Cette r\u00e9forme a boulevers\u00e9 la pratique des entreprises et des juridictions prud&#8217;homales. Le 6 mars 2025, la cour d&#8217;appel de Paris a rendu un arr\u00eat important qui limite le champ de cette pr\u00e9somption lorsque le salari\u00e9 b\u00e9n\u00e9ficie d&#8217;un statut protecteur. Le dispositif est d\u00e9sormais encadr\u00e9 par l&#8217;article L. 1237-1-1 du code du travail et le d\u00e9cret d&#8217;application du 17 avril 2023. Le salari\u00e9 dispose d&#8217;un d\u00e9lai de quinze jours pour r\u00e9pondre \u00e0 la mise en demeure de son employeur. Pass\u00e9 ce d\u00e9lai, la rupture est pr\u00e9sum\u00e9e r\u00e9sulter d&#8217;une d\u00e9mission. Cette pr\u00e9somption n&#8217;est toutefois pas irr\u00e9fragable. L&#8217;employeur doit alors respecter une proc\u00e9dure stricte avant de pouvoir invoquer la pr\u00e9somption. Le caract\u00e8re volontaire de l&#8217;abandon constitue la pierre angulaire du m\u00e9canisme. La d\u00e9mission ne se pr\u00e9sume pas. Elle suppose une volont\u00e9 claire, s\u00e9rieuse et non \u00e9quivoque de la part du salari\u00e9. L&#8217;abandon de poste ne saurait \u00e0 lui seul \u00e9tablir cette volont\u00e9 sans la mise en demeure pr\u00e9vue par la loi.<\/p>\n<p>La cour d&#8217;appel de Versailles l&#8217;a rappel\u00e9 dans un arr\u00eat du 25 juin 2025 :<\/p>\n<blockquote>\n<p>\u00ab La d\u00e9mission ne se pr\u00e9sume pas et suppose une volont\u00e9 claire, s\u00e9rieuse et non \u00e9quivoque de la part du salari\u00e9. \u00bb (CA Versailles, 25 juin 2025, n\u00b0 23\/01581, <a href=\"https:\/\/www.courdecassation.fr\/decision\/685cd424e3c193a230870ee0\">d\u00e9cision<\/a>), motifs : \u00ab la d\u00e9mission ne se pr\u00e9sume pas et suppose une volont\u00e9 claire, s\u00e9rieuse et non \u00e9quivoque de la part du salari\u00e9 \u00bb.<\/p>\n<\/blockquote>\n<h2>Les conditions strictes de la mise en demeure<\/h2>\n<p>L&#8217;article R. 1237-13 du code du travail (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000047456645\">texte officiel<\/a>) pr\u00e9cise les modalit\u00e9s de la mise en demeure. L&#8217;employeur doit adresser au salari\u00e9 une lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception ou une lettre remise en main propre contre d\u00e9charge. Ce courrier doit imp\u00e9rativement mentionner deux obligations distinctes : justifier de l&#8217;absence et reprendre le poste. Le d\u00e9lai imparti au salari\u00e9 ne peut \u00eatre inf\u00e9rieur \u00e0 quinze jours \u00e0 compter de la date de pr\u00e9sentation de la mise en demeure.<\/p>\n<p>Le salari\u00e9 qui entend se pr\u00e9valoir d&#8217;un motif l\u00e9gitime doit l&#8217;indiquer dans sa r\u00e9ponse \u00e0 la mise en demeure. Les motifs l\u00e9gitimes peuvent inclure des raisons m\u00e9dicales, l&#8217;exercice du droit de retrait ou le droit de gr\u00e8ve. Le refus d&#8217;ex\u00e9cuter une instruction contraire \u00e0 une r\u00e9glementation ou la modification du contrat de travail \u00e0 l&#8217;initiative de l&#8217;employeur constituent \u00e9galement des motifs l\u00e9gitimes. L&#8217;employeur ne peut pas se contenter d&#8217;une simple demande de reprise du travail. La mise en demeure doit respecter la formulation l\u00e9gale sous peine d&#8217;irr\u00e9gularit\u00e9.<\/p>\n<h2>Comment contester la d\u00e9mission pr\u00e9sum\u00e9e devant les prud&#8217;hommes<\/h2>\n<p>L&#8217;article L. 1237-1-1 du code du travail ouvre au salari\u00e9 un recours direct devant le conseil de prud&#8217;hommes. Le salari\u00e9 qui conteste la rupture sur le fondement de cette pr\u00e9somption peut saisir le conseil de prud&#8217;hommes. L&#8217;affaire est alors directement port\u00e9e devant le bureau de jugement. Ce dernier se prononce sur la nature de la rupture et les cons\u00e9quences associ\u00e9es. Il statue au fond dans un d\u00e9lai d&#8217;un mois \u00e0 compter de sa saisine.<\/p>\n<p>Ce d\u00e9lai d&#8217;un mois est imp\u00e9ratif. Il vise \u00e0 acc\u00e9l\u00e9rer la r\u00e9solution du litige compte tenu de l&#8217;urgence pour le salari\u00e9 priv\u00e9 de ressources. Le juge examine si la mise en demeure respectait les formes l\u00e9gales. Il v\u00e9rifie ensuite si le d\u00e9lai de quinze jours a \u00e9t\u00e9 observ\u00e9. Enfin, il appr\u00e9cie si le salari\u00e9 disposait de motifs l\u00e9gitimes pour ne pas reprendre son poste. Le salari\u00e9 peut alors r\u00e9clamer le paiement de son salaire pendant la p\u00e9riode de rupture. Il peut \u00e9galement demander des indemnit\u00e9s compensatrices de pr\u00e9avis, une indemnit\u00e9 pour licenciement sans cause r\u00e9elle et s\u00e9rieuse et des dommages-int\u00e9r\u00eats pour pr\u00e9judice moral. Les cotisations de s\u00e9curit\u00e9 sociale et les droits \u00e0 retraite sont \u00e9galement r\u00e9gularis\u00e9s.<\/p>\n<p>La cour d&#8217;appel de Paris a condamn\u00e9 l&#8217;employeur dans son arr\u00eat du 6 mars 2025. Elle lui a inflig\u00e9 des dommages-int\u00e9r\u00eats pour mise \u00e0 pied abusive. Elle a aussi sanctionn\u00e9 le non-respect de la portabilit\u00e9 de la compl\u00e9mentaire sant\u00e9 et le pr\u00e9judice li\u00e9 \u00e0 la r\u00e9siliation unilat\u00e9rale du contrat d&#8217;assurance. Cette d\u00e9cision montre que l&#8217;employeur qui abuse du m\u00e9canisme de la pr\u00e9somption expose l&#8217;entreprise \u00e0 des condamnations lourdes. Le salari\u00e9 r\u00e9int\u00e9gr\u00e9 per\u00e7oit l&#8217;ensemble des salaires et avantages dus pendant la p\u00e9riode de rupture annul\u00e9e.<\/p>\n<h2>Le cas des salari\u00e9s prot\u00e9g\u00e9s et la d\u00e9cision de la cour d&#8217;appel de Paris du 6 mars 2025<\/h2>\n<p>La cour d&#8217;appel de Paris a rendu le 6 mars 2025 un arr\u00eat qui limite l&#8217;application de la pr\u00e9somption de d\u00e9mission aux salari\u00e9s prot\u00e9g\u00e9s. Dans cette affaire, un conseiller du salari\u00e9 avait \u00e9t\u00e9 mis \u00e0 pied conservatoire. L&#8217;inspection du travail avait refus\u00e9 d&#8217;autoriser son licenciement. L&#8217;employeur avait alors invoqu\u00e9 la pr\u00e9somption de d\u00e9mission apr\u00e8s que le salari\u00e9 n&#8217;eut pas repris son poste.<\/p>\n<p>La cour a retenu que la pr\u00e9somption l\u00e9gale de d\u00e9mission fait intervenir l&#8217;employeur dans la rupture du contrat de travail. Elle ne dispense donc pas l&#8217;employeur de solliciter l&#8217;autorisation de l&#8217;inspection du travail pour un salari\u00e9 prot\u00e9g\u00e9. La cour a \u00e9galement relev\u00e9 que la mise en demeure de l&#8217;employeur ne respectait pas la formulation exig\u00e9e par l&#8217;article R. 1237-13. L&#8217;employeur avait demand\u00e9 au salari\u00e9 de \u00ab justifier (son) absence ou de reprendre (son) poste \u00bb au lieu d&#8217;exiger la justification et la reprise. La cour a annul\u00e9 la rupture et ordonn\u00e9 la r\u00e9int\u00e9gration du salari\u00e9.<\/p>\n<blockquote>\n<p>\u00ab La pr\u00e9somption l\u00e9gale de d\u00e9mission qui fait intervenir l&#8217;employeur dans la rupture du contrat de travail, ne dispense pas ce dernier de solliciter l&#8217;inspection du travail, d&#8217;autant plus que le salari\u00e9 pr\u00e9sum\u00e9 avoir d\u00e9missionn\u00e9 au sens et dans les conditions de l&#8217;article pr\u00e9cit\u00e9 doit avoir abandonn\u00e9 volontairement son poste, ce qui ne saurait \u00eatre applicable \u00e0 un salari\u00e9 qui a \u00e9t\u00e9 mis \u00e0 pied \u00e0 titre conservatoire. \u00bb (CA Paris, 6 mars 2025, n\u00b0 24\/02319, <a href=\"https:\/\/www.courdecassation.fr\/decision\/67ca8f05b05f898609a8c182\">d\u00e9cision<\/a>), motifs : \u00ab La pr\u00e9somption l\u00e9gale de d\u00e9mission qui fait intervenir l&#8217;employeur dans la rupture du contrat de travail, ne dispense pas ce dernier de solliciter l&#8217;inspection du travail \u00bb.<\/p>\n<\/blockquote>\n<h2>Abandon de poste et licenciement pour faute grave : ce que dit la jurisprudence<\/h2>\n<p>L&#8217;employeur peut \u00e9galement licencier le salari\u00e9 pour faute grave en cas d&#8217;abandon de poste. La faute grave est celle qui rend imm\u00e9diatement impossible le maintien du salari\u00e9 dans l&#8217;entreprise. La cour d&#8217;appel d&#8217;Aix-en-Provence a pr\u00e9cis\u00e9 dans un arr\u00eat du 5 d\u00e9cembre 2025 :<\/p>\n<blockquote>\n<p>\u00ab La faute grave, qui peut seule justifier une mise \u00e0 pied conservatoire, est celle qui r\u00e9sulte d&#8217;un fait ou d&#8217;un ensemble de faits imputables au salari\u00e9 mat\u00e9rialisant une violation des obligations d\u00e9coulant du contrat de travail ou des relations de travail d&#8217;une importance telle qu&#8217;elle rend impossible le maintien du salari\u00e9 dans l&#8217;entreprise. \u00bb (CA Aix-en-Provence, 5 d\u00e9cembre 2025, n\u00b0 22\/09142, <a href=\"https:\/\/www.courdecassation.fr\/decision\/6933fdb6406d06a9f72f4510\">d\u00e9cision<\/a>), motifs : \u00ab La faute grave, qui peut seule justifier une mise \u00e0 pied conservatoire, est celle qui r\u00e9sulte d&#8217;un fait ou d&#8217;un ensemble de faits imputables au salari\u00e9 mat\u00e9rialisant une violation des obligations d\u00e9coulant du contrat de travail ou des relations de travail d&#8217;une importance telle qu&#8217;elle rend impossible le maintien du salari\u00e9 dans l&#8217;entreprise \u00bb.<\/p>\n<\/blockquote>\n<p>L&#8217;employeur doit engager la proc\u00e9dure de licenciement dans un d\u00e9lai restreint. La prolongation de l&#8217;abandon de poste au-del\u00e0 de quelques semaines d\u00e9sorganise l&#8217;entreprise. Elle peut alors justifier un licenciement pour faute grave.<\/p>\n<h2>Checklist : les 5 \u00e9tapes pour contester une d\u00e9mission pr\u00e9sum\u00e9e<\/h2>\n<ol>\n<li><strong>Conserver la mise en demeure<\/strong> : photographiez ou scannez la lettre recommand\u00e9e ou la remise en main propre.<\/li>\n<li><strong>V\u00e9rifiez le d\u00e9lai<\/strong> : le d\u00e9lai de r\u00e9ponse ne peut \u00eatre inf\u00e9rieur \u00e0 quinze jours \u00e0 compter de la pr\u00e9sentation.<\/li>\n<li><strong>R\u00e9digez une r\u00e9ponse motiv\u00e9e<\/strong> : indiquez les motifs l\u00e9gitimes qui justifient votre absence dans le d\u00e9lai imparti.<\/li>\n<li><strong>Saisissez les prud&#8217;hommes dans le mois<\/strong> : le bureau de jugement doit statuer dans un d\u00e9lai d&#8217;un mois.<\/li>\n<li><strong>R\u00e9clamez la nullit\u00e9 et la r\u00e9int\u00e9gration<\/strong> : si vous \u00eates salari\u00e9 prot\u00e9g\u00e9, exigez l&#8217;autorisation pr\u00e9alable de l&#8217;inspection du travail.<\/li>\n<\/ol>\n<h2>Abandon de poste et prud&#8217;hommes \u00e0 Paris et en \u00cele-de-France<\/h2>\n<p>Le contentieux de la d\u00e9mission pr\u00e9sum\u00e9e rel\u00e8ve de la comp\u00e9tence du conseil de prud&#8217;hommes du lieu de travail. \u00c0 Paris et en \u00cele-de-France, le conseil de prud&#8217;hommes de Paris est comp\u00e9tent pour les salari\u00e9s dont le lieu de travail se situe dans le ressort. Tout d\u00e9lai inf\u00e9rieur est irr\u00e9gulier.<\/p>\n<p><strong>La pr\u00e9somption de d\u00e9mission s&#8217;applique-t-elle aux salari\u00e9s en arr\u00eat maladie ?<\/strong><\/p>\n<p>Non. Le salari\u00e9 en arr\u00eat maladie ne peut \u00eatre pr\u00e9sum\u00e9 d\u00e9missionnaire pour absence li\u00e9e \u00e0 son \u00e9tat de sant\u00e9. L&#8217;arr\u00eat maladie constitue un motif l\u00e9gitime.<\/p>\n<p><strong>Peut-on contester la d\u00e9mission pr\u00e9sum\u00e9e si on a quitt\u00e9 son poste pour harc\u00e8lement moral ?<\/strong><\/p>\n<p>Oui. Le harc\u00e8lement moral constitue une cause de nullit\u00e9 du licenciement. L&#8217;exercice du droit de retrait pour danger grave et imminent est \u00e9galement un motif l\u00e9gitime.<\/p>\n<p><strong>Que se passe-t-il si l&#8217;employeur n&#8217;a pas respect\u00e9 la forme de la mise en demeure ?<\/strong><\/p>\n<p>La pr\u00e9somption ne peut pas s&#8217;appliquer.
