La demanderesse, ayant c\u00e9d\u00e9 l&#8217;immeuble, r\u00e9clamait le recouvrement des sommes dues avant la cession. La d\u00e9fenderesse, r\u00e9guli\u00e8rement assign\u00e9e, n&#8217;a pas comparu \u00e0 l&#8217;audience. La question de droit portait sur le caract\u00e8re non s\u00e9rieusement contestable de l&#8217;obligation locative. Le juge a fait droit \u00e0 la demande provisionnelle actualis\u00e9e \u00e0 la baisse.<\/p>\n<p>La recevabilit\u00e9 de la demande en l&#8217;absence du d\u00e9fendeur.<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s rappelle qu&#8217;en application de l&#8217;article 472 du code de proc\u00e9dure civile, il ne fait droit \u00e0 la demande que s&#8217;il l&#8217;estime r\u00e9guli\u00e8re, recevable et bien fond\u00e9e. Il constate que la d\u00e9fenderesse ne compara\u00eet pas et v\u00e9rifie donc les pi\u00e8ces produites par la demanderesse. Cette v\u00e9rification permet de garantir le respect du contradictoire malgr\u00e9 l&#8217;absence de la partie adverse. La valeur de ce contr\u00f4le est de pr\u00e9server les droits du d\u00e9fendeur d\u00e9faillant.<\/p>\n<p>Le juge retient que la demande est recevable car la dette a \u00e9t\u00e9 actualis\u00e9e \u00e0 la baisse, ne causant aucun grief au locataire non comparant. Cette solution prot\u00e8ge le d\u00e9fendeur absent d&#8217;une aggravation de sa situation sans d\u00e9bat. En ce sens, elle constitue une application \u00e9quitable des r\u00e8gles de proc\u00e9dure civile. La port\u00e9e de cette exception est de limiter la recevabilit\u00e9 des actualisations \u00e0 la hausse en r\u00e9f\u00e9r\u00e9.<\/p>\n<p>Le caract\u00e8re provisionnel de l&#8217;obligation locative.<\/p>\n<p>Le juge applique l&#8217;article 835 alin\u00e9a 2 du code de proc\u00e9dure civile pour accorder une provision lorsque l&#8217;obligation n&#8217;est pas s\u00e9rieusement contestable. Il se fonde sur le contrat de bail et l&#8217;attestation de cession pour \u00e9tablir l&#8217;existence de cette obligation. Il cite l&#8217;article 1728 du code civil, selon lequel le preneur est tenu <em>&#8220;de payer le prix du bail aux termes convenus&#8221;<\/em> (Motifs). Cette citation ancre la d\u00e9cision dans le droit commun des contrats.<\/p>\n<p>Le juge estime que la somme de 32.023,69 euros, r\u00e9sultant du d\u00e9compte produit, est non contestable en l&#8217;absence de tout \u00e9l\u00e9ment contraire. Il applique ensuite la r\u00e8gle de preuve de l&#8217;article 1353 du code civil, qui p\u00e8se sur le cr\u00e9ancier. La valeur de ce raisonnement est de conditionner la provision \u00e0 la d\u00e9monstration d&#8217;une cr\u00e9ance certaine.
