Le requ\u00e9rant, candidat malheureux, contestait la r\u00e9gularit\u00e9 du scrutin en raison d\u2019un sermon prononc\u00e9 le matin du vote par un pr\u00eatre. La question de droit portait sur l\u2019influence d\u00e9terminante d\u2019une ing\u00e9rence religieuse dans le processus \u00e9lectoral. Le juge constitutionnel a estim\u00e9 que cette intervention n\u2019avait pas alt\u00e9r\u00e9 la sinc\u00e9rit\u00e9 du scrutin.<\/p>\n<p>I. L\u2019exigence d\u2019une influence d\u00e9terminante sur le r\u00e9sultat<\/p>\n<p>Le Conseil constitutionnel a subordonn\u00e9 l\u2019annulation \u00e0 la preuve d\u2019un effet d\u00e9cisif sur l\u2019issue du vote. Il a constat\u00e9 qu\u2019il ne r\u00e9sultait pas de l\u2019instruction que les propos tenus en chaire par le cur\u00e9 d\u2019Alo aient eu une influence d\u00e9terminante. Cette condition stricte limite les contestations fond\u00e9es sur des pressions ext\u00e9rieures.<\/p>\n<p>La solution consacre un crit\u00e8re objectif et mesurable pour appr\u00e9cier l\u2019impact d\u2019une irr\u00e9gularit\u00e9. Le juge \u00e9carte ainsi toute annulation automatique en pr\u00e9sence d\u2019une simple intervention illicite. Cette approche garantit la stabilit\u00e9 des r\u00e9sultats \u00e9lectoraux tout en sanctionnant les abus av\u00e9r\u00e9s.<\/p>\n<p>II. La port\u00e9e de la r\u00e9probation malgr\u00e9 le rejet de la requ\u00eate<\/p>\n<p>Le Conseil a express\u00e9ment qualifi\u00e9 l\u2019acte litigieux de regrettable, en relevant que cette intervention \u00e9tait f\u00e2cheuse. Il affirme ainsi une valeur normative implicite : l\u2019ing\u00e9rence religieuse dans le vote est prohib\u00e9e. La d\u00e9cision pose une r\u00e8gle de principe sans pour autant l\u2019appliquer au cas d\u2019esp\u00e8ce.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est double : elle rappelle la neutralit\u00e9 exig\u00e9e dans le scrutin tout en limitant les recours. Le juge constitutionnel refuse d\u2019ordonner une enqu\u00eate suppl\u00e9mentaire, faute d\u2019\u00e9l\u00e9ment probant.
