CN: 853/23 THE INTERMEDIATE COURT OF MAURITIUS (CIVIL DIVISION) In the matter of:- Modern Refrigeration Service Ltd Plaintiff v/s 1. Ajmol Enterprise Ltd (in Receivership) 2. Abdul Sattar Adam Ali Mamode Hajee Abdoula Defendants JUDGMENT: 1. As per the Amended Proecipe, the Plaintiff is praying for a judgment condemning and ordering the Defendants jointly and solido to pay to it the sum Rs1,483,354.70/-.
2. It is agreed between all parties that the services of the Plaintiff were retained for the construction of the New SMF Regimental Medical Unit at Vacoas and for the reconstruction of the Abdool Raman Government School in Port Louis (Phase 1).
3. The representative of the Plaintiff testified to the effect that previously the Plaintiff was claiming Rs783,076.20 for the construction of the New SMF Regimental Medical Unit at Vacoas. The Plaintiff has now revised the figure and is now claiming Rs594,292.20.
4. Previously the Plaintiff was claiming Rs888,662.50 for the reconstruction of the Abdool Raman Government School in Port Louis (Phase 1). The Plaintiff has now revised the figure and is now claiming Rs889,062.50.
5. The representative of both Defendants testified in court and agreed with both amounts claimed by the Plaintiff and stated that the Defendants are agreeable to pay the sum of Rs1,483,354.70 as the total sum for both projects.
6. I have duly analysed all the evidence on record. In light of the admission of the representative of the Defendants, I order both Defendants jointly and in solido to pay to the Plaintiff the sum of Rs1,483,354.70 for both projects.
7. With regards to cost, the Plaintiff’s Counsel has stated the Plaintiff is not insisting on costs, there is therefore no order as to cost.
