2. In directions issued on 1 July 2025, the appellant was directed as follows: 1. The Appellant must respond to the Tribunal no later than 5pm on 17 July 2025 to confirm whether they wish to continue with their appeal. If they wish to continue with their appeal, they must make representations as to why the case should not be struck out. 2. Failure to do so could result in the Tribunal striking out the Appellant’s case. 3. The appellant was further warned: 7. The Appellant is therefore required to confirm their position regarding the above. If no response is received, the Appellant is on notice that the Tribunal may strike out the appeal. 4. No response has been received from the appellant. 5. I am satisfied that pursuant to rule 8(4) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 (the Procedure Rules), the appellant was notified of the possibility that these proceedings would be struck out and has had a proper opportunity to provide a response. 6. I am satisfied that the appellant has failed to comply with a direction which stated that failure to comply could result in the proceedings being struck out and that the appellant’s failure to co-operate means that the tribunal cannot deal with the matter fairly or justly. Given these failings, it is not necessary for me to address the issue of whether the appeal has no realistic prospect of success.
