>L\u2019obligation de payer une provision partielle n\u2019est pas s\u00e9rieusement contestable.<\/p>\n<p>Le juge \u00e9carte l\u2019argument de force majeure faute de d\u00e9monstration de l\u2019ext\u00e9riorit\u00e9 et de l\u2019irr\u00e9sistibilit\u00e9. Il retient que \u00ab l\u2019obligation du preneur de payer la somme demand\u00e9e n\u2019est pas s\u00e9rieusement contestable \u00e0 hauteur de 38 716,91 euros \u00bb (point 16). Cette somme est calcul\u00e9e d\u00e9duction faite des majorations et int\u00e9r\u00eats de retard, r\u00e9serv\u00e9s au juge du fond. Le sens est de reconna\u00eetre une dette certaine apr\u00e8s d\u00e9duction des \u00e9l\u00e9ments excessifs.
