Une candidate, lors de l&#8217;\u00e9lection l\u00e9gislative des 21 et 28 mars 1993 dans le Calvados, n&#8217;avait pas d\u00e9pos\u00e9 son compte de campagne. La question de droit portait sur les cons\u00e9quences du non-respect du d\u00e9lai imp\u00e9ratif de d\u00e9p\u00f4t. Le juge a d\u00e9clar\u00e9 la candidate in\u00e9ligible pour une dur\u00e9e d&#8217;un an \u00e0 compter du scrutin.<\/p>\n<p>La nature imp\u00e9rative du d\u00e9lai de d\u00e9p\u00f4t du compte de campagne.<\/p>\n<p>Le Conseil constitutionnel affirme que le d\u00e9lai de deux mois pr\u00e9vu \u00e0 l&#8217;article L. 52-12 du code \u00e9lectoral &#8220;pr\u00e9sente un caract\u00e8re imp\u00e9ratif&#8221; (consid\u00e9rant 1). Cette qualification interdit toute possibilit\u00e9 de prorogation ou d&#8217;excuse pour un d\u00e9p\u00f4t tardif. La solution garantit l&#8217;\u00e9galit\u00e9 entre les candidats et la sinc\u00e9rit\u00e9 du financement politique. Sa valeur est absolue car elle ne souffre aucune exception, m\u00eame en l&#8217;absence de mauvaise foi.<\/p>\n<p>La sanction automatique de l&#8217;in\u00e9ligibilit\u00e9 pour d\u00e9faut de d\u00e9p\u00f4t.<\/p>\n<p>Le juge constate que la candidate n&#8217;avait pas d\u00e9pos\u00e9 son compte \u00e0 l&#8217;expiration du d\u00e9lai. Il applique ensuite l&#8217;article L.O. 128 qui pr\u00e9voit l&#8217;in\u00e9ligibilit\u00e9 d&#8217;un an pour tout candidat n&#8217;ayant pas respect\u00e9 cette obligation. Cette d\u00e9cision a une grande port\u00e9e pratique car elle rappelle la rigueur du contentieux \u00e9lectoral.
