Le Conseil constitutionnel, dans sa d\u00e9cision du 21 juin 1967, a rejet\u00e9 la requ\u00eate d’un candidat battu aux \u00e9lections l\u00e9gislatives. Le requ\u00e9rant contestait la r\u00e9gularit\u00e9 du scrutin dans la quatri\u00e8me circonscription d’Indre-et-Loire. Il invoquait trois moyens : l’allocution pr\u00e9sidentielle, l’in\u00e9ligibilit\u00e9 de son adversaire et une irr\u00e9gularit\u00e9 d’affichage. La question centrale portait sur la comp\u00e9tence du Conseil pour contr\u00f4ler une d\u00e9claration du Chef de l’\u00c9tat. Le juge constitutionnel a estim\u00e9 n’avoir aucun pouvoir en la mati\u00e8re et a valid\u00e9 l’\u00e9lection.<\/p>\n

L’incomp\u00e9tence du Conseil constitutionnel face \u00e0 l’allocution pr\u00e9sidentielle<\/p>\n

Le Conseil rappelle fermement les limites de son office dans le contentieux \u00e9lectoral. Il affirme qu’il “n’a pas comp\u00e9tence pour se prononcer, m\u00eame par voie d’exception et nonobstant l’article 44 de ladite ordonnance, sur la conformit\u00e9 \u00e0 la loi de la d\u00e9claration susmentionn\u00e9e du Chef de l’Etat”<\/em> (consid\u00e9rant 2). Cette solution s’impose comme une fin de non-recevoir absolue, \u00e9cartant toute discussion sur le fond. La valeur de cette d\u00e9cision est donc de poser un principe d’incomp\u00e9tence radicale. Le juge constitutionnel se d\u00e9clare inapte \u00e0 contr\u00f4ler les actes de parole du Pr\u00e9sident de la R\u00e9publique en p\u00e9riode \u00e9lectorale. La port\u00e9e de ce consid\u00e9rant est immense : elle soustrait enti\u00e8rement le Chef de l’\u00c9tat au contr\u00f4le juridictionnel du Conseil pour ses interventions m\u00e9diatiques. Le sens est de pr\u00e9server la s\u00e9paration des pouvoirs et la fonction arbitrale du Pr\u00e9sident, m\u00eame en campagne.<\/p>\n

L’interpr\u00e9tation restrictive des r\u00e8gles d’in\u00e9ligibilit\u00e9 et le rejet des griefs<\/p>\n

Le Conseil constitutionnel interpr\u00e8te strictement la r\u00e8gle d’in\u00e9ligibilit\u00e9 issue de l’ordonnance du 4 f\u00e9vrier 1959. Il rappelle que “toute in\u00e9ligibilit\u00e9, qui a pour effet d’apporter une atteinte \u00e0 la libert\u00e9 des candidatures, doit \u00eatre interpr\u00e9t\u00e9e restrictivement”<\/em> (consid\u00e9rant 5). Il applique ce principe au cas d’un candidat ayant pour rempla\u00e7ant un d\u00e9put\u00e9 soumis \u00e0 r\u00e9\u00e9lection. Le juge estime que cette situation ne contredit pas les objectifs de disponibilit\u00e9 du rempla\u00e7ant. Il conclut qu’ “il ne saurait faire obstacle \u00e0 l’\u00e9ligibilit\u00e9 dudit candidat”<\/em> (consid\u00e9rant 10). La valeur de ce raisonnement est de limiter la port\u00e9e d’une in\u00e9ligibilit\u00e9 l\u00e9gale par une interpr\u00e9tation finaliste. Le sens est de privil\u00e9gier la libert\u00e9 de candidature en l’absence d’atteinte concr\u00e8te au syst\u00e8me de remplacement. Enfin, le Conseil rejette le moyen tir\u00e9 d’un affichage excessif faute de preuve. Il qualifie l’affichage litigieux de simple action d’information, “n’ayant donc constitu\u00e9 ni une irr\u00e9gularit\u00e9 ni une manoeuvre”<\/em> (consid\u00e9rant 11).
