CN:2564/19 IN THE DISTRICT COURT OF PORT LOUIS (2nd Division) In the matter of:
POLICE V MINOR HENRIETTE Jolann Cedric
JUDGMENT
Accused stands charged with the offence of Assault in breach of sections 228(1) and 230 (1) of the Criminal Code. Accused pleaded not guilty to the charge and was not represented at trial stage. Responsible party, Mrs Chrisna Momus was present throughout proceedings. Prosecution called witness no.1 WPC Benedin-Luchmun, who read and produced defence statement of the accused, marked as Doc A Same contained a confession. Prosecution then called witness no.2, WPC Euphemie, who related that she saw an injury on the complainant’s knee. The case was then closed for the Prosecution. The accused was informed of his Constitutional rights in creole and elected to make a statement from the dock. Accused begged for excuse.

The case was then closed for the Defence. The Court has considered the evidence on record and has carefully watched the witnesses. » The accused made a full-fledged confession. This in itself is enough to conclude that the Prosecution has proven its case beyond reasonable doubt and accordingly finds the accused guilty as charged.
