Aucun grief particulier n&#8217;\u00e9tant soulev\u00e9, le juge constitutionnel a examin\u00e9 d&#8217;office la r\u00e9gularit\u00e9 proc\u00e9durale de l&#8217;article 11 de ce texte. La question \u00e9tait de savoir si cet article, modifiant le code de proc\u00e9dure p\u00e9nale, pr\u00e9sentait un lien suffisant avec la proposition de loi initiale. Le Conseil constitutionnel a r\u00e9pondu par la n\u00e9gative, d\u00e9clarant la disposition contraire \u00e0 la Constitution.<\/p>\n<p>La censure pour absence de lien avec le texte initial.<\/p>\n<p>Le juge constitutionnel rappelle que tout amendement doit pr\u00e9senter un lien, m\u00eame indirect, avec le texte d\u00e9pos\u00e9. Il examine le contenu de l&#8217;article 11 au regard de la proposition de loi initiale relative aux lanceurs d&#8217;alerte. Il constate que ces dispositions ne pr\u00e9sentent pas de lien, m\u00eame indirect, avec celles de l&#8217;article 5 de la proposition de loi initiale visant \u00e0 renforcer la protection des lanceurs d&#8217;alerte contre des mesures de repr\u00e9sailles. La motivation est claire et ne laisse aucune place \u00e0 l&#8217;interpr\u00e9tation sur l&#8217;absence de rattachement.<\/p>\n<p>La valeur de cette d\u00e9cision est d&#8217;affirmer la rigueur du contr\u00f4le de la recevabilit\u00e9 des amendements. Le Conseil constitutionnel veille au respect de l&#8217;article 45 de la Constitution, garant de la clart\u00e9 et de la coh\u00e9rence du processus l\u00e9gislatif. En censurant un <em>&#8220;cavalier l\u00e9gislatif&#8221;<\/em>, il sanctionne une pratique qui d\u00e9tourne la proc\u00e9dure parlementaire de son objet. La port\u00e9e est ici imm\u00e9diate : l&#8217;article 11 est retranch\u00e9 de la loi sans que le juge ne se prononce sur le fond de ses dispositions.<\/p>\n<p>La port\u00e9e de la d\u00e9cision d\u00e9passe le seul cas d&#8217;esp\u00e8ce. Elle rappelle au l\u00e9gislateur l&#8217;obligation de maintenir un lien substantiel entre les amendements et le texte en discussion. Cette censure proc\u00e9durale, sans examen du fond, constitue un avertissement pour l&#8217;avenir.
