Un salari\u00e9 contestait le refus de la caisse primaire apr\u00e8s deux avis d\u00e9favorables de comit\u00e9s r\u00e9gionaux. La question centrale \u00e9tait de savoir si le lien direct et essentiel entre la pathologie et le travail \u00e9tait \u00e9tabli. La solution retient que l\u2019absence d\u2019\u00e9l\u00e9ments probants ne permet pas de renverser les avis concordants des comit\u00e9s.<\/p>\n<p>I. L\u2019exigence probatoire pesant sur le demandeur<\/p>\n<p>Le tribunal rappelle que pour une maladie hors tableau, la preuve d\u2019un lien direct et essentiel incombe au salari\u00e9. Le juge constate que l\u2019int\u00e9ress\u00e9 n\u2019a produit aucun \u00e9l\u00e9ment nouveau pour contredire les expertises.<\/p>\n<p>A. La force des avis m\u00e9dicaux concordants<\/p>\n<p>Les deux comit\u00e9s r\u00e9gionaux ont successivement rendu des avis d\u00e9favorables motiv\u00e9s par l\u2019absence de facteurs de risque psycho-sociaux durables. Le jugement souligne que <em>&#8220;les deux comit\u00e9s r\u00e9gionaux successivement d\u00e9sign\u00e9s ont tenu compte de la demande motiv\u00e9e de reconnaissance&#8221;<\/em>. Cette concordance \u00e9tablit une pr\u00e9somption factuelle que le demandeur devait combattre par des preuves concr\u00e8tes.<\/p>\n<p>B. L\u2019insuffisance des all\u00e9gations du salari\u00e9<\/p>\n<p>Le tribunal rel\u00e8ve que le salari\u00e9 s\u2019en est simplement rapport\u00e9 \u00e0 l\u2019appr\u00e9ciation du tribunal sans fournir d\u2019\u00e9l\u00e9ment. Il \u00e9carte explicitement les all\u00e9gations de mise \u00e0 l\u2019\u00e9cart en relevant qu\u2019<em>&#8220;il ne ressort pas par ailleurs de l\u2019instruction men\u00e9e que l\u2019assur\u00e9 aurait \u00e9t\u00e9 priv\u00e9 des t\u00e2ches&#8221;<\/em>. Cette carence probatoire scelle l\u2019absence de lien direct et essentiel entre la pathologie et l\u2019activit\u00e9 professionnelle.<\/p>\n<p>II. La port\u00e9e du contr\u00f4le judiciaire sur l\u2019avis du comit\u00e9 r\u00e9gional<\/p>\n<p>Le jugement d\u00e9limite strictement le r\u00f4le du juge face \u00e0 l\u2019avis technique du comit\u00e9 r\u00e9gional de reconnaissance des maladies professionnelles. Il ne substitue pas son appr\u00e9ciation m\u00e9dicale mais v\u00e9rifie la coh\u00e9rence des motifs.<\/p>\n<p>A. Le respect de la proc\u00e9dure l\u00e9gale de double saisine<\/p>\n<p>Conform\u00e9ment \u00e0 l\u2019article R. 142-17-2, le tribunal a d\u00e9sign\u00e9 un second comit\u00e9 r\u00e9gional apr\u00e8s le premier avis d\u00e9favorable. Cette double saisine garantit un r\u00e9examen impartial du dossier, comme le rappelle la d\u00e9cision en d\u00e9signant <em>&#8220;un comit\u00e9 r\u00e9gional autre que celui qui a d\u00e9j\u00e0 \u00e9t\u00e9 saisi&#8221;<\/em>. La proc\u00e9dure a donc \u00e9t\u00e9 r\u00e9guli\u00e8rement suivie jusqu\u2019\u00e0 son terme.<\/p>\n<p>B. L\u2019absence de contestation s\u00e9rieuse des motifs m\u00e9dicaux<\/p>\n<p>Le juge constate que les deux avis concordants reposent sur une analyse pr\u00e9cise des pi\u00e8ces m\u00e9dicales et administratives. Le tribunal estime que <em>&#8220;les avis concordants d\u00e9favorables des deux comit\u00e9s r\u00e9gionaux ne peuvent pas \u00eatre remis en cause&#8221;<\/em> faute d\u2019\u00e9l\u00e9ments contraires.
