Le tribunal judiciaire de Poitiers, dans un jugement du 9 d\u00e9cembre 2025, \u00e9tait saisi d’une action en garantie des vices cach\u00e9s et en responsabilit\u00e9 d\u00e9cennale cons\u00e9cutive \u00e0 l’effondrement d’un mur de sout\u00e8nement et aux d\u00e9sordres affectant une piscine. Les acqu\u00e9reurs d’un bien immobilier recherchaient la responsabilit\u00e9 des vendeurs et de l’entreprise ayant r\u00e9alis\u00e9 la dalle de la piscine. La question de droit centrale portait sur l’opposabilit\u00e9 de la clause d’exclusion de garantie des vices cach\u00e9s et sur le partage de responsabilit\u00e9 entre les constructeurs. Le tribunal a fait droit \u00e0 l’action estimatoire des acqu\u00e9reurs et a condamn\u00e9 in solidum les diff\u00e9rents d\u00e9fendeurs.<\/p>\n

I. L’\u00e9viction de la clause d’exclusion de garantie des vices cach\u00e9s.<\/p>\n

Le tribunal \u00e9carte la clause d’exclusion de garantie stipul\u00e9e \u00e0 l’acte notari\u00e9 en raison de la mauvaise foi des vendeurs. Il retient que “le seul \u00e9tat apparent du mur au jour de l’achat (fissure, tuiles manquantes) \u00e9tait insuffisant \u00e0 renseigner les acqu\u00e9reurs sur l’ampleur du vice” (Motifs). Cette appr\u00e9ciation souveraine des juges du fond confirme le caract\u00e8re non apparent du vice, condition essentielle pour \u00e9carter la clause. La valeur de cette solution est de rappeler que la simple pr\u00e9sence de d\u00e9sordres visibles ne suffit pas \u00e0 priver l’acqu\u00e9reur de la garantie si leur gravit\u00e9 r\u00e9elle est occulte.<\/p>\n

Pour la piscine, le tribunal retient que les vendeurs ont endoss\u00e9 le r\u00f4le de constructeur, ce qui rend la clause inopposable. Il souligne que “les seules visites pr\u00e9alables \u00e0 la vente ne pouvaient mettre les acqu\u00e9reurs (non professionnels) en mesure de saisir l’ampleur des d\u00e9sordres” (Motifs). La port\u00e9e de ce raisonnement est significative : un vendeur non professionnel qui r\u00e9alise lui-m\u00eame des travaux engage sa responsabilit\u00e9 de constructeur et ne peut se retrancher derri\u00e8re les clauses limitatives du contrat de vente.<\/p>\n

II. La responsabilit\u00e9 partag\u00e9e des constructeurs pour les d\u00e9sordres de la piscine.<\/p>\n

Le tribunal engage la responsabilit\u00e9 de l’entreprise RENOV 2 sur le fondement de l’article 1792 du code civil. Il constate que “les d\u00e9sordres compromettent la solidit\u00e9 de l’ouvrage” et que le refus d’autres entreprises d’intervenir traduit “une impropri\u00e9t\u00e9 \u00e0 destination” (Motifs). Cette d\u00e9cision souligne que des d\u00e9fauts de conception et de mise en \u0153uvre, m\u00eame en l’absence de faute contractuelle directe, caract\u00e9risent un vice de construction engageant la responsabilit\u00e9 d\u00e9cennale du constructeur.<\/p>\n

Cependant, le tribunal limite l’action en garantie des vendeurs contre l’entreprise \u00e0 la moiti\u00e9 des condamnations. Il motive ce partage par le fait que “les consorts [A] ont accept\u00e9 la mise en oeuvre de b\u00e9ton fibr\u00e9 et non arm\u00e9” et qu’ils avaient eux-m\u00eames la qualit\u00e9 de constructeur (Motifs).
