Une candidate \u00e0 une \u00e9lection l\u00e9gislative dans l&#8217;Indre n&#8217;avait pas d\u00e9pos\u00e9 son compte de campagne dans le d\u00e9lai l\u00e9gal. La question de droit portait sur le caract\u00e8re imp\u00e9ratif du d\u00e9lai de d\u00e9p\u00f4t et la sanction automatique d&#8217;in\u00e9ligibilit\u00e9. La haute juridiction a constat\u00e9 l&#8217;in\u00e9ligibilit\u00e9 de la candidate pour une dur\u00e9e d&#8217;un an \u00e0 compter du scrutin.<\/p>\n<p>Le caract\u00e8re imp\u00e9ratif du d\u00e9lai de d\u00e9p\u00f4t<\/p>\n<p>La d\u00e9cision rappelle que le d\u00e9lai de deux mois pour d\u00e9poser le compte de campagne est une obligation stricte. Le Conseil affirme que &#8220;ce d\u00e9lai, qui doit se d\u00e9compter de jour \u00e0 jour, pr\u00e9sente un caract\u00e8re imp\u00e9ratif&#8221; (Consid\u00e9rant 1). La valeur de cette solution est de garantir l&#8217;\u00e9galit\u00e9 entre tous les candidats et la sinc\u00e9rit\u00e9 du financement \u00e9lectoral. La port\u00e9e est absolue : aucun retard, m\u00eame minime, ne peut \u00eatre tol\u00e9r\u00e9 par le juge.<\/p>\n<p>Le constat automatique de l&#8217;in\u00e9ligibilit\u00e9<\/p>\n<p>Le juge constitutionnel se borne \u00e0 constater le manquement mat\u00e9riel au d\u00e9lai pour appliquer la loi. Il lui &#8220;appartient de constater que Mme Rongy est in\u00e9ligible&#8221; (Consid\u00e9rant 3) sans pouvoir moduler la sanction. La valeur de cette solution est de lier strictement le juge \u00e0 la volont\u00e9 du l\u00e9gislateur organique.
