Le Conseil d’\u00c9tat, statuant au contentieux, a rendu le 20 f\u00e9vrier 1959 une d\u00e9cision relative \u00e0 la r\u00e9gularit\u00e9 des op\u00e9rations \u00e9lectorales s\u00e9natoriales au Gabon. Un requ\u00e9rant contestait la participation d’un d\u00e9put\u00e9, \u00e9lu au titre de plusieurs territoires, au scrutin du 8 juin 1958 en raison de son vote ant\u00e9rieur au Moyen-Congo en 1955. La question de droit portait sur la compatibilit\u00e9 d’une participation successive d’un m\u00eame d\u00e9put\u00e9 \u00e0 des \u00e9lections s\u00e9natoriales dans des territoires diff\u00e9rents. Le Conseil d’\u00c9tat a rejet\u00e9 la requ\u00eate en validant la participation du d\u00e9put\u00e9.<\/p>\n

I. L’absence d’interdiction l\u00e9gislative de la participation successive.
\nLe juge \u00e9carte le moyen tir\u00e9 d’une incapacit\u00e9 fond\u00e9e sur un vote ant\u00e9rieur dans un autre territoire. Il rappelle le texte applicable pour d\u00e9finir les droits du d\u00e9put\u00e9.<\/p>\n

A. La port\u00e9e de l’article 51 de la loi du 23 septembre 1948 modifi\u00e9e.
\nLe consid\u00e9rant reproduit int\u00e9gralement la disposition selon laquelle “les d\u00e9put\u00e9s \u00e9lus au titre de plusieurs territoires doivent faire conna\u00eetre… au nom de quel territoire ils d\u00e9sirent exercer leur droit de vote” (Consid\u00e9rant 2). Cette r\u00e8gle impose un choix pr\u00e9alable pour chaque scrutin, sans limiter le nombre de participations. Sa valeur est d’\u00eatre une simple formalit\u00e9 de d\u00e9claration, non une condition d’\u00e9ligibilit\u00e9.<\/p>\n

B. L’absence de prohibition dans les textes.
\nLe Conseil d’\u00c9tat constate qu'”aucune autre disposition l\u00e9gislative n’interdit \u00e0 un d\u00e9put\u00e9… de participer successivement \u00e0 des \u00e9lections s\u00e9natoriales int\u00e9ressant des territoires diff\u00e9rents” (Consid\u00e9rant 3). Le sens de cette affirmation est de consacrer la libert\u00e9 du parlementaire. La port\u00e9e est de rejeter toute interpr\u00e9tation restrictive qui cr\u00e9erait une incapacit\u00e9 implicite.<\/p>\n

II. La validation de la participation du d\u00e9put\u00e9 au scrutin gabonais.
\nLe juge conclut \u00e0 l’absence de fondement juridique de la contestation soulev\u00e9e par le requ\u00e9rant. Il applique le principe de l\u00e9galit\u00e9 \u00e0 la situation concr\u00e8te.<\/p>\n

A. L’absence de vice affectant la r\u00e9gularit\u00e9 des op\u00e9rations.
\nLe requ\u00e9rant soutenait que le vote de 1955 interdisait celui de 1958, mais le juge \u00e9carte ce raisonnement. Il estime que “le sieur Gondjout n’est pas fond\u00e9 \u00e0 soutenir que le sieur Bayrou… ne pouvait, pour ce motif, participer \u00e0 l’\u00e9lection du Gabon” (Consid\u00e9rant 3). La valeur de cette solution est de rappeler que seul un texte expr\u00e8s peut restreindre un droit \u00e9lectoral.<\/p>\n

B. La port\u00e9e de la d\u00e9cision sur le contentieux \u00e9lectoral.
\nCette d\u00e9cision affirme le principe de l’absence d’automaticit\u00e9 des causes d’incapacit\u00e9. Sa port\u00e9e est de garantir la souplesse n\u00e9cessaire au fonctionnement du coll\u00e8ge \u00e9lectoral s\u00e9natorial dans les territoires d’outre-mer.
