Neither party was present or represented. DECISION It is the unanimous decision of the tribunal that the Appellant's Appeal succeeds. REASONS On 8th December 1998 the Social Services Appeal Panel of North Lincolnshire Council decided to cancel the Appellant's registration as manager of Newgrove House, Residential Home. On 23rd December 1998 the Appellant filed and served a Notice of Appeal against that decision. The Appellant's Appeal was due to be heard on 24th, 25th and 26th May 1999. On 16 April 1999 North East Lincolnshire Council filed a Statement of Reasons for their decision of Dec 8th 1998. On 4th May 1999 North East Lincolnshire Council wrote to the Registered Homes Tribunal Secretariat advising them that the situation had changed following their annual inspection of Newgrove House on 8th April 1999. In the light of that inspection they no longer felt that it was appropriate to continue with their decision to cancel Mrs Khurana's registration as manager and accordingly did not wish to offer any evidence in respect of her appeal. It is therefore the unanimous decision of the Tribunal that the Appeal succeeds. I confirm that this is the unanimous decision of the tribunal
