Le Conseil constitutionnel, dans sa d\u00e9cision du 22 juin 1967, a rejet\u00e9 la requ\u00eate d\u2019un candidat contestant l\u2019\u00e9lection l\u00e9gislative dans la quatri\u00e8me circonscription de l\u2019Is\u00e8re. Le requ\u00e9rant d\u00e9non\u00e7ait l\u2019apposition de trois affiches par le d\u00e9put\u00e9 \u00e9lu ainsi que la publication d\u2019un appel de maires comportant une signature erron\u00e9e. La question de droit portait sur la r\u00e9gularit\u00e9 des op\u00e9rations \u00e9lectorales au regard des articles L. 90 et R. 26 du Code \u00e9lectoral. Le Conseil a estim\u00e9 que les irr\u00e9gularit\u00e9s constat\u00e9es n\u2019avaient pas alt\u00e9r\u00e9 la sinc\u00e9rit\u00e9 du scrutin, rejetant ainsi l\u2019annulation demand\u00e9e.<\/p>\n

I. La violation formelle des r\u00e8gles \u00e9lectorales sans influence d\u00e9terminante<\/p>\n

Le Conseil a reconnu que le candidat \u00e9lu avait enfreint la r\u00e8gle limitant le nombre d\u2019affiches autoris\u00e9es. Il a relev\u00e9 que \u00ab ces affiches, r\u00e9guli\u00e8res quant \u00e0 leur teneur, \u00e9taient, en raison de leur nombre, non conformes aux dispositions pr\u00e9cit\u00e9es du code \u00e9lectoral \u00bb (consid\u00e9rant 2). Cette constatation \u00e9tablit une m\u00e9connaissance objective des prescriptions l\u00e9gales. Toutefois, le juge constitutionnel a imm\u00e9diatement nuanc\u00e9 la port\u00e9e de cette violation en affirmant que ce fait \u00ab n\u2019a pu, \u00e0 lui seul, exercer sur le scrutin une influence de nature \u00e0 en changer le sens \u00bb (consid\u00e9rant 2). La valeur de ce raisonnement est de rappeler que toute irr\u00e9gularit\u00e9 n\u2019entra\u00eene pas automatiquement l\u2019annulation du scrutin. Le Conseil exige un lien de causalit\u00e9 direct entre la faute et le r\u00e9sultat \u00e9lectoral. En l\u2019esp\u00e8ce, le d\u00e9passement du nombre d\u2019affiches a \u00e9t\u00e9 jug\u00e9 insuffisant pour modifier l\u2019issue du vote. La port\u00e9e de cette solution est de fixer un seuil de tol\u00e9rance aux manquements formels, prot\u00e9geant la stabilit\u00e9 des \u00e9lections.<\/p>\n

II. La r\u00e9gularit\u00e9 des pratiques contest\u00e9es et l\u2019absence de fraude caract\u00e9ris\u00e9e<\/p>\n

Le Conseil a ensuite examin\u00e9 la diffusion d\u2019un appel de maires par un journal local la veille du scrutin. Il a jug\u00e9 que \u00ab la reproduction par un journal r\u00e9gional, la veille du scrutin, d\u2019un appel lanc\u00e9 ant\u00e9rieurement par voie d\u2019affiches par les maires de la circonscription en faveur du candidat \u00e9lu, n\u2019\u00e9tait pas illicite \u00bb (consid\u00e9rant 3). Le sens de cette d\u00e9cision est de valider la libert\u00e9 d\u2019expression et la reprise d\u2019informations d\u00e9j\u00e0 publiques. Concernant l\u2019erreur sur la signature d\u2019un maire, le Conseil a soulign\u00e9 que \u00ab le d\u00e9menti affich\u00e9 par ce dernier le matin du scrutin a pu permettre \u00e0 ses administr\u00e9s d\u2019\u00eatre inform\u00e9s en temps utile de sa position \u00bb (consid\u00e9rant 3). La valeur de ce constat est d\u2019\u00e9carter toute man\u0153uvre frauduleuse, puisque l\u2019erreur a \u00e9t\u00e9 corrig\u00e9e avant le vote. La port\u00e9e de cette analyse est de prot\u00e9ger la sinc\u00e9rit\u00e9 du scrutin tout en admettant des imperfections mineures.
