Les juges ont retenu que le bruit excessif g\u00e9n\u00e9r\u00e9 par les activit\u00e9s ext\u00e9rieures de l&#8217;\u00e9tablissement d\u00e9passait de plusieurs dizaines de d\u00e9cibels les niveaux r\u00e9glementaires. Ce jugement rappelle que le respect des horaires d&#8217;exploitation et l&#8217;absence de faute de gestion n&#8217;exon\u00e8rent pas le responsable lorsque son activit\u00e9 cause un trouble anormal. En pratique, de nombreux propri\u00e9taires et locataires subissent des nuisances sonores, olfactives ou visuelles sans savoir comment agir. Pourtant, le droit offre des outils pr\u00e9cis pour faire cesser le trouble et obtenir une indemnisation. La difficult\u00e9 r\u00e9side dans la preuve. L&#8217;article expose les fondements juridiques du trouble anormal de voisinage, les moyens probatoires efficaces et la strat\u00e9gie proc\u00e9durale pour s\u00e9curiser une r\u00e9paration.<\/p>\n<h2>Qu&#8217;est-ce qu&#8217;un trouble anormal de voisinage ?<\/h2>\n<p>L&#8217;article 651 du code civil (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006429953\">texte officiel<\/a>) dispose que : \u00ab La loi assujettit les propri\u00e9taires \u00e0 diff\u00e9rentes obligations l&#8217;un \u00e0 l&#8217;\u00e9gard de l&#8217;autre, ind\u00e9pendamment de toute convention. \u00bb Ce texte fonde le principe selon lequel nul ne doit causer \u00e0 autrui un trouble de voisinage. La jurisprudence a pr\u00e9cis\u00e9 que seul le trouble exc\u00e9dant les inconv\u00e9nients normaux de voisinage engage la responsabilit\u00e9 de son auteur.<\/p>\n<p>L&#8217;article R. 1336-5 du code de la sant\u00e9 publique (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035425967\">texte officiel<\/a>) compl\u00e8te ce cadre : \u00ab Aucun bruit particulier ne doit, par sa dur\u00e9e, sa r\u00e9p\u00e9tition ou son intensit\u00e9, porter atteinte \u00e0 la tranquillit\u00e9 du voisinage ou \u00e0 la sant\u00e9 de l&#8217;homme, dans un lieu public ou priv\u00e9, qu&#8217;une personne en soit elle-m\u00eame \u00e0 l&#8217;origine ou que ce soit par l&#8217;interm\u00e9diaire d&#8217;une personne, d&#8217;une chose dont elle a la garde ou d&#8217;un animal plac\u00e9 sous sa responsabilit\u00e9. \u00bb<\/p>\n<p>La Cour d&#8217;appel de Lyon l&#8217;a affirm\u00e9 dans un arr\u00eat du 15 avril 2025, n\u00b0 23\/04772 (<a href=\"https:\/\/www.courdecassation.fr\/decision\/67ff39d1303a1b38839f7d95\">d\u00e9cision<\/a>), motifs : \u00ab nul ne doit causer \u00e0 autrui de trouble anormal de voisinage, et qu&#8217;\u00e0 d\u00e9faut, l&#8217;auteur en devra r\u00e9paration, m\u00eame en l&#8217;absence de faute. L&#8217;anormalit\u00e9 du trouble s&#8217;appr\u00e9cie au regard des circonstances locales et est caract\u00e9ris\u00e9e lorsque ce trouble pr\u00e9sente un caract\u00e8re grave et\/ou r\u00e9p\u00e9t\u00e9, d\u00e9passant les inconv\u00e9nients normaux de voisinage. \u00bb<\/p>\n<p>Ainsi, la responsabilit\u00e9 est objective. Le demandeur n&#8217;a pas \u00e0 d\u00e9montrer une faute. Il doit \u00e9tablir un rapport de voisinage, un trouble anormal, un pr\u00e9judice et un lien de causalit\u00e9 entre ces \u00e9l\u00e9ments.<\/p>\n<h2>Comment prouver le trouble anormal de voisinage<\/h2>\n<p>La preuve constitue l&#8217;enjeu central du contentieux. Le juge appr\u00e9cie souverainement l&#8217;existence du trouble au regard des \u00e9l\u00e9ments produits.<\/p>\n<h3>Checklist des 5 \u00e9tapes pour constater et prouver le trouble<\/h3>\n<ol>\n<li><strong>R\u00e9diger des courriers recommand\u00e9s au voisin<\/strong> : chaque envoi constitue un point de d\u00e9part du d\u00e9lai de prescription et prouve la mise en demeure amiable.<\/li>\n<li><strong>Faire \u00e9tablir des constats d&#8217;huissier<\/strong> : le constat dresse un \u00e9tat des lieux factuel et dat\u00e9 des nuisances. Il est admissible et p\u00e8se fortement dans l&#8217;appr\u00e9ciation du juge.<\/li>\n<li><strong>R\u00e9unir des t\u00e9moignages \u00e9crits de voisins<\/strong> : les attestations de tiers \u00e9tablissent le caract\u00e8re r\u00e9p\u00e9t\u00e9 et grave du trouble dans son contexte local.<\/li>\n<li><strong>Obtenir un rapport de mesures acoustiques<\/strong> : pour les nuisances sonores, un technicien ou un acousticien peut mesurer les niveaux de bruit et les \u00e9mergences au regard du d\u00e9cret n\u00b0 2006-1099.<\/li>\n<li><strong>Saisir le juge d&#8217;une demande d&#8217;expertise judiciaire<\/strong> : l&#8217;expert d\u00e9sign\u00e9 par le tribunal proc\u00e8de \u00e0 des relev\u00e9s in situ et \u00e9met des pr\u00e9conisations techniques. Ses conclusions font autorit\u00e9 sur le caract\u00e8re anormal du trouble.<\/li>\n<\/ol>\n<p>Le tribunal judiciaire de Lisieux a retenu dans un jugement du 4 novembre 2025, n\u00b0 24\/00041 (<a href=\"https:\/\/www.courdecassation.fr\/decision\/690a848443d68eab408d1be9\">d\u00e9cision<\/a>), motifs : \u00ab la responsabilit\u00e9 pour trouble anormal de voisinage est un r\u00e9gime de responsabilit\u00e9 civile sans faute de telle sorte que l\u2019appr\u00e9ciation souveraine d\u2019un tel trouble n\u2019est pas exclue en l\u2019absence de violation des normes r\u00e9glementaires acoustiques. \u00bb En l&#8217;esp\u00e8ce, l&#8217;expert avait conclu que les nuisances sonores \u00e9taient caract\u00e9ris\u00e9es malgr\u00e9 le respect des valeurs limites dans certaines zones.<\/p>\n<p>La Cour de cassation a \u00e9galement pr\u00e9cis\u00e9 dans un arr\u00eat du 13 juin 2024, n\u00b0 22-21.250 (<a href=\"https:\/\/www.courdecassation.fr\/decision\/666a8c05c0b8d30008019084\">d\u00e9cision<\/a>), motifs : \u00ab le juge, qui constate l&#8217;existence de troubles de jouissance subis par un locataire, appr\u00e9cie souverainement les mesures propres \u00e0 les faire cesser en faisant injonction \u00e0 leur auteur de proc\u00e9der \u00e0 des travaux. \u00bb<\/p>\n<h2>Quels pr\u00e9judices le juge indemnise-t-il<\/h2>\n<p>Le trouble anormal de voisinage ouvre droit \u00e0 r\u00e9paration de plusieurs pr\u00e9judices distincts.<\/p>\n<p>Le pr\u00e9judice de jouissance est le principal chef d&#8217;indemnisation. Il correspond \u00e0 la privation ou \u00e0 la r\u00e9duction de la possibilit\u00e9 de jouir normalement de son bien. Constitue un pr\u00e9judice de jouissance la g\u00eane et la perte de confort subies par les occupants d&#8217;un immeuble en raison de nuisances anormales.<\/p>\n<p>Le pr\u00e9judice moral est \u00e9galement r\u00e9parable lorsque le trouble a affect\u00e9 la sant\u00e9 mentale de la victime. Le tribunal de Bobigny a ainsi allou\u00e9 10 000 euros de dommages-int\u00e9r\u00eats pour pr\u00e9judice moral \u00e0 un voisin dont l&#8217;examen psychologique avait conclu \u00e0 une r\u00e9action psychotraumatique av\u00e9r\u00e9e li\u00e9e aux nuisances sonores.<\/p>\n<p>Le tribunal de Bobigny a en outre pr\u00e9cis\u00e9 dans son jugement du 17 novembre 2025, n\u00b0 24\/02040 (<a href=\"https:\/\/www.courdecassation.fr\/decision\/691c586b8b6588a4f89a277c\">d\u00e9cision<\/a>), motifs : \u00ab le fait que la soci\u00e9t\u00e9 respecte les lois et r\u00e8glements dans le cadre de l&#8217;exploitation de son h\u00f4tel-restaurant et ne commette aucune faute dans sa gestion n&#8217;est pas de nature \u00e0 l&#8217;exon\u00e9rer de sa responsabilit\u00e9 \u00e0 partir du moment o\u00f9 son activit\u00e9 cause un trouble anormal de voisinage. \u00bb<\/p>\n<p>La perte de valeur v\u00e9nale du bien est plus difficile \u00e0 \u00e9tablir. Le juge exige la preuve d&#8217;une d\u00e9valorisation d\u00e9finitive et certaine. Une simple attestation d&#8217;agence immobili\u00e8re ne suffit pas sans d\u00e9montrer l&#8217;impossibilit\u00e9 de faire cesser les nuisances.<\/p>\n<h2>La proc\u00e9dure pour faire cesser le trouble et obtenir r\u00e9paration<\/h2>\n<p>La premi\u00e8re \u00e9tape consiste \u00e0 adresser une mise en demeure au voisin par courrier recommand\u00e9 avec accus\u00e9 de r\u00e9ception. Ce courrier rappelle l&#8217;existence du trouble, exige sa cessation et menace une action judiciaire. Il constitue un acte interruptif de prescription.<\/p>\n<p>En l&#8217;absence de r\u00e9sultat, deux voies sont possibles. La proc\u00e9dure de r\u00e9f\u00e9r\u00e9 permet d&#8217;obtenir rapidement une injonction de faire ou une astreinte. Elle est utile lorsque le trouble est continu et que la victime souffre d&#8217;un pr\u00e9judice urgent. La proc\u00e9dure au fond, par assignation devant le tribunal judiciaire, vise une condamnation d\u00e9finitive aux dommages-int\u00e9r\u00eats.<\/p>\n<p>L&#8217;article 1240 du code civil (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032041571\">texte officiel<\/a>) dispose que : \u00ab Tout fait quelconque de l&#8217;homme, qui cause \u00e0 autrui un dommage, oblige celui par la faute duquel il est arriv\u00e9 \u00e0 le r\u00e9parer. \u00bb Bien que le trouble anormal de voisinage rel\u00e8ve d&#8217;une responsabilit\u00e9 sans faute, ce texte est invoqu\u00e9 accessoirement lorsque la faute de l&#8217;auteur est \u00e9tablie.<\/p>\n<p>L&#8217;action en r\u00e9paration du trouble anormal de voisinage est soumise \u00e0 la prescription quinquennale applicable aux actions en responsabilit\u00e9 civile extra-contractuelle. Le point de d\u00e9part court \u00e0 compter de la survenance du trouble ou de son aggravation.<\/p>\n<h2>Trouble de voisinage \u00e0 Paris et en \u00cele-de-France : comp\u00e9tence et d\u00e9lais<\/h2>\n<p>Le tribunal judiciaire du lieu de la r\u00e9sidence du d\u00e9fendeur est comp\u00e9tent pour conna\u00eetre du litige. Alternativement, la victime peut saisir le tribunal du lieu o\u00f9 se produit le trouble. \u00c0 Paris et en \u00cele-de-France, les tribunaux judiciaires de Paris, Nanterre, Bobigny, Cr\u00e9teil et Versailles traitent quotidiennement ce type de contentieux.<\/p>\n<p>Le d\u00e9lai de prescription est de cinq ans. Il convient donc d&#8217;agir sans tarder d\u00e8s l&#8217;apparition du trouble. L&#8217;absence de r\u00e9ponse \u00e0 une mise en demeure ne constitue pas une reconnaissance non \u00e9quivoque du droit de la victime. Seule une r\u00e9ponse \u00e9crite admettant le trouble ou une attitude conciliante traduisant une acceptation ferme peut avoir cet effet.<\/p>\n<p><strong>Dois-je obligatoirement faire appel \u00e0 un expert acousticien pour prouver un bruit ?<\/strong><\/p>\n<p>Non. L&#8217;expertise acoustique n&#8217;est pas obligatoire. Le juge peut retenir l&#8217;existence d&#8217;un trouble sur la base de constats d&#8217;huissier, de t\u00e9moignages et de pi\u00e8ces photographiques ou vid\u00e9o. L&#8217;expertise renforce toutefois consid\u00e9rablement la d\u00e9monstration.<\/p>\n<p><strong>Puis-je obtenir l&#8217;arr\u00eat imm\u00e9diat de l&#8217;activit\u00e9 nuisible ?<\/strong><\/p>\n<p>Le juge peut ordonner la cessation du trouble par injonction. Toutefois, il appr\u00e9cie souverainement la proportionnalit\u00e9 de la mesure. Il peut estimer qu&#8217;une simple condamnation financi\u00e8re suffit si le trouble peut \u00eatre att\u00e9nu\u00e9 par des travaux.<\/p>\n<p><strong>La location de mon bien me prive-t-elle du droit d&#8217;obtenir des dommages-int\u00e9r\u00eats ?<\/strong><\/p>\n<p>Non. Le propri\u00e9taire non occupant peut agir \u00e0 condition de rapporter la preuve d&#8217;un pr\u00e9judice personnel et direct. La perte de locataire, l&#8217;impossibilit\u00e9 de relouer ou la d\u00e9gradation du bien peuvent constituer ce pr\u00e9judice.<\/p>\n<p><strong>Quel est le co\u00fbt d&#8217;une proc\u00e9dure de trouble de voisinage ?<\/strong><\/p>\n<p>Le co\u00fbt varie selon la complexit\u00e9 du dossier.
